    One BRPD officer dead, another critical; suspect arrested

    UPDATE: One of the two Baton Rouge Police officers who were shot Sunday at a house in the city's Howell Park neighborhood has died of his injuries, Baton Rouge Police Chief Murphy Paul confirmed to our media partners at The Advocate.

    Police told the newspaper that the officers, who have not been identified by authorities, were shot while responding to a call Sunday afternoon in the 3100 block of Conrad Drive, which is off North Foster Drive near its intersection with Winbourne Avenue. The shooting occurred inside a house after officers had arrived on scene and made contact with the suspect.

    The second officer was still hospitalized and "fighting for his life" Sunday evening, Paul said. He asked for prayers for the officer and the entire Baton Rouge police force, the newspaper reports.

    The suspect was in custody, police said.

    BATON ROUGE, La. (WAFB) - One of two Baton Rouge police officers involved in a shooting Sunday has died.

    BPRD Chief Murphy Paul has not yet released the name of the deceased officer but said that officer had been on the force for 21 years.

    The other officer, a seven-year veteran of the force, is “fighting for his life” at Our Lady of the Lake Medical Center.

    The suspect, Ronnie Kato, 36, was taken into custody without incident after a four-hour standoff, the police chief said.

    Chief Paul said the officers responded to the 1800 block of Pamela Drive around 9:30 a.m.

    They were looking for Kato as a suspect in a homicide that happened earlier Sunday morning.

    He added the two officers received a tip that Kato was at a home on Conrad Street in the area of Winbourne Avenue and North Foster and while they were checking the scene, Kato fired upon them.

    Kato is suspected of killing one of his own relatives earlier in the day, a source familiar with the case said.

    Two ambulances escorted by multiple police units were seen leaving the area and headed toward the hospital.

    Around 4 p.m., an eruption of gunfire and screams rang out from near the house. It was followed by three or four more gunshots.

    Ronnie Kato ambushed officers, stood over slain cop and shot him multiple times, affidavit says

    Records released Monday reveal more details about the attack on two Baton Rouge police officers Sunday afternoon in which Ronnie Kato is accused of shooting one of his victims to death and then standing over the officer's dead body, continuing to fire an assault style rifle at close range.

    The details are included in the affidavit of probable cause officers filed upon Kato's arrest. The suspect barricaded himself inside his house after the shooting, leading to a standoff that lasted several hours until he was ultimately taken into custody without incident Sunday evening and later booked into jail.

    Kato, 36, had told his girlfriend that if she called police, he would mimic a man who ambushed Baton Rouge area law officers in 2016, according to a 2017 police report cited in the affidavit. He said then that he would "Gavin Long" officers, police wrote.

    Long traveled to Baton Rouge from Kansas City in summer 2016 and killed three law enforcement officers and injured three officers. That attack occurred amid protests over police brutality following the fatal police shooting of Alton Sterling outside a convenience store on North Foster Drive, not far from where Sunday's attack occurred.

    Police were looking for Kato on Sunday in connection with a domestic violence homicide just hours earlier 5½ miles away in which he's accused of shooting to death his longtime girlfriend's stepfather. That shooting occurred around 9:30 a.m. Sunday on North Pamela Drive, and officers had received a tip that Kato was hiding out at a house on Conrad Drive in Baton Rouge's Howell Park neighborhood.

    Officers went to the house to conduct a "knock and talk" with Kato, police wrote in the affidavit. Two officers went around the back of the house "to make sure Kato did not flee."

    "As they approached the backyard Kato opened fire with an assault style rifle striking both officers," police said, killing one officer in the ambush. "Evidence on scene indicated that the suspect stood over the deceased officer and shot him multiple times with an assault style rifle. Several of the wounds appeared to be close contact."

    Both officers were transported to the hospital, but the affidavit reveals one had already died on the scene.

    Baton Rouge Police Chief Murphy Paul gave a short media briefing outside the house on Conrad Drive after Kato had been taken into custody Sunday night. The chief didn't release the names of the officers who were shot but asked the community to pray for his department.

    He said the officer who was killed was a BRPD veteran who had served for 21 years.

    "Our officers — talk about being public servants and the responsibility that comes along with being a law enforcement officer," Paul said during a short media briefing at the scene Sunday. "This is a call no chief wants to get."

    The second officer remains hospitalized.

    Police filed a second arrest report for Kato detailing his alleged actions during the earlier domestic violence homicide that occurred on North Pamela Drive, a residential street off North Sherwood Forest Drive several miles from where the officers were shot.

    Kato's longtime girlfriend told police they had recently been arguing, so she went to her mother's house on North Pamela Drive. Kato showed up at the house Sunday morning and they two started arguing again, police said.

