Juan Carlos Alvarez - Texas Death Row

    Facts of the Crime:

In June 1998, in Houston, Alvarez and three co-defendants participated in two drive-by shootings.

On June 6, 1998, Alvarez fired an SKS assault rifle at a group of people at an apartment complex. Alvarez suspected that some of the group were members of a rival gang. Two of the co-defendants fired handguns. Although ballistics test determined that Alvarez did not fire the fatal bullets, testimony revealed he helped plan the drive-by shooting and supplied one of the cars used. Two people (who were brothers) were killed and six were injured by gunfire.

On June 17, 1998, Alvarez shot and killed two young men with shotguns in an apartment complex in Southwest Houston. The victims were shot at close range in the back and face. In this shooting, Alvarez supplied the shotgun and the same SKS assault rifle. Alvarez was identified at trial as the shooter.

Officers found the shotgun and the SKS assault rifle in his closet. Testimony showed that none of the four victims in these incidents were members of the rival gang.

Evidence presented at the punishment phase of the trial showed that Alvarez shot and killed a man in an apparent random attack on May 30, 1998, as the victim was driving home.

Alvarez was sentenced to death in Harris County in November 1999.

"Appellant’s appeal is not permitted. Appellant does not cite, nor have we found, any constitutional or statutory provision or any rule that would authorize this appeal from the trial court’s order. See Staley v. State, 233 S.W.3d 337, 338 (Tex. Crim. App. 2007). Appellant’s appeal is dismissed."

If an execution date gets set, thereŽll be a lot of media attention - heŽs a Mexican citizen.
No murder can be so cruel that there are not still useful imbeciles who do gloss over the murderer and apologize.

Mexican national on Texas death row loses appeal in Harris County

The state's top criminal appeals court has refused an appeal from a Mexican national on Texas death row for his participation in street gang shootings in Houston that left four dead.

Lawyers for Juan Carlos Alvarez argued to the Texas Court of Criminal Appeals that his initial appeals attorney was incompetent because of an illness that prompted that lawyer to withdraw from the case. Alvarez also had wanted money approved for investigators and experts.

The Harris County trial court refused and Wednesday's ruling from the appeals court upholds that decision, saying the appeal isn't authorized.

The 37-year-old Alvarez is condemned for two drive-by shootings with an assault rifle in June 1998. Four people were killed. Evidence also tied him to another fatal shooting days earlier on a Houston freeway.
