    A Florida toddler was near death after being beaten and sexually abused, and her caregiver was charged, deputies said Thursday.

    Nicholas Stephen Canfield, 25, was attempting lifesaving measures on the victim, a 2-year-old girl, when deputies responded to a call in North Fort Myers on Wednesday, the Lee County Sheriff's Office said.

    Canfield has been charged with capital sexual battery (victim under the age of 12) and aggravated child abuse, a first-degree felony.

    A medical exam of the girl found “indications of recent sexual abuse, as well as fresh bruises, swelling and other forms of physical trauma,” according to the sheriff’s office.

    The girl, who was unresponsive when authorities arrived after Wednesday’s call, was immediately taken to a local hospital and placed in its pediatric intensive care unit.

    “Only the lowest form of life would do this to a child,” Sheriff Carmine Marceno said in a statement posted to the department’s Facebook page. “I will do everything in my power to make sure that this predator never has an opportunity to abuse anyone again.”

    As of Thursday, the girl was in critical condition with “an extremely poor prognosis."

    A 2-year-old girl, who was taken to a hospital last week, died Friday after an incident of suspected child sexual abuse.

    Nicholas Stephen Canfield, 25, of North Fort Myers, and the child's caregiver were charged with sexual assault and aggravated child abuse after deputies found him trying life-saving measures on the girl, according to a Lee County Sheriff's news release.

    The Lee County Sheriff’s Office responded to a medical assist call April 29, shortly before 2 p.m. involving an unresponsive 2-year-old girl at a residence on West Mariana Avenue just west of Business 41 in North Fort Myers.

    Canfield was arrested shortly after 5:30 a.m. April 30, and remains in Lee County Jail without bond.

    Medical staff at the Pediatric Intensive Care Unit determined that there were indications of recent sexual abuse, as well as fresh bruises, swelling and other forms of physical trauma.

    Homicide, new abuse charges filed against North Fort Myers man in case involving toddler found unresponsive

    Two more charges have been filed and another child victim listed in the case of a North Fort Myers man found with an unresponsive 2-year-old girl who later died.

    Aggravated child abuse and second-degree homicide charges were filed Monday against Nicholas Stephen Canfield, 25, who was already facing sexual assault and aggravated child abuse charges.

    Canfield was arrested shortly after 5:30 a.m. April 23 after the Lee County Sheriff’s Office responded to a medical assist call at a home on West Mariana Avenue just west of Business 41 in North Fort Myers.

    On Monday, the Sheriff's Office said the murder charge came after the 2-year-old girl in the original case died. The second aggravated abuse charge relates to a second child, a male.

    Sheriff Carmine Marceno said two of the three children in the home showed signs of injury and called the situation "pure evil."

    He said the case was active and open and other charges are being considered, not necessarily against Canfield.

    In the original case, deputies said Canfield, the child’s caregiver, was attempting lifesaving measures on the child when they arrived shortly after 1:30 p.m. The child's mother had left for work at 8 a.m.

    The girl was immediately transported to Golisano Children's Hospital in Fort Myers.

    Medical staff at the hospital's Pediatric Intensive Care Unit determined that there were indications of recent sexual abuse, as well as fresh bruises, swelling to the face, neck and legs, and other forms of physical trauma.

    She died May 1.

    Information on the second child's condition was not available.

    Marceno also commented on a second aggravated child abuse case, reported Sunday.

    "Sadly, this case is not unique," he said. "Lee County Sheriff's deputies responded to a similar call in Lehigh Acres." Deputies discovered a 23-month-old suffering from life-threatening injuries.

    Marceno said that case also remains active.

    A North Fort Myers man arrested in April has been indicted by a grand jury for first-degree murder, sexual battery on a child, and three counts of aggravated child abuse.

    According to the original report, a toddler was taken to the hospital with severe injuries after deputies found the child unresponsive at a home on W. Mariana Avenue at 1:43 p.m. on April 29.

    Deputies say they met with the child’s caregiver, Nicholas Steven Canfield, 25, who was attempting lifesaving measures on the child. The 2-year-old was immediately taken to the hospital, where she later died according to the sheriff’s office.

