Under Alabama law, capital murder charges can be filed in cases that involve the murder of a child younger than 12 years old. Upon conviction the only sentences for capital murder are the death penalty or life in prison without the possibility of parole.
"Capital murder charges are definitely on the table," said Chief Assitant District Attorney C.J. Robinson. "We will go where the evidence takes us. As the investigation continues we will be preparing the case for presentation to a future session of the Autauga County Grand Jury.
"Upgraded charges could very well come out of the grand jury, if the investigation supports a capital element."
On July 4, Hundley allegedly punched his pregnant wife in the stomach during an episode of domestic violence, said Prattville Police Chief Mark Thompson. Adriel was delivered, but placed on life support. He was taken to a Birmingham hospital where he died on Aug. 11. He died from injuries he sustained while in the womb, Robinson said.
Hundley is being held in the Autauga Metro Jail on a bond of $250,000.
