Death Penalty Trial Set for Chad Guy Daybell in 2019 ID Murders of Tylee Ryan, JJ Vallow and Tammy Daybell

Mother Is Charged in Missing Idaho Children Case Complicated by Multiple Deaths

Tylee Ryan and Joshua Vallow have been missing for months. Their mother, Lori Vallow, was arrested in Hawaii and now faces felony charges in Idaho.

    By Jacey Fortin
    The New York Times

Two children who lived in Idaho — Tylee Ryan, 17, and Joshua Vallow, 7 — have been missing for months.

The story of their disappearance is part of a larger tale that has drawn national and international headlines and involves at least three people dead, the two missing children and open police investigations in multiple states.

At the center of it all are the children’s mother, Lori Vallow, 46, and her new husband, Chad Daybell, 51 — a couple whose religious doomsday beliefs have isolated them from their families, their relatives say.

Ms. Vallow was arrested in Hawaii on Thursday, the police on Kauai said, on a warrant issued by the authorities in Idaho. She faces charges that include two felony counts of desertion and nonsupport of dependent children, resisting or obstructing officers, contempt of court and criminal solicitation to commit a crime.

Ms. Vallow and Mr. Daybell married shortly after both of their former spouses died: Ms. Vallow’s husband was shot, and Mr. Daybell’s wife’s cause of death remains unknown. The authorities have said that Ms. Vallow did not cooperate to help find the missing children.

The newlyweds were then found together — without the children — in Hawaii.

What happened in Arizona, Idaho and Hawaii?

Last year, multiple people who were related or married to Ms. Vallow or Mr. Daybell were either killed or found dead.

In July, Ms. Vallow’s brother, Alexander Cox, called 911 to say that he had shot Charles Vallow, Ms. Vallow’s estranged husband, at her home in Chandler, Ariz.

According to body camera footage from the police officers who responded to his call, Mr. Cox said that he had been visiting his sister when Mr. Vallow, who had been living in Texas, came to see the children.

Mr. Cox said that he had witnessed an altercation between his sister and Mr. Vallow and that she had left the home. Then, Mr. Cox said, he got into an argument with Mr. Vallow, who hit him on the head with a baseball bat.

Mr. Cox said that he retrieved his handgun from his room and shot Mr. Vallow in self-defense. Mr. Vallow died. No arrests were made, but the case remains under investigation, the police in Chandler said.

On Oct. 19, Mr. Daybell’s wife, Tammy Daybell, 49, was found dead in her home in Salem, Idaho. The authorities said that she appeared to have died of natural causes, and she was buried in Springville, Utah, where she once lived.

Mr. Daybell married Ms. Vallow the next month; she moved to Idaho.

But Tammy Daybell’s body was exhumed on Dec. 11 after the authorities in Idaho began to question the circumstances of her death and whether it might have been connected to the disappearances of Tylee and Joshua.

The Fremont County Sheriff’s Office in Idaho, which is investigating Ms. Daybell’s death, is waiting for autopsy results.

On Dec. 12, Mr. Cox, Ms. Vallow’s brother, was found dead in his home in Gilbert, Ariz., according to the police there. It remains unclear how he died.

“We are currently awaiting for the autopsy results to come back,” a department spokeswoman said in a statement. “We anticipate it’ll be another two months or so for us to receive those results.”

Ms. Vallow and Mr. Daybell eventually turned up in Hawaii but without the children, and in late January, the Kauai Police Department said it had served her with a court order to take her children to the Idaho Department of Health and Welfare.

The deadline came and went, but neither Ms. Vallow nor her children appeared.

On Thursday, the Kauai police said that they had arrested Ms. Vallow in Princeville, and that she would attend a hearing on the island “where she will have an opportunity to waive or fight her extradition to Idaho.” Mr. Daybell was not arrested.

In court on Friday, a judge set bail for Ms. Vallow at $5 million and scheduled another hearing on her extradition on March 2.

Idaho court documents supporting the charges against Ms. Vallow said that when the police searched her and her rented Ford Explorer in Kauai, they found Tylee’s bank card, which was still active and had been used since Tylee went missing months ago.