    She then walked in the house away from him, and Kato kicked down the door and struck her in the head with a pistol, according to the affidavit. Kato went back outside, retrieved a rifle and started shooting into the house, she told police. The girlfriend was hiding inside the bathroom but could hear Kato "in the house shooting and yelling 'where she at?'"

    She told police she heard him leave and came out of the bathroom, at which point she saw that her stepfather had been shot. Police identified the victim as Curtis Richardson, 58.

    There were six people inside when Kato shot up the house, police said. It appears Richardson was the only person injured in the attack.

    Kato and his girlfriend had been together for almost 20 years and were engaged to be married, according to the affidavit.

    Aside from the 2017 police report in which Kato allegedly threatened an attack on law enforcement during an argument with his girlfriend, his documented criminal history contains no additional instances of violence. It appears the interaction with police in 2017 didn't result in charges being filed against Kato.

    East Baton Rouge court records show his criminal history is limited to two separate drug possession cases, one in 2001 and another in 2010 — and nothing since then besides a 2013 traffic ticket. Charges were dropped in the most recent drug possession case.

    Civil court records also show no signs that Kato's girlfriend or anyone else had requested temporary protection from abuse.

    Criminal justice experts have been warning about a possible uptick in domestic violence that could occur amid the ongoing coronavirus pandemic because victims are trapped in stressful situations and close quarters with their abusers. Such volatile situations are often dangerous for law enforcement officers responding to such calls.

    A recent increase in shots fired calls also had Baton Rouge police cautioning members of the public to report crimes or potential violence before it happens.

    BATON ROUGE, La. (WAFB) - One of two Baton Rouge police officers involved in a shooting Sunday, April 26 has died.

    BRPD Chief Murphy Paul has released the name of the deceased officer Sgt. Glenn Dale Hutto, Jr. had been on the force for 21 years.

    The other officer, a seven-year veteran of the force, is “fighting for his life” at Our Lady of the Lake Medical Center.

    On Tuesday, April 28, there will be a public processional from the coroner’s office to Rabenhorst Funeral Home on Government Street to honor the fallen officer. The family will be moving the officer’s body. The public is invited to pay their respects along the route from Harding to Government, while keeping social distancing in mind. The procession begins at 1 p.m.

    The suspect, Ronnie Kato, 36, is in custody. Per court records, Kato had his first appearance Monday morning before Judge Richard Anderson and the court ordered he be held without bond.

    District Attorney Hillar Moore announced Monday, April 27 his office will be seeking the death penalty in the case against Kato.

    “My office rarely seeks the death penalty. We do so only in the most serious of cases. The facts as alleged in the affidavits and from information that I have learned are egregious.,” Moore said. "I obviously have not had the opportunity to speak with the victims’ families and do not know their feelings but hope to do so when it is appropriate. As for me and my office, based on what I know now, I believe that pursuing this matter as a death penalty case is what justice would demand. "

    BRPD officer gives thumbs up in hopeful hospital image two days after being shot

    BATON ROUGE – The Baton Rouge Police officer shot in the line of duty Sunday has a long road ahead in his recovery, but has made miraculous progress in the two days since the attack.

    Derrick Maglone was shot responding to reports of a murder suspect being seen near Howell Park around lunchtime Sunday. A second Baton Rouge Police officer with him was also shot. The second officer, Glenn Hutto, died.

    Family members said in an interview with WBRZ Chief Investigator Chris Nakamoto Tuesday, Maglone was shot multiple times in the shoulder and head area. The bullet did not pierce his skull, according to the family. As of Tuesday, Maglone was responding to family members and asked about his fallen colleague.

    Law enforcement runs deep in his family. His father was a longtime sheriff in East Feliciana Parish. His uncle is the former head of Louisiana State Police, Mike Edmonson.

    "The news on Sunday was very grim," Edmonson said. "When we got to the hospital, the surgeons from Neuromedical Center they are phenomenal. The staff at this hospital, when you talk about Derrick right now it's almost miraculous what he has done. We are a couple days out so he is still in a critical period. They will get him up today and walk. Isn't that unbelieveable?"

    Maglone gave a thumbs up in a picture taken and shared with WBRZ.

    Maglone has been a Baton Rouge Police officer for seven years.

    "Today he has proven us wrong, and some of what we thought," Tania Langlois, Maglone's sister said. "He is so tough, and he is fighting. He actually said those words, 'I'm going to fight.'"

    His family said while the first few days since the shooting have shown miraculous progress, Maglone’s full recovery is still an uphill trek. He is still learning to do things, and although he is talking he isn't saying too much.

    "Just thank you to everybody," Langlois said. "The love that we have been shown takes your breath away almost. It's remarkable, so we want everyone to stay safe out there. It's no doubt the quick response from the officers, paramedics and hospital staff is the reason why we have the positive progress right now. It's impressive."

