    HOUSTON – BREAKING NEWS UPDATE:

    One of two Houston police officers shot on Tuesday morning has died, Houston Police Chief Art Acevedo said.

    Houston Police Officer, Sgt. Harold Preston, who was a 41-year veteran of the force, was struck multiple times, Acevedo said.

    Another officer is expected to recover with non-life-threatening injuries.

    ORIGINAL STORY:

    A suspect accused of shooting two Houston police officers is in custody and will be hospitalized, KSAT’s sister station, KPRC-TV, reported.

    The two wounded officers were transported to Memorial Hermann Hospital, KPRC reported.

    The shooting started as a disturbance call around 8 a.m., police said. Officers arrived on the scene at an apartment building in the 2600 block of Holly Hall around 9:20 a.m., KPRC reported.

    Sergeant Harold Preston, an officer in Houston, Texas, was shot in the head during a domestic incident and later died from his injuries. Another officer was shot in the arm but is expected to survive

    A police officer who was planning to retire this year has died after being shot on the job.

    Sergeant Harold Preston, who had been an officer for 41 years at Houston Police in Texas, was fatally shot during an incident today, (Tuesday, October 20).

    Houston Police Department's Chief Art Acevedo said Preston was shot more than once in the head.


    He was also shot in the shoulder area and a bullet embedded in his spine.


    Officers responded to a domestic at Richmond Manor apartment complex in Holly Hall, near Highway 288 at around 7.55am Central Standard Time.


    Initially police reported that at least one officer had been struck by gunfire, but they have now confirmed one cop has died, and another is in hospital with an injured arm.

    The second officer, Courtney Waller, is expected to survive and his injuries are not life-threatening.


    Waller has only been with the force for three years.


    The suspect was taken into custody without further incident and transported to Ben Taub Hospital.


    Police have now confirmed he was shot in the abdomen and his injuries are not life-threatening.


    Acevedo said officers were responding to a domestic violence situation when Preston, Waller and another cop arrived on the scene.


    The estranged wife of the suspect, identified as 51-year-old Elmer Manzano, told them she was moving out and wanted to retrieve items from the apartment.


    Acevedo said the force had two previous service calls at the same address over the weekend.


    Today, the woman said the door was locked and Manzano wouldn't let her in, and officers spoke with her for an hour.


    Around 9.25am, the suspect's 14-year-old son, who was with the woman in the parking lot of the complex, managed to unlock the door and open it.


    The son saw that Manzano had a gun and told officers.


    That's when Manzano reportedly fired multiple rounds, which hit Waller and Preston, the chief of police said.


    Police were able to safely move Preston away from the apartment at 9.31am, while the suspect remained inside.

    HPD Sergeant Harold Preston was killed in the line of duty today. Sgt. Preston has been with the Houston Police Department for 41-years and was due to retire at year-end. As tragic as that is, his death was 100% preventable. His partner also was shot and will survive his injuries. In addition, the shooters own 14-year-old son was shot.

    The suspect, Elmer Manzano, a convicted felon with multiple prior assaults on his record was in custody, detailed just a day before this tragedy occurred. On October 18, HPD Officers responded to a call from Mrs. Santos, stated that her ex-husband, Elmer Manzano, was at the location brandishing a gun threatening Mrs. Santos and her children. HPD Officers took Elmer Manzano into custody that day but Harris County District Attorney Kim Ogg declined to take charges, instructing Officers to release him, and return the six bullets he had in his pocket, he was also allowed to keep his gun which he claimed was locked in his safe. Had charges been accepted, Mr. Manzano might be back on the street, but his gun and ammunition would have been seized and held as evidence. No gun would have meant no dead officer and injured officer.

    Today, responding to another call from Mrs. Santos, Officers responded. Mr. Manzano answered the door with gunshots at point-blank range. The two officers and Manzano’s 14-year-old son were hit. 100% preventable. The actions of Harris County DA Kim Ogg are inexcusable. While Mr. Manzano pulled the trigger, Kim Ogg put the gun in his hands. Her actions are directly responsible for the death of HPD Sergeant Harold Preston.

    Citizens mourn the tragic and senseless loss of HPD Sergeant Preston They have an opportunity to ensure this does not happen again. DA Ogg’s fate is in the hands of Harris County voters NOW. She is on the ballot today. Vote to keep your streets, your neighborhoods, your homes, and your family safe. Vote to keep the men and women of law enforcement from preventable perils. Vote to hold Kim Ogg responsible for HPD Sergeant Preston’s death.

    U.S. Attorney Files Federal Charges on Accused Houston Cop-Killer

    HOUSTON, Texas — The United States Attorney for the Southern District of Texas filed two federal charges against the criminal alien accused of killing Houston Police Sergeant Howard Preston. The charges will help ensure the accused killer stays behind bars.

    In an interview with Breitbart Texas, U.S. Attorney for the Southern District of Texas Ryan Patrick said his office is filing two federal gun charges against 51-year-old Elmer Rolando Manzano-Martinez. Manzano is a Salvadoran national who is illegally present in the United States, according to U.S. Immigration and Customs Enforcement officials. He is currently under arrest in Harris County, Texas, on charges that he murdered Houston Police Sgt. Howard Preston.

    Ryan said his prosecutors filed one count of Alien in Possession of a Firearm and one charge of Felon in Possession of a Firearm. The felon in possession stems from Manzano’s 2002 felony conviction in Harris County, Texas. Patrick said his office is also considering additional federal charges.

