    CINCINNATI (WXIX) - A man accused of killing a Cincinnati mother and her 3-year-old son in 2020 is asking the court to take the death penalty possibility off the table.

    Desean Brown will appear in court Monday after his attorney filed the motion to exclude the death penalty, claiming the defendant is seriously mentally ill, according to court documents.

    Under Ohio law, the death penalty is banned for defendants who were seriously mentally ill at the time of their offense.

    Brown is suspected of killing Nyteisha Lattimore and her 3-year-old son, Nylo, in 2020, Hamilton County Prosecutor Joe Deters said at the time.

    Prosecutors think Nylo’s body was thrown into the Ohio River. The 3-year-old’s body has never been found.

    Brown’s lawyers also want the current trial schedule thrown out. His lawyers claim the defense and prosecution need time to evaluate Brown’s mental state.

    Previously, Brown’s lawyer requested a lower bond for their client, but a judge denied the request.

    The last time Brown was in court, Nylo’s biological father punched him.

    Suspect in killings of Nylo, Nyteisha Lattimore fit to stand trial, prosecutor’s office says

    CINCINNATI (WXIX) - The suspect in the killing of a Cincinnati mother and her 3-year-old son is fit to stand trial, according to the Hamilton County Prosecutor’s Office.

    Desean Brown is accused of killing Nyteisha Lattimore and her son, Nylo, in 2020.

    Prosecutors think Nylo’s body was thrown into the Ohio River. Despite countless search efforts, his body has not been found.

    Brown’s lawyers have filed a motion to exclude their client from possibly facing the death penalty, court records show.

    The filed motion claims he is seriously mentally ill, which under Ohio law, means he could not receive a death penalty sentence.

    The judge in the case says the prosecution needs time to have their own independent expert evaluate Brown to see if they to conclude Brown is mentally ill, as the defense determined.

    A hearing for the exclusion of the death penalty motion is scheduled for Oct. 26.

    Back in June, Brown was in court for another motion hearing in the murder case when Nylo’s biological father, Tonio Hughes, ran up and punched him in the face.

    Two sheriff’s deputies quickly restrained Hughes and placed him into custody, Hamilton County Sheriff’s PIO Kyla Woods said.

    Following the incident, Judge Megan Shanahan found Hughes in contempt of court and sentenced him to seven days at the Hamilton County Justice Center.

    The judge ordered Hughes to be released on June 27, which was three days earlier than the original release date.

    Judge sets new decision date for Nylo Lattimore murder case

    CINCINNATI, Ohio (WXIX) - Two years after the deaths of Nyteisha Lattimore and her 3-year-old son Nylo, we still don’t know what will happen to the man suspected of killing them.

    On Wednesday, the defense’s motion to take the death penalty off the table was delayed again, according to the court hearing.

    A state expert hasn’t finished the report to evaluate whether Desean Brown, the accused suspect, is seriously mentally ill as his defense claimed.

    At his August trial, Brown’s lawyers filed a motion to exclude the death penalty. Now, the judge in the case will make a decision on the motion on Nov. 28.

    In Dec. 2020, Nyteisha’s body was found near the Purple People Bridge, and prosecutors believe that Nylo’s body was dumped in the Ohio River.

    According to the Hamilton County Coroner, Nyteisha died from stab wounds. Nylo’s body still hasn’t been found.

    Brown faces the death penalty with two counts of aggravated murder, one count of abuse of a corpse, and one count of tampering with evidence.

    Man accused of killing mother, toddler returns to court; Victims' family member speaks

    CINCINNATI — Nearly 2 1/2 years after a Walnut Hills mother and her 3-year-old son were killed, family members say life hasn't gotten any easier.

    "Two-and-a-half years of living Hell," Rodrick Lattimore said.

    Rodrick Lattimore's daughter, Nyteisha Lattimore, and her son, Nylo Lattimore, were killed in December 2020.

    Rodrick Lattimore said he wakes up thinking about his daughter.

