    LaJeromeny Brown, 44, is due for a case status update before Madison County Circuit Court Judge Chris Comer. Brown is facing a capital murder charge and prosecutors are seeking the death penalty, but no trial date has been set.

    Trial set for man accused of killing Huntsville police officer Billy Clardy III

    A judge has set the capital murder trial date for the man accused of shooting and killing a Huntsville Police officer in 2019.

    LaJeromeny Brown's trial is set for October 16, 2023.

    Brown is accused of killing STAC Agent Billy Clardy III, a 48-year-old husband and father of five, during a drug task force operation in northeast Huntsville on Dec. 6, 2019.

    Previously, a judge blamed pandemic related court issues for delaying the trial. The judge said Thursday morning during the status hearing he expects it to last about three weeks.

    State prosecutors are seeking the death penalty in this case.

    MADISON COUNTY, Ala. — The man accused of shooting and killing a Huntsville Police officer in 2019 is facing a new charge, according to court documents.

    LaJeromeny Brown, 44, charged in the death of the Huntsville Police Department’s (HPD) Strategic Counter-Drug Team (STAC) Unit Agent Billy Clardy, III, during an operation where officers were attempting to buy 100 pounds of marijuana from Brown.

    On March 16, 2023, court records say Brown tried to bring a cell phone into the jail, leading to the misdemeanor charge of promoting prison contraband.

    As for his capital murder charges, testimony at Brown's preliminary hearing in 2020 indicated that two HPD officers were inside the house waiting to arrest Brown when he entered. Brown entered the home and encountered Clardy, who was shot twice.

    It was December 6, 2019. Clardy died later that night from his injuries.

    Brown now faces a capital murder charge and prosecutors have made it known that they are seeking the death penalty.

    A bond of $500 was added to Brown’s misdemeanor case, though he is still being held without bond for the capital murder charge.

    Court records show an appearance docket has been scheduled for Tuesday, April 11.

    Man charged in HPD Officer Clardy’s death asks to delay trial, citing ‘media frenzy’ after Officer Crumby’s death

    HUNTSVILLE, Ala. (WHNT) — The man accused of killing Huntsville Police Officer Billy Clardy, III, has asked the court to delay his capital murder trial due to the recent shooting death of HPD Officer Garrett Crumby.

    LaJeromeny Brown, 44, was arrested on December 7, 2019. He was charged with capital murder in the death of Clardy, a Strategic Counter-Drug Team (STAC) Unit Agent, who was killed during an operation where officers were attempting to buy 100 pounds of marijuana from Brown.

    Brown’s capital murder trial is currently set for October 16, but he asked the court for a continuance given the “similarities of the two cases,” and “the media frenzy,” according to court records.

    The motion states, “In light of the extensive media coverage and the prejudicial atmosphere it has created, it is essential to grant a motion to continue Mr.Brown’s trial proceedings.”

    Madison County Circuit Judge Chris Comer told News 19 they do not expect to make a decision this week and that a hearing will be scheduled within the next 60 days.

    On March 16, 2023, Brown was additionally charged with promoting prison contraband, after court records say he tried to bring a cell phone into the jail.

    Attorneys for LaJeromeny Brown called for the trial delay in a June 7 court filing. The defense argues the March killing of Huntsville Police Department officer Garrett Crumby was similar to Clardy’s death, and the extensive media coverage has created a “prejudicial atmosphere” against the defendant.

    Brown is currently set to go on trial on October 16.

    “By granting this motion, the court will have the opportunity to allow the media frenzy to subside and provide ample time for the defendant’s legal team to prepare an effective defense,” the court filing argued. “A continuance will enable the court to select a jury that has not been unduly influenced by media coverage and ensure a fair trial for the defendant.”

    Madison County Circuit Judge Chris Comer responded to the request by setting a hearing date for Friday.

    Clardy, a STAC agent, was killed in December 2019 during a failed drug sting at a house on Levert Street, where Brown was supposed to sell undercover officers 100 pounds of marijuana. Prosecutors are seeking the death penalty.

    Crumby was killed March 28 after he and Officer Albert Morin responded to a shots fired call at the Governors House Apartments.

    Investigators say Crumby was shot multiple times by Juan Laws of Huntsville. Morin was badly wounded in the encounter, but he returned to light-duty work on Monday. Prosecutors are also seeking the death penalty for Laws.

    A Madison County circuit judge will not delay the trial of a man accused of killing a Huntsville police officer in 2019.

    Circuit Judge Chris Comer today denied a motion to continue the trial of LaJeromeny Brown, 45, the man accused of shooting and killing Huntsville police Officer Billy Fred Clardy III.

    Comer also set a status conference for Sept. 6 at 11 a.m. prior to the capital murder trial, currently set for Oct. 16.

    Attorneys for Brown in June had argued to delay the trial because of the March 28, 2023 fatal shooting of Officer Garrett Crumby, 36, who died from wounds received at an apartment complex on the 4600 block of Governors House Drive. Officer Albert Morin, 34, who was also wounded, returned to duty this week.

    In court documents, Brown’s attorneys contended that the case was “likely to continue to receive extensive publicity,” and a continuance would allow the “media frenzy” to die down and the court to pick a jury “not unduly influenced.”

    Clardy and several other police officers were conducting a drug operation to buy 100 pounds of marijuana from Brown at a home on Levert Street in northeast Huntsville, according to the authorities and previous court testimony.

    During a court hearing, Huntsville police Investigator Chris Hines testified that Clardy and another officer were waiting inside the home when Brown showed up with a suitcase and other bags. When Brown opened the front door, Clardy moved in to arrest him, the investigator testified. Hines told the court that no one in the house spoke before Brown fired eight shots — two of them hit Clardy — from a modified 9mm Glock.