    Lawyers certified to handle death penalty cases sought for accused Baton Rouge cop killer

    State Public Defender Remy Starns and East Baton Rouge Parish District Defender Mike Mitchell filed court papers Friday stating they are unable to assign lawyers to represent Ronnie Kato "due to a combination of existing workload and a lack of adequate resources."

    "Where the state public defender and the district public defender are unable to assign ... counsel, this court nevertheless has the authority and the responsibility to ensure that the defendant's right to counsel is vindicated by the appointment of counsel," Starns and Mitchell wrote to 19th Judicial District Judge Richard Anderson.

    Attached to the court filing is a list of lawyers currently certified for trial-level capital case representation. The groups include the Baton Rouge Capital Conflict Office and several New Orleans-based organizations: Louisiana Capital Assistance Center, Capital Defense Project of Southeast Louisiana, Capital Appeals Project, and Promise of Justice Initiative.

    The day after Hutto's April 26 slaying, East Baton Rouge Parish District Attorney Hillar Moore III said his office planned to seek the death penalty against Kato.

    Ronnie Kato, the 36-year-old man accused of killing his girlfriend's step-father, Curtis Richardson, before shooting and killing Baton Rouge Police Lt. Glenn Hutto Jr. and then wounding Cpl. Derrick Maglone, qualifies for a prompt probable cause hearing, a lawyer with the Capital Appeals Project in New Orleans is arguing for the 2nd time.

    Kato has been behind bars since the fatal April 26 shootings and is being held without bail.

    He has not been indicted, but East Baton Rouge Parish District Attorney Hillar Moore III has said his office intends to seek the death penalty.

    "Mr. Kato has a constitutional and statutory right to a prompt preliminary examination," Joshua Schwartz, a staff attorney with the Capital Appeals Project, argues in a motion filed last week in Baton Rouge state court.

    It is the second time Schwartz has filed a motion for a preliminary exam. The first motion was filed in late April.

    Probable cause is determined at a preliminary examination during which the defense can subpoena and cross-examine witnesses.

    Schwartz filed another motion in April to enroll in the case for the limited purpose of protecting Kato's rights, but Moore said Monday that no judge in the 19th Judicial District Court has indicated that Schwartz may enroll for only a limited role.

    "It is our belief that no one with recognized authority to represent the defendant in this case has requested a preliminary hearing and therefore no such request is legally before the court," the district attorney said.

    Schwartz points out that the state constitution says the right to a preliminary exam "shall not be denied in felony cases except when the accused is indicted by a grand jury."

    A grand jury has not yet taken up Kato's case.

    The ongoing coronavirus pandemic shut down the East Baton Rouge Parish grand jury until June 10, when it met for the first time since March 12.

    "Mr. Kato has the right to a prompt preliminary examination. The ongoing COVID-19 pandemic should not result in further delay," Schwartz argues. "While the pandemic has caused temporary Court closures, the Louisiana Supreme Court has expressly approved of hearings conducted via video conferencing to protect the health and safety of all involved."

    In Baton Rouge police officer's slaying, man indicted on 1st-degree murder counts

    The man accused of fatally shooting a Baton Rouge police officer and his girlfriend's stepfather a few hours apart last April was indicted Wednesday on charges that could lead to his execution.

    Ronnie Kato, 36, of Baton Rouge, was charged by an East Baton Rouge Parish grand jury with 2 counts of 1st-degree murder in the April 26 killings of Lt. Glenn Hutto Jr., 45, and Curtis Richardson, 58.

    District Attorney Hillar Moore III, who was in the courtroom when the grand jury's decision was announced, said his office will continue to meet with the victims' families and that a formal decision on whether to seek the death penalty will be made in the near future.

    "Today starts the formal, long, arduous, emotional life of this case," he said.

    Kato is being held without bond. His case is assigned to state District Judge Richard Anderson.

    Detectives believe Kato fatally shot Richardson, his girlfriend's stepfather, during a domestic dispute at a home on North Pamela Drive off North Sherwood Forest Drive the morning of April 26.

    Then, 3 hours later, Kato allegedly shot Hutto and Cpl. Derrick Maglone as the 2 officers looked for him at a home on Conrad Drive near the intersection of Winbourne Avenue and North Foster Drive.

    Kato barricaded himself inside the home on Conrad in the city's Howell Park neighborhood after the shooting and was taken into custody after a standoff with police that lasted several hours.

    A detective testified at a probable cause hearing this month that Kato ambushed Hutto and Maglone with an assault-style rifle as the officers searched for him in the backyard of the Conrad home.

    Kato was lying down inside a car with heavily tinted windows when he began shooting, Baton Rouge Police homicide detective Logan Collins said during the hearing.

    Maglone, 35, was shot first, Collins said. He was critically injured and released from the hospital May 7.