    "And every time I cross that river, I think about Nylo," Lattimore said.

    Hamilton County prosecutors said they believe Nyteisha Lattimore's boyfriend, Desean Brown, threw the toddler into the Ohio River alive.

    Brown is also accused of stabbing Nyteisha to death before wrapping her in a body bag that investigators said he bought on eBay. Her body was found near the Purple People Bridge.

    Despite numerous searches, Nylo's body was never located.

    "If I could look Desean Brown in the eye right now, I would say to him, 'Desean Brown, you deserve nothing less but the death penalty,'" Rodrick Lattimore said.

    Brown was indicted on two counts of aggravated murder, and his attorneys are fighting to get the death penalty dismissed if convicted.

    Three doctors have evaluated him.

    "We have all of the reports from the doctors. We have conflicting reports," Judge Megan Shanahan said in court on Tuesday.

    Prosecutors said two of the three believe Brown does not have a severe mental illness, but the third thinks he does.

    Judge Shanahan will hear testimony from all three on Aug. 31 and will then make a ruling. If she finds Brown is severely mentally ill, the death penalty would be taken off the table.

    If it were up to Rodrick Lattimore, there would be only one option.

    "You deserve nothing but death. You don't deserve prison life. You deserve death," Rodrick Lattimore said. "You don't deserve to live, Desean Brown. You are a monster."

    CINCINNATI — The man accused of throwing a 3-year-old boy into the Ohio River alive after stabbing the boy's mother to death is scheduled for a mental illness hearing Thursday.

    It's been nearly three years since Nylo and Nyteisha Lattimore were tragically killed and Desean Brown was arrested for their murders. For the past year, Brown's attorneys have filed continuances for his trial as they work to have mental health evaluations done on him.

    In August 2022, Brown's attorneys filed two motions: One requested the death penalty be dismissed in Brown's case because of the mental illness; a second motion requested to vacate Brown's trial schedule to allow the prosecution to appoint their own expert to evaluate Brown.

    Now, Brown will appear at the Hamilton County Courthouse at noon for a serious mental illness hearing; Defense attorneys issued a subpoena Wednesday requesting a psychological health professional testify on Brown's behalf at the hearing.

    If Judge Meghan Shanahan rules Brown is suffering from a severe mental illness, the death penalty — which prosecutors announced they would seek against Brown in 2021 — could be dropped.

    Nyteisha was stabbed to death in her home Dec. 5, 2020 according to police. Her body would not be discovered until Dec. 12, 2020 when officers found it abandoned on Pete Rose Way in downtown Cincinnati.

    Brown let Nyteisha's body sit in her apartment for at least five days, prosecutors said, before using a body bag to remove it from the apartment. Prosecutors said they believe Nylo was thrown into the river alive one day after Nyteisha's murder, on Dec. 6. Nylo's empty stroller was discovered along the Ohio River, not far from where his mother's body was located, on Dec. 13.

    Nylo's body has never been recovered.

    In June, Cincinnati police detectives told the judge it appears Nyteisha was pregnant with Brown's child, but had a miscarriage. Detectives believe Brown killed her and Nylo out of retaliation for the miscarriage.

    Over the past three years, Brown's team has filed motions to dismiss the case against him entirely based on a multitude of factors, including insufficient evidence.

    Thursday's hearing centers on whether the death penalty applies to someone in his mental state. Defense Attorney Martin Pinales, who is not affiliated with this case, said motions like these come with challenges.

    "A lot of people who are convicted of any offense, whether there's a death penalty or not, have some degree of mental illness," he said. "The question is 'Is it sufficient to get over the hurdle of the person being so severely ill that they should not receive the death penalty?'"

    Pinales said timing can help or hurt arguments in a case.

    "We have had cases where we said the person is not guilty by reason of insanity or that the person is not competent to stand trial because of mental health issues," he said. "I haven't had it where it to where the death penalty has already been invoked and now the person is trying to negate that."

