    Summary of Offense:

    On November 4, 2000, in Dallas, Cantu shot and killed James Mosqueda, 27 (cousin to Cantu), and Mosqueda's girlfriend, Amy Kitchen, 22. In addition, Cantu took jewelry and a vehicle from the victims.

    Cantu was sentenced to death in Collin County in November 2001.

    On October 13, 2010, Cantu's request for DNA testing was denied by the Texas Court of Criminal Appeals.

    On April 20, 2009, Cantu filed an appeal before the US Court of Appeals for the Fifth Circuit over the denial of his habeas petition in Federal District Court.

    On January 26, 2011, the Fifth Circuit Court of Appeals affirmed the district court’s denial of habeas relief.

    As per the TDCJ, an execution date of August 30, 2011 has been set for Cantu.

    According to Thomas M. Jones, Assistant Attorney General and Gena Bunn the counsel of record for Cantu, Collin County convicting court issued an order withdrawing the execution date. I am awaiting a copy of that order.

    I think it is for DNA testing. The state isn't challenging his request for testing.