    “We filed these charges for two reasons,” Patrick said. “First, the delay in Harris County’s filing of Capital Murder charges raised concern that the suspect could walk out of the hospital.”

    He said he is also concerned about the current climate in Houston where state district court judges have released Capital Murder suspects on bond.

    “We don’t want HSI or other law enforcement agents to have to go looking for the guy,” USA Patrick explained. “It is much more of a danger to our law enforcement agents and the community if we have to pick him up on the streets.”

    ICE Enforcement and Removal Operations officers filed an immigration detainer with the Harris County Sheriff’s Office on Monday night, officials told Breitbart Texas. Patrick explained the new federal charges will carry more weight in preventing Manzano’s release from custody.

    The Harris County District Attorney’s Office has not yet committed to seeking the death penalty in the state’s Capital Murder case, spokesman John Donnelly told Click2Houston on Wednesday evening. He explained it is very early in the process.

    On October 18, Houston police officers worked a possible domestic violence call at Manzano’s home. No charges were filed against Manzano in that incident. However, the police officer reportedly found six bullets in Manzano’s pocket. Manzano also allegedly told police he had a gun in his safe.

    While an illegal alien in possession of ammunition is not a violation of Texas law, it is a violation of federal law, Patrick stated. He explained that if Manzano had bullets in his possession and the Harris County ADA had contacted his office, they could have picked him up on federal charges and started the immigration removal process.

    Ryan said his office has been offering local police and prosecutors the option of getting his office involved to bring federal charges on difficult violent crime cases or where they need to get a bad guy off the streets — particularly if a gun is involved.

    His office made violent crime a focus when he was appointed by President Donald Trump in 2018. He brought on new prosecutors to focus specifically on violent crime.

    As a result, Ryan expressed, prosecutions for violent crimes increased by five percent in his first year and 57 percent the following year. He explained they are now doubling the 10-year rolling average.

    Violent crimes have been increasing in big cities across the country, the head of the nation’s largest federal prosecutor’s office stated.

    “The U.S. Attorney’s Office is into violent crime because someone’s got to be,” Patrick concluded.

    HOUSTON — A man accused of shooting two Houston police officers -- one fatally -- was officially charged with capital murder and attempted capital murder on Wednesday, and prosecutors said they will seek the death penalty.

    Elmer Manzano, 51, is accused of fatally shooting Houston Sgt. Harold Preston, 65, and wounding Officer Courtney Waller on Tuesday at an apartment complex in southwest Houston, KHOU reported. Manzano is also charged with aggravated assault-serious bodily injury, the television station reported.

    Manzano remains in an area hospital after being shot in the stomach by officers, KPRC reported.

    Harris County District Attorney Kim Ogg said her office will pursue the death penalty against Manzano, KTRK reported. Ogg said she based her decision not only on Preston’s death, but also on the injuries suffered by Waller and Manzano’s 14-year-old son, the television station reported.

    HOUSTON, Texas (KTRK) -- The man accused of killing a HPD sergeant last week fired at officers because they shot at him, according to details revealed in court overnight.

    Suspect Elmer Manzano did not appear in court because he is still in the hospital being treated for a gunshot wound to the stomach.

    Still, more details about the charges against him were read in court.

    He has no bond for his charges of capital murder and aggravated assault. He also faces an attempted capital murder charge and was issued a $500,000 bond for that.

    Last Tuesday, Manzano, 51, was taken into custody from the Richmond Manor apartment complex on Holly Hall and reportedly taken to Ben Taub Hospital.

    Police said he had barricaded himself in an apartment after the shooting that killed HPD Sgt. Harold Preston and wounded Officer Courtney Waller.

    Manzano is also accused of shooting his 14-year-old son, who was taken to Texas Children's Hospital. His condition was not immediately disclosed.

    The incident came in as a domestic violence call, where Manzano's wife and son were trying to retrieve their belongings and leave.

    According to what was read in court overnight, Manzano fired 10 shots when he came out of the family's apartment.

    Investigators say that when Manzano was interviewed by police at the hospital, he "stated that he knew the police officers were out there. And when he answered the door, he claimed that the police officers shot at him so he fired back at them about five times."

    Manzano had threatened his wife twice leading up to the shooting, according to police.

    Police documents obtained by ABC13 showed as recent as the weekend before, the couple had a verbal fight over their 14-year-old son's custody. Officers were called at that time, where they found six bullets on Manzano but no gun. The incident resulted in police reporting "no assault occurred."

    Going a step further, the Harris County District Attorney's Office was willing to accept a terroristic threat charge if officers believed that an assault happened. Prosecutors stated on their charge refusal slip "officer does not believe offense occurred."

    A search of Manzano's criminal history showed a December 2002 charge of evading arrest with a motor vehicle, but Acevedo indicated Manzano had police called on him over repeated abuses to his family.

    Federal trial date set for on unrelated gun charges for suspect in murder of HPD sergeant

    HOUSTON, Texas (KTRK) -- A trial date on unrelated charges has been set for the man accused of killing HPD Sgt. Harold Preston.

    Elmer Manzano is scheduled to appear in federal court on Dec. 28. on firearm possession charges.

    Manzano, who is currently in jail without bond for charges of capital murder and aggravated assault, also faces an attempted capital murder charge. Arraignment on state charges is scheduled for Dec. 2.