The Rexburg police also discovered that Ms. Vallow sent an email in July asking the facility in Arizona that had trained her son’s service dog to find another family for the dog “due to a change in life circumstances,” the court documents said. The training facility picked up the dog on Aug. 30.

Mr. Daybell’s parents also told the police that Mr. Daybell and Ms. Vallow had told them that Ms. Vallow was “an empty nester,” according to the documents.

    Was a religious organization involved?

Relatives of Ms. Vallow and Mr. Daybell have suggested that the couple’s religious beliefs isolated them from their family members.

Mr. Daybell is the author of several books with religious themes, and both he and Ms. Vallow have been linked to an entity called Preparing a People.

A multimedia company, Color My Media, said in a statement that “Preparing a People” was essentially a lecture series. “It is not a ‘group’ and is not a ‘cult’ or something people join,” it said.

The website said it aims to help prepare people for the Second Coming of Jesus Christ, and the statement made reference to the Church of Jesus Christ of Latter-day Saints. It added that Mr. Daybell and Ms. Vallow had both appeared on podcasts associated with the organization but were not considered leaders.

Ms. Vallow’s religious beliefs were also mentioned in court documents when Mr. Vallow filed for a divorce from her about five months before he died.

The filings were obtained by Fox 10, a news outlet in Phoenix, which reported that the documents showed that Mr. Vallow claimed that Ms. Vallow believed she was “receiving spiritual revelations and visions to help her gather and prepare those chosen to live in the New Jerusalem after the Great War as prophesied in the Book of Revelations.”

Steve Ellsworth, a lawyer who represented Mr. Vallow when he filed for divorce, confirmed the accuracy of the Fox 10 report. (The divorce was never finalized.)

    Where are the children?

It remains unclear where Tylee and Joshua are, and whether they are alive.

The Rexburg police conducted a wellness check on Joshua on Nov. 26. They did not find him. They returned with a search warrant the next day and found that Ms. Vallow and Mr. Daybell had left Rexburg.

“We have taken every step available to us, including executing multiple search warrants, interviewing multiple sources and running down every lead we have found,” the Rexburg police said in a statement on Dec. 30. “We strongly believe that Joshua and Tylee’s lives are in danger.”

“We want them back,” Larry Woodcock, a grandparent of Joshua, said at a news conference last month. He added that Ms. Vallow was a good mother to the children when they were younger.

“If somebody two years ago would have said this is what’s going to happen with Lori, I would never have believed it,” he said.

The authorities have said that Joshua’s relatives have not heard from him since September, that Mr. Daybell once falsely claimed that Tylee had died more than a year ago, and that Ms. Vallow once falsely claimed that Joshua was staying with a family friend in Arizona.

“We know that the children are not with Lori and Chad Daybell and we also have information indicating that Lori knows either the location of the children or what has happened to them,” the police statement said.

In early February, The East Idaho News reported that Ms. Vallow abandoned a storage unit she had rented on Oct. 1 at Self Storage Plus in Rexburg.

The news outlet shared security footage from the storage company, which appeared to show Ms. Vallow and two men — possibly Mr. Cox and Mr. Daybell — visiting the unit multiple times in October and November to bring or remove items.

Self Storage Plus confirmed in a statement that it had rented a storage unit to Ms. Vallow. An owner of the business confirmed that the authorities had searched the unit on Nov. 27, and that it contained children’s items including photographs, bicycles and clothing.

Sean Bartholick, a lawyer for Ms. Vallow — who may have changed her last name to Daybell — and Mr. Daybell, declined to comment on the case in early February, but issued a statement on their behalf to The East Idaho News in December.

“Chad Daybell was a loving husband and has the support of his children in this matter,” it said. “Lori Daybell is a devoted mother and resents assertions to the contrary. We look forward to addressing the allegations once they have moved beyond speculation and rumor.”

Colby Ryan, Ms. Vallow’s older son from a previous marriage, expressed his frustration with the murky situation and urged his mother to “do the right thing” in a video posted in late January.

Mr. Ryan said he loved his siblings and wanted to see them.

“I just hope everything can work out really soon,” Mr. Ryan said. “I hope everything can turn back around and we can be together again. I want that. I miss our family.”

