    DALLAS — Naim Muhammad held his head low as police officers walked him inside the Dallas County jail on Monday evening and officially charged him with capital murder for the drowning deaths of his two young sons.

    Muhammad, wearing a white hooded jumpsuit, only responded to one question asked by News 8.

    MUHAMMAD: "Yeah, I got something to say. My kids."

    WFAA: "What about them?"

    MUHAMMAD: "I love 'em."

    But Dallas police say the 32-year-old father of three drowned two of his young sons after kidnapping them along with their mother as she walked them to the first day of school on Monday.

    Police found the lifeless bodies of Naim and Elijah Muhammad in a car.

    Court records reviewed by News 8 show Muhammad had a violent past after being arrested a half-dozen times in Dallas County.

    He faced his first felony in 2009 for aggravated assault with a deadly weapon.

    In that case, police said he hit one of his girlfriends in the head with a hammer after she confronted him about the way he was talking to her son.

    Muhammad got five years probation for that offense.

    But he violated that probation when police arrested him in February for family violence.

    According to the police report in this case, Muhammad said he wanted to take his son, Naim, to school, but the mother refused to let him.

    Detectives said Muhammad hit her in the face with his fist and, according to the report, told her "I am going to beat your ****ing *ss if you do not let me take my son."

    Muhammad briefly fled with the boy anyway before officers found him.

    Precisely who had custody remained uncertain, police said at the time.

    Regardless, on March 17, a judge issued an arrest warrant for Muhammad since he violated his probation.

    But it took Dallas County Sheriff's Department deputies six more weeks to go look for him, which raises the question whether the sheriff's office could have done more to get him off the streets.

    "That's always the question that's always asked, and of course we do the best we can, and we're out there actively serving these warrants," explained Detective Raul Reyna, a spokesman for the sheriff's office. "This one? We hoped we could have gotten to him sooner, but unfortunately we didn't."

    The sheriff's office has 65,000 felony warrants on average, Reyna added, and there are only 40 deputies to round up that many suspects.

    Last month News 8 learned that the Texas Attorney General sued Muhammad to try to establish him as the father of three boys (including the two who were killed Monday) so he might soon start paying child support.

    What role that suit played, if any, in Monday's deadly encounter is one police and prosecutors are trying to determine.

    Dallas constable couldn't chase alleged child murderer

    They may look like police and drive in marked cars, but Monday proved again the confusion Dallas County constables are having responding to chases.

    A Precinct 1 deputy constable chose not to chase suspected kidnapper Naim Muhammad, but If it happened in a different part of town, the decision would have changed.

    "In our office, we would have given the green light to pursue that vehicle," said Chief Mike Ramirez of Precinct 5.

    Ramirez said his constables are allowed to chase in Precinct 5 if they believe a suspect poses a threat of violence or is involved in a felony.

    But that won't be the case for long.

    On Monday four of the county's five constables submitted a new proposal to county commissioners — one in which all precincts would change to a "no-chase" policy beginning in 2012.

    One of the major reasons for the policy is their patrol cars.

    Dallas County has stripped down constable vehicles. They don't have overhead lights and some don't have sirens or computers, which are among the major safety measures you would want in a chase.

    That's the reason officials said the Precinct 1 deputy didn't pursue Naim Muhammad on Monday; her patrol car didn't have those features.

    It's a frustrating reality for some peace officers who say they simply want to do their job: Keeping people safe.

    "When a citizen is distressed they look for the nearest uniform, I don't think that person cares if they are police, constable or sheriff," Ramirez said. "They are looking for help; we should be allowed to help that citizen."

    Funeral set for two boys whose father confessed to drowning them

    Funeral arrangements have been set for the 3- and 5-year-old brothers whose father confessed to drowning them Monday in a remote Glenn Heights creek.

    Visitation for Naim, 5, and Elijah Muhammad, 3, will be from 1 to 9 p.m. Friday at the Evergreen Memorial Funeral Home, 6649 Houston School Road. Funeral services will be at 11 a.m. Saturday at Inspiring Body of Christ, 7701 S. Westmoreland Road.

    Naim Rasool Muhammad, 32, kidnapped the boys and their mother, Kametra Sampson, from a South Dallas street Monday morning, police say.

    Sampson escaped and Muhammad drove the boys to a creek in the 1200 block of Brookside Lane, near Interstate 35E and Bear Creek Road, where he drowned them as Dallas police searched frantically for them, investigators said.

    A third son who authorities say Muhammad tried but failed to kidnap from a South Dallas home remained in foster care on Wednesday, said Child Protective Services spokeswoman Marissa Gonzales. A hearing is expected soon, where a judge will determine whether to keep the boy in foster care or release him to his mother or another relative.

    “We just really felt like it was kind of important to make sure that wherever he goes is going to be the safest place for him,” Gonzales said.

    Grieving family and friends declined to comment or could not be reached on Wednesday. At a small candlelight vigil earlier this week, Sampson thanked her supporters and referred to one of her sons as her “little teddy bear.”

    “I’m going to miss them,” she said. “I know they can’t get hurt no more. No more hurting where they at. And I know God is going to look after them.”

    Muhammad faces two capital murder charges and was on “crisis stabilization watch” at the Dallas County jail Wednesday evening. That is not as serious as a suicide watch, but it means that he is still being checked frequently, said Sheriff’s Department spokesman Raul Reyna.

