Dallas man on death row loses appeal for second time
A Dallas man on death row lost an appeal Monday to the 5th U.S. Circuit Court of Appeals for the second time.
Ivan Cantu was sentenced to death in Collin County in the killing of his cousin in 2001. The federal appeals court rejected Cantu's argument that his legal help was deficient for failing to investigate and present evidence that he was innocent.
Cantu was convicted of capital murder in the death of 27-year-old James Mosqueda and he was indicted in the death of his cousin's girlfriend, 22-year-old Amy Kitchen, according to The Dallas Morning News archives.
A former girlfriend testified that Cantu told her he planned to kill Mosqueda and that he showed her the bodies, which were found at the couple's home in Far North Dallas.
Cantu took Kitchen's engagement ring, evidence showed, and gave it to his own girlfriend.

In today's United States Supreme Court orders, Cantu's petition for writ of certiorari was DENIED.

US Supreme Court Refuses Appeal From Dallas Man on Death Row
HOUSTON (AP) — The U.S. Supreme Court has refused to review an appeal from a Dallas man on death row for fatally shooting his cousin during a November 2000 robbery where a second person also was killed.
The high court had no comment Monday in its decision in the appeal from 44-year-old inmate Ivan Cantu. He argues his legal help at his 2001 trial was deficient for failing to investigate and present evidence that he's innocent.
Cantu was convicted of killing 27-year-old James Mosqueda and was indicted for the death of Mosqueda's girlfriend, 22-year-old Amy Kitchen. The two were shot at Mosqueda's Collin County home in north Dallas.
Mosqueda's Corvette was taken and found outside Cantu's apartment. Evidence showed he took Kitchen's engagement ring and gave it to his own girlfriend.

He exhausted appeals two years ago. Why hasn't he gotten a date by now?
Any reasons for the delay?

Nice. He needs to go too.
Paco Rivera's episode on Cantu. Not nearly as compelling for Cantu as I thought it might be, although I don't recall any mention of his fingerprints on the gun.