Chad and Lori Daybell indicted for murders of JJ Vallow, Tylee Ryan and Tammy Daybell

By Nate Eaton and Robert Patten
    East Idaho News

ST. ANTHONY — Chad and Lori Vallow Daybell have been indicted on first-degree murder charges for the deaths of Tammy Daybell, Tylee Ryan and Joshua “JJ” Vallow.

Madison County Prosecuting Attorney Rob Wood made the announcement during a news conference Tuesday, which happened to be the day JJ would have turned 9 years old. Wood, a special prosecutor in the case, was joined by local, state, federal law enforcement and other officials.

The news comes after a grand jury convened over the past week in Fremont County.

The following are charges Chad and Lori are facing, according to a news release sent after Wood and Fremont County Prosecutor Lindsey Blake met with the media Tuesday afternoon:

    1. Lori and Chad Daybell were indicted on the charge of conspiracy to commit first-degree murder and grand theft by deception for the death of Tylee Ryan.
    2. Lori and Chad Daybell were indicted on the charge of first-degree murder for the death of Tylee Ryan.
    3. Lori and Chad Daybell were indicted on the charge of conspiracy to commit first-degree murder and grand theft by deception for the death of JJ Vallow.
    4. Lori and Chad Daybell were indicted on the charge of first-degree murder for the death of JJ Vallow.
    5. Lori and Chad Daybell were indicted on the charge of conspiracy to commit first-degree murder in the death of Tammy Daybell.
    6. Chad Daybell was indicted on the charge of first-degree murder in the death of his wife Tammy Daybell.
    7. Lori Daybell was indicted on the charge of grand theft related to Social Security Survivor benefits over $1,000 allocated for the care of minors Tylee Ryan and JJ Vallow that were appropriated after the children were missing and ultimately found deceased.
    8. Chad Daybell was indicted on the charge of insurance fraud related to a life insurance policy he had on Tammy Daybell for which he was the beneficiary and received funds after her death.
    9. Chad Daybell was indicted on the charge of insurance fraud related to another life insurance policy he had on Tammy Daybell for which he was the beneficiary and received funds after her death.

The penalty for the murder charges range from life in prison without the possibility of parole to the death penalty, Blake said. Prosecutors were not disclosing what penalty they will pursue, but if they decide on the death penalty, legally they have to notify Lori and Chad within 60 days of their plea.

Grand jury proceedings are held in strict confidence and are sealed from the public, so it’s unknown what evidence and information-led the jury to indict.

Wood and Blake released few details about the indictments but expressed thanks to the public for being patient over the past year.

The indictments come nearly one year after the bodies of 16-year-old Tylee Ryan and 7-year-old Joshua “JJ” Vallow, were found buried on Chad’s Fremont County property. He was arrested June 9 on two felony counts of conspiracy to commit destruction, alteration or concealment of evidence, and two felony counts of destruction, alteration or concealment of evidence.

Tylee’s body was dismembered and burned, according to court documents. JJ’s body was wrapped in tight black plastic and secured with gray duct tape.

Chad pleaded not guilty to the charges and has been in the Fremont County Jail on a $1 million bail.

Lori was arrested on Feb. 20, 2020, in Kauai, Hawaii, and extradited to Rexburg. She was charged with two felony charges of conspiracy to commit destruction, alteration or concealment of evidence and has been in the Madison County Jail on a $1 million bail. Lori pleaded not guilty to the charges.

Chad and Lori married weeks after Chad’s first wife, Tammy Daybell, suddenly died on Oct. 19, 2019. The couple fled to Hawaii as police began investigating the disappearance of JJ and Tylee. Tammy’s death has been under investigation for over a year and an autopsy was complete in February, but results and her cause of death have not been released to the public.

Lori’s former husband, Charles Vallow, was shot and killed by Lori’s brother, Alex Cox, in July 2019. Cox said the shooting was in self-defense, but the investigation is still open. Cox died of natural causes in December 2019, according to the Maricopa County, Arizona, medical examiner.

EastIdahoNews.com confronted Chad and Lori in Hawaii in January 2020, and they refused to say where the children were. The case was thrust into the national spotlight, but the COVID-19 pandemic slowed progress down as grand juries were unable to meet.

