    A 14-year-old Georgia girl was kept in a dog crate, beaten, bound with zip ties, and starved before she died and was buried in the family’s back yard, an investigator testified Tuesday.

    The abuse was allegedly inflicted by Mary Crocker’s own family, including her father, who once worked as a Walmart santa. Elwyn Crocker Sr., 50, is facing charges of felony murder in Mary’s death, along with four other relatives who are also accused of abusing the girl and her brother, Elwyn “JR” Crocker Jr., according to The Atlanta Journal-Constitution.

    The bodies of both siblings were found buried behind the family’s double-wide trailer on December 20.

    Investigator Abby Brown testified Tuesday about the horrific abuse the teen allegedly endured before her death, as part of a bond hearing for Crocker Sr. and Mark Anthony Wright, the brother of the girl’s step-mother, WSAV reports.

    According to Brown, Crocker Sr. admitted to keeping the 14-year-old naked in a dog crate kept in the family’s kitchen. They would bind her with zip ties to prevent her from escaping. When she needed a bath, someone would haul the crate into the bathroom and spray her with water. She was kept in the crate so often that her joints became stiff and swollen, and the family decided to try to straighten out her posture by duct taping her to a ladder.

    One photo, stored on Crocker Sr.’s phone, allegedly showed the teen standing naked and emaciated next to the dog crate shortly before her death on October 28, 2018. The teen’s body wouldn’t be discovered for several months, buried alongside her older brother who was believed to be killed two years earlier.

    The family is also accused of starving Mary as a form of punishment. When they did feed her, they would often put rice vinegar and other substances in the food “in the hopes that she would not eat,” or serve her special food just for her that was described as grey, Brown said.

    Mary’s one surviving brother, James, 11, told investigators that he required special lactose-free food because of his cerebral palsy, but said on one occasion he was instructed by his step-grandmother to hit his sister after she took his food.

    “He hit her with a frying pan,” Brown said, according to the local paper.

    Crocker Sr. and Wright were both denied bail and the cases were bound over for a grand jury. The children’s stepmother Candice Crocker, 33, her mother, Kim Wright, 50, and Kim Wright’s boyfriend, Roy Anthony Prater, 55, are also facing charges stemming from the alleged abuse.

    State to seek death penalty in Effingham child killings

    They are accused in the deaths of children whose remains were found buried behind their home

    Prosecutors have filed notice that they intend to seek the death penalty for four of five defendants accused in the deaths of young two South Georgia teens found buried behind their home, the state capitol defender’s office confirmed Thursday.

    The bodies of Mary Crocker and her brother, Elwyn “JR” Crocker Jr., were found in December 2018 in shallow graves near a dog pen in Effingham County, some 30 miles from Savannah. Authorities have said they believe the siblings were both 14 when they went missing two years apart, JR in 2016, Mary in 2018. Authorities have said the siblings were beaten, starved and forced to live in a cage.

    News of the potential death sentences is the latest development in a case that has drawn national attention and led to sharp criticism of the state Division of Family and Children Services. The Atlanta Journal-Constitution reported in January 2019 that DFCS declined in 2017 to investigate an allegation of abuse at the home because the complaint was a year old. At the time of the complaint, JR was apparently already buried in the back yard, while Mary was still alive. Child welfare experts said it was a mistake to not investigate the report, and DFCS vowed a policy change.

    The defendants facing murder charges and death are the children’s father, Elwyn Crocker Sr., his wife, Candice Crocker, Candice Crocker’s mother, Kim Wright, and Candice Crocker’s brother, Tony Wright. Kim Wright’s boyfriend, Roy Prater, also has been charged with murder, but prosecutors haven’t filed a notice to seek the death penalty in that case.

    Previously, investigators said all five defendants participated in abusing the siblings.

    All five pleaded not guilty last year. The four who now face death sentences are set to appear for an arraignment hearing on an updated indictment Feb. 19.

    EFFINGHAM CO., Ga. (WTOC) - Four people facing the death penalty in the deaths of two teens in Effingham County pleaded not guilty in court Wednesday.

    The decision to seek the death penalty means they had to come back to do their pleas again.

    Elwyn Crocker, Candice Crocker, and Kim Wright face 13 counts each. The state charged them with two counts of malice murder and two counts of felony murder for the deaths of Elwyn Crocker, Jr. and Mary Crocker. They also face an additional count of sexual battery, four counts of cruelty to children, two counts of false imprisonment, and two counts of concealing a death.