    After seriously wounding Hutto, who crawled toward Maglone and radioed for help, Kato stood over Hutto — a 21-year veteran of the police force — and fatally shot him, Collins testified.

    Collins, the lead police detective on the case, said the same AR-15 rifle was used to kill Richardson and Hutto.

    Hutto, a sergeant at the time of the shooting, received the rank of lieutenant posthumously.

    Hutto and Maglone were among the half-dozen or so officers sent to the home on Conrad in search of Kato, Collins said.

    BATON ROUGE - Ronnie Kato, a 36-year-old man accused of engaging in an April 26 crime spree that involved taking the life of his girlfriend's step-father, Curtis Richardson, before shooting and killing Baton Rouge Police Lt. Glenn Hutto Jr. and then wounding Cpl. Derrick Maglone, faced Judge Richard Anderson Friday morning for his arraignment.

    Kato, attending the virtual court appearance with his attorney's Lena Hinton and Sean Collins, entered a 'not guilty' plea to two counts of first degree murder and one count of attempted murder.

    It's been nearly six months since he was accused of taking the lives of Lt. Hutto and Richardson, and Kato's appearance has changed to that of man whose spent a significant amount of time behind bars.

    With long hair, a full beard, and noticeably slimmer than he appeared in his April mugshot, Kato faced Judge Anderson with his 'not guilty' plea early Friday morning.

    The 36-year-old was indicted in July, and at that time East Baton Rouge Parish District Attorney Hillar Moore III said his office intends to continue meeting with the victims' families so that a formal decision on whether to seek the death penalty will be made in the near future.

    His next status hearing is January 21, 2020.

    Prosecutors said Wednesday they will seek the execution of a man accused of killing Baton Rouge Police Lt. Glenn Dale Hutto Jr. during an ambush last year, and also said they would dismiss a separate first-degree murder charge because the victim's family will not cooperate with them.

    Ronnie Kato, 37, had been accused of killing Hutto hours after killing his girlfriend's stepfather Curtis Richardson. Richardson's wife and stepdaughter have said they will not aid in Kato's prosecution, and the district attorney's office tried but failed to hold two separate trials.

    East Baton Rouge Parish District Attorney Hillar Moore III is seeking the death penalty for only the fourth time since taking office nearly 13 years ago. He said after a court hearing Wednesday that dismissing the charge in Richardson's case "was not a decision that was made lightly," but was taken after consultation with Richardson's blood relatives seeking justice for their slain loved one.

    The dismissal came five weeks after state District Judge Christopher Dassau said the two killings were integrally related and said Kato should face only one trial in the killings of Richardson, 58, and Hutto, 45.

    Prosecutors had argued they couldn't try Kato before the same jury because Kato's longtime girlfriend and the woman's mother, who is Richardson's wife, won't cooperate with them. The girlfriend, Donkeisha Allen, also allegedly threatened to kill members of the prosecution team, prosecutors have said. Allen is Richardson's stepdaughter.

    East Baton Rouge Parish Assistant District Attorney Dana Cummings explained in court Wednesday that because Dassau's ruling was within his judicial discretion, prosecutors decided to dismiss the murder count relating to Richardson's slaying rather than appeal the judge's ruling.

    Other members of Curtis Richardson's family, including his son Curtis Richardson Jr. and daughter India Richardson and nephew Brian Richardson, attended the court hearing and said afterward they want justice for Curtis Richardson and support the prosecution's pursuit of the death penalty.

    Those family members and members of Hutto's family had a long meeting in the hallway outside Dassau's courtroom after the hearing and expressed support for each other.

    "We were happy to meet the Hutto family," India Richardson said after the meeting.

    India Richardson added that she and other members of the Richardson family who back the prosecution were prepared for the dismissal of the murder count involving her father, but the announcement was still difficult to hear.

    "So much emotion. We trust Miss Dana," she said.

    "I just really want justice for my uncle," said Curtis Richardson's nephew Brian Richardson. "The family just really wants justice."

    Kato's lawyers, Sean Collins and Franz Borghardt, said the dismissal of one of Kato's murder counts does not significantly change anything in the case.

    "Our goal is to save Ronnie Kato's life," Collins said. "We have a job to do."

    Moore said his office's notice of intent to seek the death penalty is "extremely rare and I have sought to use it sparingly, as I should." He reminded that Kato is presumed innocent but said his alleged conduct if proven "warrants jury consideration of the most severe punishment established by law."

    Authorities say Kato killed Curtis Richardson during a domestic dispute with Donkeisha Allen on North Pamela Drive. Kato is the father of Donkeisha Allen's three children.

    Several hours later, police say he fatally shot Hutto and wounded another officer while police were searching for Kato at a home on Conrad Drive.