    It is unclear whether Muhammad would face the death penalty if convicted of the capital murder charges he faces. A spokeswoman for Dallas County District Attorney Craig Watkins said the death penalty review committee would consider the case, as it does all eligible capital murder cases.

    “At the proper time, a determination will be made as to whether we will seek the ultimate punishment against Naim Muhammad,” Jamille Bradfield said.

    Foster care for sibling of 2 slain Dallas boys

    A younger sibling of two Dallas brothers who police say were abducted and drowned has been ordered to remain foster care.

    A judge Tuesday decided the 14-month-old son of Naim Muhammad will remain under the authority of Child Protective Services. The boy's mother is allowed supervised visits.

    Muhammad is jailed on two counts of capital murder in the Aug. 22 deaths of his sons, who were ages 3 and 5. Police captured Muhammad hours after the children were snatched while walking to school with their mother on the older boy's first day of kindergarten.

    Police have said they believe Muhammad also tried but failed to abduct the toddler from a relative.

    Bond is $2.1 million for Muhammad, who's also charged with violating probation in an aggravated assault case.

    Dallas County District Attorney's office said Wednesday in a press release that prosecutors will seek the death penalty for a 32-year-old man accused of drowning his two sons.

    Naim Rasool Muhammad was indicted a capital murder charge in the deaths of Naim, 5, and Elijah, 3.

    Dallas police have said that Muhammad kidnapped the kids on the first day of school in August when they were walking with their mother.

    Police said that Muhammad confessed on video to drowing his sons in a remote Glenn Heights creek.

    After killing the boys, Muhammad left them near the creek and returned with his mother. He placed their bodies in the car after his mother asked where the children were, authorities have said. His mother called police.

    Mother testifies in trial of Dallas father accused of drowning children

    On Aug. 22, 2011, 5-year-old Naim Muhammad was excited for the first day of school. At about 8:30 a.m. that morning, he was walking with his mother and younger brother Elijah to Julia C. Frazier Elementary School in southeast Dallas when his father allegedly pulled up behind them and forced the three into a vehicle.

    Four hours later, the boys were dead, drowned, police say, in a southern Dallas creek. When Dallas police caught up with Naim Rasool Muhammad, 34, they found the two boys dead in the trunk of the car he's accused of abducting them in.

    But before Muhammad was in custody, the boys' uncle testified in court Tuesday that Muhammad attempted to break into his home via a bedroom window and screamed, 'Your nephews are dead!' as he was being shoved out.

    Brandon Turner, uncle to slain boys Naim and Elijah, told the court that Muhammad was coming after his third son, 1-year-old Jeremiah. Turner said he was able to keep the boy safe and push Muhammad away from the home.

    Tuesday marked the second day of testimony in Muhammad's trial. He's been charged with two counts of capital murder and faces the death penalty if convicted. During opening statements on Monday, prosecutor Tammy Kemp told the jury that Muhammad ordered his children to "play like they were swimming" in the water while he "held their heads down in the filthy, stinky creek until they stopped breathing."

    Meanwhile, Dallas police launched a manhunt for the then-32-year-old father. During the initial abduction, the mother of the children escaped and flagged down a Dallas County constable. After the alleged attempted break-in, grandmother Priscilla Sampson testified that she was at Jack Evans Police Headquarters when officers told her that the boys were dead.

    She said she had to tell her daughter of the deaths.

    "I didn't want to believe it," said Kametra Sampson, the mother of the murdered boys.

    Kametra Sampson was the third witness the prosecution called on Tuesday. She described a distraught man, frustrated that she was dating another man. She testified that Muhammad told her he didn't want another man raising his sons.

    According to the grandmother's earlier testimony, Muhammad attended a barbecue the weekend before the boys were killed. She said he was upset that the mother was with the children and a new boyfriend.

    Kametra Sampson told the court that Muhammad's anger peaked in a fury on Aug. 22. She said he threatened to beat her with a rock if she and her sons didn't get in the car with him. She said he kept asking her to take him back. Kametra Sampson begged him to stop the car, but he responded, "How would you like it if I killed all of you?"

    Sampson said she spotted a constable and jumped out of the car. She testified that she ran to the constable and said her ex was going to kill her and her sons.

    She told the jury that she was bleeding, crying and scared. She said she didn't think the children would be safe in the car but considered that constable her only hope. Sampson said the constable refused to chase Muhammad's car because she didn't have lights and sirens. She testified that she called Dallas police, but no one acted like the abduction was urgent.

    An Amber Alert was not issued.

    During his opening statements on Monday, defense attorney Paul Johnson admitted that his client was guilty –– even though Muhammad has pled the opposite –– and asked the jury to keep an open mind in an attempt to avoid a death sentence.

    Testimony will continue throughout the afternoon in Criminal District Court No. 4 at the Frank Crowley Courts Building.

    Texas man convicted in drowning deaths of 2 sons

    A jury has taken less than 10 minutes to convict a North Texas man of capital murder in the drowning of two of his sons.

    Naim Rasool Muhammad was convicted Wednesday of killing 5-year-old Naim and 3-year-old Elijah on August 22, 2011. Prosecutors are seeking the death penalty.

    He confessed to police that he took his children to a Dallas-area creek and told them to pretend they were swimming before he held their faces under the water. He told a detective he drowned the boys because he was mad at their mother for breaking up with him.