    Elwyn Crocker Senior sat silently, showing no emotion, as prosecutors read off the 13 charges against him. They say he starved his children and put them in animal crates. Investigators say he and the others also sexually assaulted Mary. He’s accused of burying both behind their home on Rose Bud Place.

    He only said “yes sir” when the judge asked if his lawyers were accessible and helping out.

    His wife, Candice Crocker, also listened to the state outline the charges she faces, followed by Kim Wright, the step-grandmother. All three of them face the same charges related to the deaths of Mary and EJ Crocker.

    Candice Crocker’s lawyers fought to have our camera kicked out of the courtroom. They say the camera makes it hard to focus and makes her anxious. She only said “yes sir” when answering the same question as her husband.

    Kim Wright’s lawyers told her not to answer the judge’s questions. She also did not show much emotion but walked slowly in and out of the courtroom.

    Mark Anthony Wright, the son of Kim Wright, faces eight counts, including malice murder and felony murder in Mary’s death, one count of sexual battery, two counts of cruelty to children, two counts of concealing a death, and one count of false imprisonment.

    Wright is charged with only Mary Crocker’s death. He is only charged with concealing Elwyn Crocker’s death, who investigators believe died in October or November of 2016.

    They believe Mary Crocker died in 2018, by October at the latest. Investigators found both bodies in December of 2018.

    Elwyn Crocker is the children’s father and Candice is the step-mother. Kim Wright is the step grandmother.

    The defendants re-entered their pleas Tuesday because the state decided to pursue the death penalty against these four defendants.

    With this being a death penalty case, there will be a lot of hearings before any trials. The state plans to try Elwyn Crocker first.

    The next hearing is set for April 8th.

    Roy Prater is the fifth person charged. He’s Kim Wright’s boyfriend. Prosecutors have not said why they’re not seeking the death penalty on him.

    Hearing set for Friday in buried children case

    After months of no action because of the coronavirus pandemic, a status hearing is set for 9 a.m. Friday in Effingham County Superior Court in the case of 2 teenagers found buried in their back yard in the Guyton area in December 2018.

    4 out of 5 defendants are facing the death penalty in the deaths of siblings Mary Frances and Elwyn John Crocker Jr.

    Pleading not guilty in February and facing the death penalty are: Elwyn John Crocker, the biological father of the teenagers; Candice Heather Crocker, the stepmother; Kimberly Renee Wright, the step grandmother; and Mark Anthony Wright, Candice Crocker’s brother.

    A fifth defendant in the case, Roy Anthony Prater, the step grandmother’s boyfriend, is not facing the death penalty.

    Charges against the defendants include malice murder, felony murder, aggravated sexual battery, cruelty to children, concealing the death of another and false imprisonment.

    The bodies of the siblings were found buried behind the family’s mobile home. Both siblings were 14 years old when they died.

    The defendants are accused of starving and beating the siblings, with an investigator testifying in court that the teenagers were confined in a dog crate, starved and tortured.

    The murders were “outrageously or wantonly vile, horrible, or inhuman in that it involved torture or depravity of the mind,” the state said in the death penalty notices.

    The state said in indictments that the 4 defendants sodomized Mary Frances Crocker with a foreign object.

    It was unclear whether any of the defendants would be tried together. One of the defense attorneys mentioned in court in February that Elwyn John Crocker would be tried first.

    Judge F. Gates Peed has issued gag orders against the defendants, witnesses, law enforcement officers and lawyers.

    2 plead guilty in Georgia case of 2 buried children

    SPRINGFIELD, Ga. — Two people have pleaded guilty to murder charges in the deaths of two teenage siblings found buried outside their Georgia home and will testify against the siblings’ father and others facing the death penalty in the case, prosecutors said Friday.

    During a court hearing in Effingham County, Assistant District Attorney Brian Deal said the stepmother of victims Mary Frances Crocker and Elwyn John Crocker Jr. had agreed to a plea deal that includes a sentence of life without parole. Candice Crocker had faced a possible death sentence if convicted in the slayings of her stepchildren.

    Roy Prater, the boyfriend of Candice Crocker’s mother, also pleaded guilty to murder and other counts, Deal said. He has not been sentenced, the Savannah Morning News reported.