However, Wood said authorities have spent “thousands of hours … seeking the truth for these innocent victims,” and Blake said the case has been moving forward behind the scenes.

“I want to assure everyone that despite the delays, we have been working diligently to pursue justice for the victims in this case, to ensure we have the evidence required to prove the facts beyond a reasonable doubt in a court of law,” she said.

Chad will have his initial court appearance on the new charges Wednesday at 11 a.m. Lori will appear at 11:30. The hearings will be held via Zoom, and we will carry the hearings live.

November Trial Date Set For Chad Daybell

REXBURG, Idaho – An Idaho judge set Chad Daybell’s murder trial to begin on November 8.

Police arrested Daybell on first-degree murder charges related to the deaths of JJ Vallow, Tylee Ryan & Tammy Daybell, Chad’s first wife.

He pleaded not guilty to the charges on June 9. It was exactly one year after police found the remains of the two children on his property.

Prosecutors told the judge during a court hearing Wednesday that they expected the trial to take five weeks.

A grand jury indicted Daybell and his wife Lori on eight federal charges including first-degree murder and conspiracy to commit first-degree murder in connection to the deaths of Tammy Daybell, and Lori’s two children, Tylee Ryan and JJ Vallow.

The murder charges carry a penalty of death or life in prison but prosecutors have not decided whether to pursue the death penalty.

A judge paused Vallow’s case after she was declared incompetent to stand trial. As a result, the court ordered treatment to restore her mental competency.

'Doomsday' cult mom Lori Vallow Daybell indicted in ex-husband's shooting death

Charles Vallow was shot and killed by Daybell’s brother, Alex Cox, in July 2019

    By Michael Ruiz
    Fox News

"Doomsday cult mom" Lori Vallow Daybell, who in May was deemed mentally unfit for trial in the deaths of her two children and her new husband’s ex-wife, has been indicted on a new count of conspiracy to commit murder first-degree in the death of her ex-husband.

A Maricopa County grand jury indicted Daybell in connection with the 2019 death of Charles Vallow in suburban Phoenix.

The two-page indictment alleges that Daybell conspired with her brother, Alexander Cox, to kill Vallow.

The complex cases against Daybell and her current husband, Chad Daybell, has spanned almost four years and a handful of states, involving her two dead children and a pair of slain ex-spouses and a possible accomplice brother who died before the entire conspiracy came to light.

The complex cases against Daybell and her current husband, Chad Daybell, has spanned almost four years and a handful of states, involving her two dead children and a pair of slain ex-spouses and a possible accomplice brother who died before the entire conspiracy came to light.

In 2018, still married to their exes, the two began dating, and within months, the romance took a macabre twist.

Joshua "JJ" and Rylee Ryan Vallow, ages 7 and 17, were reported missing in January 2019.

Chad Daybell has also been charged with first-degree murder in the death of his ex-wife, Tammy Daybell, weeks before he married Lori Vallow.

The two have maintained their innocence.

The new charge is a Class 1 felony.

Concealment of evidence charges dropped against the Daybells

ST. ANTHONY, Idaho — Local prosecutors dropped the destruction, alteration or concealment of evidence charges against Chad Daybell and Lori Vallow Daybell Thursday.

Madison County Prosecutor Rob Wood, who is acting as special prosecutor in the Fremont County case, filed a motion to dismiss the evidence charges Wednesday. District Judge Steven Boyce approved the motion, officially dropping the charges Thursday.

The couple was indicted in May on various charges, including first-degree murder for the deaths of Chad Daybell's first wife, Tammy Daybell, 16-year-old Tylee Ryan and 7-year-old Joshua "JJ" Vallow — Lori Daybell's two children. The charges in that indictment are still being prosecuted and the dismissal of the other cases allows prosecutors to better focus on the newer charges with more serious penalties.

Chad Daybell has pleaded not guilty to all charges against him and prosecutors have until the beginning of August to file a notice of intent regarding if they will seek the death penalty.

Lori Daybell's case is on hold after Boyce put a stay or temporary pause on the case after a psychologist deemed her not competent for legal proceedings. She was committed to the Idaho Department of Health and Welfare for mental health treatment.