    Police captured Brown about 100 yards from the house. Prosecutors have said they will seek the death penalty.

    Court approves jury consultant for trial of man charged with killing STAC Agent Clardy

    HUNTSVILLE, Ala. (WHNT) — LaJeromeny Brown, who is charged with killing Huntsville Police Department STAC Agent Billy Clardy, is set to go on trial in mid-October and prosecutors are seeking the death penalty.

    Brown’s defense team told the court this week it needs more help, and the court approved their request.

    The defense filed a motion Tuesday requesting the court approve up to $3,500 to pay for a jury consultant, at a rate of $70 per hour. The defense filing says it is a death penalty case and would-be jurors will be asked to answer a lengthy questionnaire.

    The defense also asked the court to approve the selection of Huntsville attorney Robin Wolfe to assist with jury selection.

    Wolfe has extensive experience in jury selection in death penalty cases, the defense filing notes. Defense attorney Bruce Gardner said in the filing that he has previously worked with Wolfe on death penalty cases and that she “has keen insight into this process.”

    Madison County Circuit Judge Chris Comer approved the request on Wednesday.

    HUNTSVILLE, Ala. — An estimated 600 jury summons will be issued for prospective jurors in the upcoming capital murder trial of a man accused of killing Huntsville STAC Agent Billy Clardy in December 2019.

    During a status hearing in the case Wednesday morning, Madison County Circuit Judge Chris Comer said the goal is to have a jury panel of 130 people. That pool of would-be jurors will be given a roughly 40-page questionnaire for the attorneys to review as part of jury selection.

    LaJeromeny Brown, 45, is set to go on trial beginning Oct. 16 and prosecutors are seeking the death penalty. Both sides in the case said much of the questionnaire is focused on attitudes about the death penalty and the level of public awareness about the case.

    Clardy was fatally wounded in a house on Levert Street in Huntsville during a botched drug sting on Dec. 6, 2019. He later died at Huntsville Hospital. Investigators say an undercover officer had arranged to buy 100 pounds of marijuana from Brown. Clardy and another officer were waiting inside the house where Brown had agreed to meet. Clardy was shot in the encounter, according to testimony from Brown’s preliminary hearing.

    Judge Comer on Wednesday held a status hearing focused on trial logistics. After conferring with defense attorneys Bruce Gardner and Eric Wood, Madison County Chief Deputy District Attorney Tim Gann and Tim Douthit, chief trial attorney for the DA’s office, a proposed schedule was laid out.

    Jury summons are set to go out next week with jurors due to report on Oct. 16. A pool of 130 people will be drawn from that number and they will be given questionnaires to fill out. Once the questionnaires are submitted, the defense and prosecution will have two full days to review. The judge had initially suggested one day, but the defense asked for more time given the volume of questions and the number of would-be jurors.

    The jury pool will report in four groups over four days for individual voir dire – basically, jury questioning by the judge and lawyers – with a goal of selecting a jury by Tuesday, Oct. 24.

    Opening statements in the case are tentatively set for Oct. 25 and the prosecution said it expects it can finish its case within two and a half days.

    If Brown is convicted of capital murder, there would then be a penalty phase to the trial. The penalty phase is where the same jury decides on one of two possible sentences – death or life in prison without parole.

    The defense has already expressed concern about the climate surrounding this case.

    HUNTSVILLE, Ala. (WHNT) — Lawyers for LaJeromeny Brown, who is charged with killing Huntsville Police Department STAC Agent Billy Clardy, have asked the state to reveal the name of a confidential informant.

    In a filing on Tuesday, Brown’s lawyers asked the court to order the state to produce any information related to the confidential informant in the case, including their name, deals entered with them and any interviews conducted.

    “Undersigned counsel have requested any information on, documents prepared by, or interviews recorded of the confidential informant (who is unknown to the Defense beyond a nickname) regarding what happened the day of the offense,” the filing says.

    Brown’s counsel cites a Supreme Court case, Roviaro v. United States, where the court held that if a confidential informant is a material witness, or “an active participant in the illegal transaction which leads to the charges brought against the accused, then the accused is entitled to learn from the State the identity of the confidential informant and his address.”

    There is a status hearing in the case set for Thursday morning.

    HUNTSVILLE, Ala. — Attorneys for accused killer LaJeromeny Brown successfully lobbied a judge to give them information about a confidential informant connected to the sting operation that allegedly led to the death of a drug task force member.

    At a hearing held in a Madison County courtroom on Thursday, defense attorneys argued that the information of the confidential informant(s) name and address would be needed, should that informant have information about the deal that could be useful for Brown's defense. They were granted these pieces in information; however, they initially asked for much more, including interviews with the confidential informant, deals, notes, "uncharged misconduct", and criminal records.

    Brown is next scheduled to appear at a status conference on October 4, with trial due to begin October 16.

    Brown was indicted in August 2021 and charged with capital murder in the December 2019 death of Huntsville STAC agent Billy Clardy III during the undercover operation at a home on Lavert Street. Investigators say Clardy died from a gunshot wound to the heart, just beyond the protection of the bulletproof vest he was wearing.

    STAC is a task force combining the efforts of Huntsville, Madison, and Decatur city police departments, the Madison County Sheriff's Office, and the Madison and Morgan County district attorneys.

    Clardy was a 14-year veteran of HPD whose father was also killed while serving HPD in 1978. The younger Clardy had an extensive list of awards and commendations earned during his career.