    Sheriff’s investigators say Mary Frances Crocker, 14, had been dead for roughly two months when a tip brought them in December 2018 to her father’s mobile home. They also unearthed the remains of Mary’s older brother, Elwyn Crocker Jr., who also had been 14 when last seen about two years earlier. Both children had been home-schooled and were never reported missing.

    A Georgia judge said he hopes to schedule a trial early next year for three family members charged in the deaths of 2 teenage siblings found buried outside their home.

    Effingham County sheriff’s deputies found the children’s bodies in December 2018 after a tip brought authorities to their father’s mobile home. Investigators said Mary Frances Crocker, 14, had been dead for roughly two months. Her older brother, Elwyn Crocker Jr., had also been 14 when last seen about two years earlier. Both children were home-schooled and no one reported them missing.

    Their father, Elwyn Crocker Sr., and two extended family members still await trial on murder charges and other criminal counts. Prosecutors are seeking the death penalty against all three, and the coronavirus pandemic delayed the case for roughly a year.

    Crocker Sr. appeared in court for a status hearing Thursday along with the other defendants — his mother-in-law, Kimberly Renee Wright, and her son, Mark Anthony Wright.

    More than 200 pretrial motions have been filed by attorneys, WTOC-TV reported. Superior Court Judge F. Gates Peed said Thursday he plans hearings to resolve them beginning in August and hopes for a trial by next spring.

    “I would like to be in a position to have a jury in place in the first quarter of 2022,” Peed said. “That might be overly optimistic, or it might not be.”

    A sheriff’s investigator testified that Mary Crocker was starved, beaten and kept bound and naked in a dog crate as punishment by her father and stepfamily before she died. Later indictments said Elwyn Crocker Jr. suffered similar treatment.

    Two other family members — the children’s stepmother, Candice Crocker, and Roy Prater, the boyfriend of Candice Crocker’s mother — pleaded guilty to murder last year and agreed to testify against the others.

    EFFINGHAM COUNTY, Ga. (WSAV) — It’s a case that happened two years ago but one that still horrifies many, the death of the two Crocker children in Effingham County. A brother and sister were found buried in their backyard.

    Friday, their father Elwyn Crocker Sr. was back in court. If convicted, Crocker could face the death penalty and dozens of motions have been filed by the defense.

    Fifteen motions from the defense were discussed today including a request that the judge not allow the death penalty to be considered.

    “While the state has solid grounds to say the death penalty has been ruled consitutional in Georgia, I’m not saying it hasn’t already been decided, but the turth of the matter is that just a couple of years ago this was found unconstitutional on some of the similar and exact same grounds in the state of Washington,” says Crocker’s attorney, Jerilyn Bell.

    While it seems doubtful the motion would be granted, an official ruling will be made next month. Crocker’s trial isn’t likely to start until mid-2022.

    Father of Crocker children back in court for first time in months

    EFFINGHAM COUNTY, Ga. (WTOC) - One of the people charged in the deaths of a teenage brother and sister buried in their Effingham County backyard was back in court Friday.

    This December will mark four years since the bodies of Mary Crocker and her brother Elwyn Crocker Jr. were found in the backyard of their family home.

    Five people are charged in this case - all with a family connection to the children.

    Elwyn Crocker Sr., Kim Wright, and Mark Wright all face murder charges in their deaths. All three also face the potential of the death penalty when this case goes to trial.

    Roy Prater and Candice Crocker have both entered guilty pleas. Both have also agreed to testify when this case goes to trial.

    State-appointed attorneys for Elwyn Crocker, Sr. filed a new batch of pre-trial motions Friday in Effingham County Superior Court.

    The presiding judge, Chief Judge F. Gates Peed, acknowledged this is the first time back in the courtroom addressing pre-trial motions since last fall. The capital murder case has been stalled by the pandemic, as well as a motion to recuse Judge Peed that was ultimately denied.

    Capital defenders for Elwyn Crocker, Sr. have entered 30 pre-trial motions as of Friday, addressing issues ranging from how discovery and evidence will be shared by the state, to whether or not the death penalty should even be considered as punishment in this case.

    As of right now, there will be 40 pre-trial motions considered by the judge on behalf of Elwyn Crocker, Sr., though the clerk of superior court says that number could change.

    The judge will make rulings on all the pre-trial motions heard Friday at a later date.

    As for the other two defendants, Kim Wright and Mark Wright, no dates have been set yet for their next appearance in court.