    Canfield was arrested and initially faced charges of capital sexual battery on a victim under 12 and aggravated child abuse, but on May 18 the sheriff’s office added a second-degree murder charge. Now, the grand jury upgraded that charge to first-degree murder.

    Lee County Sheriff Carmine Marceno said three children were living in the home and another child was also found to have been abused by Canfield.

    State Attorney Amira Fox said in addition to the child who died, Canfield’s two counts of aggravated child abuse are for two other victims.

    Defendant Nicholas Stephen Canfield, 25, has been indicted for:

    • Count I: First Degree Murder, F.S. 782.04 (1), Capital Felony
    • Count II: Sexual Battery, Child Less than 12 Years of Age, F.S. 794.011(2), Capital Felony

    A North Fort Myers man accused of killing a 2-year-old in April will face the death penalty, State Attorney Amira Fox said Monday.

    The State Attorney’s Office filed a Notice of Intent to Seek the Death Penalty against Nicholas Stephen Canfield, 25.

    A Lee County Grand Jury indicted him in October for first-degree murder, sexual battery on a child younger than 12, and three counts of aggravated child abuse.

    Deputies arrested him April 30 and he has been jailed since on $250,000 bond.

    The toddler died April 29. Rescue workers were called to her home on April 23 where they found her unresponsive.

    In May, Sheriff Carmine Marceno said two of the three children in the home showed signs of injury and called the situation "pure evil." Officials called him the children's "caretaker."

    An October indictment charges the additional crimes happened on one or more occasions between March 1 and April 29 and included a male child.

    Canfield is tentatively set for trial in March.

    Assistant State Attorney Francine Donnorummo, the Special Victims Unit chief, and Assistant State Attorney Natalie Savino will prosecute the case.

    Canfield has at least five other arrests in Lee County, including those for probation violations, battery and marijuana possession.

    A North Fort Myers man whose trial began Monday with jury selection will face capital murder after the judge presiding over the case ruled against a motion that challenged a recent change in legislation.

    Lee Circuit Judge Bruce Kyle on Sunday ruled that Nicholas Canfield, 28, who faces one count of capital first-degree murder; one count of sexual battery on a child younger than 12; and three counts of aggravated child abuse, remains eligible for the capital punishment.

    Canfield's attorney, Kathleen Fitzgeorge, on Nov. 28 filed a motion challenging the new death penalty guidelines, which allow juries to recommend death in an 8-4 vote.

    Before the bill took effect April 20, 2023, all 12 jurors had to unanimously find at least one death-penalty aggravating factor existed during deliberations in the guilt phase of the trial.

    The State Attorney’s Office filed on Nov. 23, 2020, a notice of intent to seek the death penalty against Canfield.

    Soon after seating a jury, a judge postponed the capital murder trial for a North Fort Myers man accused of raping and killing a toddler, until, at least, late spring.

    The trial for Nicholas Canfield, 28, began Jan. 29 with jury selection, but was ultimately postponed Wednesday afternoon. Lee Circuit Judge Bruce Kyle briefly called in jurors, thanked them for their attention during the past seven days and said the trial would be postponed due to unforeseen circumstances.

    As jury selection began, Kyle on Jan. 28 ruled that Canfield, who faces one count of capital first-degree murder; one count of sexual battery on a child younger than 12; and three counts of aggravated child abuse, remains eligible for the capital punishment.

    Jury selection lasted roughly seven days. Natalie Savino and Francine Donnorumo are prosecuting for the state.

    As Kyle discussed potential new dates, Savino briefly intervened and mentioned one of the witnesses is pregnant and due in March.

    "I don't know when we’ll able to proceed," Kyle said, referencing two other looming capital-murder trials in Lee County. The trials for Wade Wilson, 29, and Jorge Guerrero-Torres, 35, are set April.

    Canfield's counsel on Nov. 28 filed a motion challenging the new death penalty guidelines, which allow juries to recommend death in an 8-4 vote.
