    Facts of the Crime:

    On February 22, 1997, in Edinburg, Cardenas and a co-defendant murdered Mayra Laguna, 16. Cardenas entered the victim's residence through a window, tied her up with duct tape, then put her in a vehicle with the co-defendant and drove to a remote location. Cardenas raped Laguna, beat her severely with his fists and strangled her, causing her death. Cardenas dumped her body into a nearby canal.

    Cardenas was sentenced to death in Hidalgo County in July 1998.

    Following the denial of his habeas petition by the US Court of Appeals for the Fifth Circuit, Cardenas' petition for a writ of certiorari was denied by the US Supreme Court on April 19, 2010.

    On August 22, 2011, the 5th Circuit Court REMANDED Cardenas' case to the district court for the limited purpose of considering whether a COA should issue.

    On August 21, 2015, Cardenas filed an appeal before the US Court of Appeals for the Fifth Circuit.

    Mexican national on Texas death row loses federal appeal

    HOUSTON (AP) — A Mexican national on Texas death row for the rape-slaying of his 16-year-old cousin in the Rio Grande Valley nearly two decades ago has lost a federal court appeal, moving him a step closer to execution.

    The 5th U.S. Circuit Court of Appeals rejected arguments from 46-year-old Ruben Ramirez Cardenas that authorities in Hidalgo County failed to notify him of his rights under an international treaty that he could contact Mexican consulate officials after he was arrested for the 1997 killing of Mayra Laguna.

    The appeals court said Thursday he has no individual rights under the Vienna Convention on Consular Relations because the Supreme Court hasn't shown the treaty is enforceable.

    Records show Cardenas slipped through a window at the girl's Edinburg home, abducted her, then raped and killed her.

    Execution Set for Mexican National on Texas Death Row

    HUNTSVILLE, Texas (AP) — A Mexican national on Texas death row for the rape-slaying of his 16-year-old cousin in the Rio Grande Valley more than 20 years ago has received an execution date.

    Texas Department of Criminal Justice spokesman Jason Clark says the agency has received court documents setting the lethal injection of 47-year-old Ruben Ramirez Cardenas for Nov. 8.

    Cardenas was convicted of the February 1997 slaying of Mayra Laguna. Her body was found dumped in a canal near Edinburg, about 10 miles (16 kilometers) northeast of McAllen where she was abducted from her home. Evidence showed he slipped through a window, bound her with duct tape and drove her away. Evidence showed she was raped, beaten and strangled.

    Prison records list Cardenas as originally from Guanajuato in central Mexico.

    Unless they sought the death warrant earlier than 10 days ago, the state might need to reschedule because it doesn't look like they followed the 91-day rule.