She is also facing a conspiracy to commit murder charge in Arizona in connection to the July 2019 shooting death of her fourth-husband Charles Vallow. Investigators recently released hundreds of emails and documents tied to that investigation.

Prosecutors will seek the death penalty for Chad Daybell

ST. ANTHONY — Prosecutors will seek the death penalty for Chad Daybell, the man accused of killing his former wife, and two step-children from his current marriage.

Daybell and his wife Lori Vallow Daybell are accused of various crimes, including first-degree murder for the deaths of Chad’s first wife, Tammy Daybell, 16-year-old Tylee Ryan and 7-year-old Joshua “JJ” Vallow — Lori’s two children. The couple was indicted in May by a Fremont County grand jury.

Chad has pleaded not guilty to all charges against him.

In court documents filed Friday, Special Prosecutor Rob Wood and Fremont County Prosecutor Lindsey Blake say the death penalty can be used in any or all three first-degree murder charges filed against Daybell. Additionally, it can be used for any of the conspiracy to commit first-degree murder charges.

The prosecutors cited several reasons why this case is eligible for the death penalty:

    • The alleged murders were “committed for remuneration” (financial gain).
    • The alleged murders were “especially heinous, atrocious, cruel, or manifesting exceptional depravity.”
    • The defendant exhibited “an utter disregard for human life.”
    • The defendant has exhibited “a propensity to commit murder and will probably constitute a continuing threat to society.”
    • The prosecutors issued the following statement about their decision to seek the death penalty.

“Today we filed our Notice of Intention to seek the death penalty against Chad Daybell. Our process in making this determination was lengthy and comprehensive. We conferred with those immediate family members of JJ Vallow, Tylee Ryan and Tammy Daybell, who have indicated a willingness to speak with us and allowed them an opportunity to provide their input if they wished to do so. The ultimate decision to seek capital punishment rests with the State, and after completing the entire process, we determined that the nature and magnitude of these crimes warrant the possibility of the highest possible punishment.
This determination applies only to Chad Daybell.”

While Chad’s case progresses through the court system, Lori’s case remains paused after a mental health expert deemed her not competent to assist in her defense. On June 8, District Judge Steven Boyce committed Lori to the Idaho Department of Health and Welfare to undergo mental health treatment.

Chad is next scheduled for a pre-trial conference on Sept. 31 ahead of the now scheduled November jury trial.

Daybell trial date set for early 2023 in Ada County

    KTVB

Chad Daybell, the East Idaho man accused of killing his wife and his new lover's two children, was given a trial date during a Thursday court hearing.

Daybell's jury trial will begin Jan. 9, 2023, in Ada County.

Daybell was indicted in May on charges of first-degree murder, conspiracy to commit first-degree murder, grand theft by deception, grand theft, and insurance fraud. Investigators say he murdered his late wife Tammy Daybell — who was found dead in the couple's home just weeks before he married Lori Vallow in Hawaii — as well as Vallow's children, 7-year-old JJ Vallow and 16-year-old Tylee Ryan.

The children's remains were found buried on Daybell's Fremont County property in June 2020.

Vallow, who is also facing murder charges in the deaths of JJ and Tylee, has been deemed mentally unfit to stand trial in the case.

Daybell's trial will be held in Ada County after his lawyers raised concerns that the high level of interest and media coverage in the case would make it difficult to seat an impartial jury in eastern Idaho.

Judge Steven Boyce on Thursday set the January 2023 trial date despite concerns from prosecutors about winter weather making travel between Fremont County and Boise hazardous at that time of year. Prosecutor Rob Wood asked the trial to be pushed back to late February 2023 or beyond instead.

But the judge declined to push the trial back further, noting that Daybell has been in jail for nearly a year and a half since his initial arrest.

The trial is expected to last 10 weeks, with two of those weeks set aside to select and seat a jury.

The prosecution will seek the death penalty if Daybell is convicted of the murders.

Idaho judge rules Daybell, Vallow-Daybell murder trials will be held together

Idaho District Judge Steven Boyce denied a motion Monday from Chad Daybell’s attorney, John Prior, to separate the murder trails between his client and Lori Vallow-Daybell.

East Idaho News reported Monday that Prior argued during a hearing on Friday that his client would not be given a fair and impartial trial, if his trail was not separated from Vallow-Daybell’s.