    Possible death penalty debated during pre-trial motion hearing for Crocker Sr.

    EFFINGHAM COUNTY, Ga. (WTOC) - Almost four years ago, Mary and Elwyn Crocker Jr. were found dead in their backyard in Effingham County.

    Their father, a defendant in the case, was in court Friday as a judge heard pre-trial motions. The court addressed more than a dozen pre-trial motions by the defense in the case against Elwyn Crocker Sr.

    During the pre-trial hearing, Elwyn Crocker senior’s defense attorneys said their were 16 search warrants filed in this investigation.

    We’re also learning there were about seven or eight devices, like phones and tablets, taken from the home the siblings lived at with their family.

    One of Crocker’s defense attorneys Samuel Wood argued that some evidence presented in pre-trial hearings should be closed to the public. He says because if potential jurors see content like what’s on those devices mentioned or disturbing photographs before jury selections for trial begin, their opinion could be swayed.

    “There are going to be photographs of the body of the victims in this case. These particular victims are children and that tends, when it is published, when it is disseminated to the public, to be sensationalized because they are children.”

    Lead prosecutor Matt Breedon denied the motion.

    “Those photographs will be displayed to this court in a manner to where they will not be able to be video recorded by the crews in the court room, either they will be handed to the court or they will be displayed on a screen that will angled towards the court.”

    As Crocker Sr.’s attorneys defended several motions, one topic kept coming up...the state’s wish to pursue the death penalty.

    The defense claims studies show jurors in death penalty cases are often tainted by the severe punishment being on the table.

    Crocker’s defense attorney Jerilyn Bell motioned to have a pre-trial hearing with an expert witness to support these studies.

    “One of the highest factors for a case that would result in a likely death sentence is one that involves children by almost 40 percent higher and the impact of potential constitutional errors could not be greater than a case that involves children,” Bell said.

    State prosecution attorney Matt Breedon also denied that motion.

    “I don’t think this is a hearing that is necessary in this case especially not at this point. What the defense has done is cited various studies that may be testified to by an individual that did not conduct those studies which would be an issue for the state,” Breedon said.

    The motions discussed at this pre-trial hearing have not been ruled on by Chief Judge F. Gate Peed yet. He has until trial begins to make a decision.

    As for what’s next, Judge Peed says Elwyn Crocker Senior, Kim Wright and Mark Wright will be in pre-trial hearings together at the end of October.

    When trials begin, the three defendants will be tried separately. Judge Peed says the first person in trial will be Elwyn Crocker Senior.

    Pre-trial motions presented at hearing before Crocker case goes to trial

    EFFINGHAM COUNTY, Ga. (WTOC) - Will Elwyn Crocker face the death penalty in the case of two children who died in Effingham County? That’s the question his lawyers are asking.

    During the hearing, Elwyn Crocker’s attorney said once this case goes to trial, it could last up to 5 weeks. Several pre-trial motions she discussed in this hearing revolved around the death penalty Crocker could face as he’s accused of killing his children Mary and Elwyn Crocker Jr.

    One of the nearly two dozen motions was a request to dismiss the death penalty.

    Crocker’s Attorney Jerilyn Bell asked that during jury selection for the upcoming trial, they don’t use quote “death qualification” on potential jurors. Meaning neither the defense nor prosecution can ask the jury pool if they could consider a sentence of death.

    And once the jury is selected, Bell is asking that info in the indictment from 2019 be kept from the jury, saying it won’t make for a fair trial.

    “It carries a certain gravity that this determination has already been made and that is not something they should be considering. At most, what a trial jury should be considering is that a grand jury has determined that there are sufficient charges to go forward,” said Jerilyn Bell, Crocker’s attorney.

    The grand jury indicted Crocker with two counts of felony murder, two counts of cruelty to children in the first degree, and two counts of concealing the death of another.

    Prosecuting Attorney Matt Breedon called the motion absurd.

    “If this court doesn’t read the indictment to the jurors, how do they know what the charges are? If we don’t send them an indictment back to the jury room, how do they know which victim is in which count. How do they know what the element of the offenses are?”

    Bell also asked the Judge to make the state tell the defense all their subpoenaed witnesses for trial. She said the last list they received of possible witnesses from the prosecution was from early 2020 and 73 people on it.

    No decisions on motions were made. They are expected back in court on Friday.
