    I'm getting so sick of this court full of circus clowns delaying justice. Scotus better lift this stay

    Unfortunately I don’t think they can, because it’s a state court. I do agree that this and most of the stays granted by the TCCA are completely bogus.
    Violence and death seem to be the only answers that some people understand.

    Since the facts appear to be the same as McCoy, a stay is proper to allow if the law established in that case is applicable retroactively. If so, then a new trial must be held.

    According to Robert Dunham, Barbee’s stay last for 30 days. So he gets a new date after then?

    I saw the article you’re referring to and it’s just poor reporting. From post #20 in this thread.

    They have 30 days to file new briefs, it’s going to take a lot longer to decide if the stay should be lifted or the case should be reheard.

    Will he be stayed again after he’s given a date? The stay he got in 2019 was as time waisting as they come. Tarrant county is getting very unlucky when it comes to executing their DR population.

    I dont think he claimed ID, so i dont expect this to be stayed. He will go this year.