Daybell and Vallow-Daybell are charged with several counts of conspiracy to commit murder, and 1st-degree murder in connection to the deaths of 2 of Vallow-Daybell’s children – Joshua “JJ” Vallow, 7, and Tylee Ryan, 16. They are also facing charges in the connection to the death of Daybell’s 1st wife, Tammy Daybell.

Vallow-Daybell was found to be incompetent last June, and her case has been on hold ever since. During Friday’s hearing, Prior argued that the uncertainty of her status impacts his defense strategy.

In his ruling, however, Boyce says having the trials at the same time will be economic and efficient. Additionally, he says it will also help avoid the possibility of having inconsistent verdicts.

East Idaho News also reports that Prior has filed another motion. This one is to have the indictment and death penalty against Chad Daybell thrown out. A hearing on those issues is set for Wednesday.

Lori Vallow Daybell restored to competency, murder trial to proceed

    By Nate Eaton
    East Idaho News

ST. ANTHONY — Lori Vallow Daybell has been restored to competency and will face a jury trial on murder charges.

District Judge Steven Boyce issued a written order Monday morning saying Daybell is fit to proceed and ordered that she be released from a Department of Health and Welfare facility where she has been undergoing treatment in northern Idaho since last summer.

“The court orders that the defendant be brought before this court to be arraigned. Further, the order staying the case is hereby lifted. Defendant is to be transferred from the Idaho Department of Health and Welfare and remanded to the custody of the Fremont County Sheriff to be transported and brought before this court,” Boyce wrote.

Daybell and her husband Chad Daybell are charged with multiple counts of conspiracy to commit murder and first-degree murder in relation to the deaths of 7-year-old Joshua “JJ” Vallow, 16-year-old Tylee Ryan — two of Lori’s kids — and Chad’s first wife, Tammy Daybell. Lori Daybell’s case has been on hold since June, when she was declared incompetent for trial.

Chad and Lori Daybell’s cases are set to be tried together in Ada County in January 2023. A hearing is scheduled for Tuesday, April 19, where prosecutors are expected to argue that bringing jurors to Fremont County for the trial will be significantly cheaper than moving the entire trial to Ada County.

Lori Daybell is now scheduled to be arraigned on that same day at 1 p.m. EastIdahoNews.com has submitted a camera request to livestream the proceedings.

Prosecutors seek death penalty against Lori Vallow Daybell, ask judge to hold trials together

ST. ANTHONY — Prosecutors will pursue the death penalty against Lori Vallow Daybell and want her tried with her husband Chad Daybell in January.

In motions filed late Monday, Fremont County Prosecuting Attorney Lindsay Blake and Madison County Prosecuting Attorney Rob Wood say if Lori is convicted “for any of the counts of first degree murder and/or any of the counts of conspiracy to commit first degree murder,” they will seek the death penalty as a sentencing option.

Chad and Lori Daybell are charged with multiple counts of first-degree murder and conspiracy to commit murder for the deaths of 7-year-old Joshua “JJ” Vallow, 16-year-old Tylee Ryan — two of Lori’s kids — and Chad’s first wife, Tammy Daybell. Prosecutors are also pursuing the death penalty in Chad’s case.

The prosecutors cited the following reasons why Lori and Chad Daybell are eligible for the death penalty:

    • The alleged murders were “committed for remuneration” (financial gain).
    • The alleged murders were “especially heinous, atrocious, cruel, or manifesting exceptional depravity.”
    • The defendant exhibited “an utter disregard for human life.”
    • The defendant has exhibited “a propensity to commit murder and will probably constitute a continuing threat to society.”

In a separate motion, prosecutors are asking Judge Steven Boyce to move Lori’s trial from October to January to coincide with Chad’s trial. The cases are currently conjoined but Lori did not waive her right to a speedy trial last month and legally must be tried within six months of arraignment. Boyce scheduled her trial to begin three months before her husband’s.

Prosecutors argue that witnesses and evidence in both trials are the same and it will be more cost-effective to hold them together as proceedings are expected to last ten weeks.

Chad and Lori Daybell have pleaded not guilty to all charges.