    Nylo Lattimore’s dad escorted out of hearing for son’s suspected murderer

    CINCINNATI (WXIX) - The biological father of Nylo Lattimore was escorted out of the courtroom for a second time during a hearing for the man accused of killing the toddler and his mother in 2020.

    Desean Brown is facing the death penalty for allegedly stabbing Nyteisha Lattimore and killing her 3-year-old son Nylo before placing the child’s body in the Ohio River in December 2020.

    His defense team says Brown is mentally ill and had a psychologist testify to back their claim.

    “He suffered from a severe mental illness at the time of the offense as charged and that severe mental illness significantly impaired his capacity to exercise his rational judgment,” Brown’s defense claimed.

    Prior to the hearing, prosecutors spoke with Tonio Hughes who is Nylo’s father.

    Hughes was allowed back in the courtroom Thursday despite being previously escorted out of the courtroom for attacking Brown during a June 2022 hearing.

    There were six deputies in the courtroom Thursday to protect Brown.

    Hughes glared at Brown throughout the hearing and interrupted the court during witness testimony.

    The testimony continued, but Hughes made another outburst and was escorted out of the courtroom.

    Prosecutors then put their psychologist on the stand who said Brown was mentally stable.

    “I did not find any evidence from speaking with him or the other collateral sources of information of any significant disturbances of thought, mood or orientation or perception or memory,” the psychologist said Thursday in court.

    Ohio law does not allow a person with severe mental illness to face the death penalty.

    Brown’s attorneys say he is bipolar, which they claim falls under the statute to define someone as mentally ill.

    Judge Megan Shanahan heard two hours of testimony Thursday from psychologists.

    She said it will take her some time to go through all the analysis before deciding whether Brown’s case will go forward as a capital case.

    The judge said she will have a decision on Sept. 26.

    Previous Hamilton County Prosecutor Joe Deters said Nyteisha was killed on Dec. 5, 2020. Her body was found around 3:30 a.m. on Dec. 12 near the Purple People Bridge.

    Her body was in her Walnut Hills apartment for five days before Brown disposed of it, according to Deters.

    Brown allegedly purchased a body bag from eBay and took an Uber down to the Ohio River, telling the driver it was his clothes because he was moving out.

    The prosecutor says Nylo’s blood was found on a Paw Patrol blanket recovered with Nyteisha’s body. His stroller was also allegedly located in the Ohio River near where his mother’s body was found.

    CINCINNATI, Ohio (WXIX) - Nearly three years after the vicious slayings of a Cincinnati mother and her 3-year-old son, a judge announced Tuesday their accused killer can face the death penalty if he’s found guilty at trial.

    The suspect, Desean Brown, 23, showed no immediate reaction as Hamilton County Common Pleas Court Judge Megan Shanahan gave her decision and then immediately set his trial for Dec. 5.

    Brown is charged with two counts of aggravated murder and one count each of abuse of a corpse and tampering with evidence in the December 2020 deaths of Nyteisha Lattimore, 29, and her toddler son, Nylo.

    Brown’s lawyers wanted the death penalty taken off the table.

    They contend he is seriously mentally ill and was incapable of knowing what he was doing.

    Prosecutors strongly objected and cited multiple steps they say he took in trying to cover up the slayings. That proves he knew precisely what he was doing.

    As Brown awaits trial, he is held on an order of “no bond” at the Hamilton County jail.

    Nyteisha Lattimore was found stabbed to death and abandoned on Pete Rose Way near the Purple People Bridge over the Ohio River around 3:30 a.m. on Dec. 12, 2020, prosecutors and police have said.

    Her son’s stroller was found along the river nearby.

    Cincinnati police testified Brown was motivated to kill her. He blamed her for miscarrying his baby and talked about killing her and her son in retaliation.

    Police and prosecutors have said they believe Brown actually killed Lattimore on Dec. 5, 2020, and left her body in the apartment for five days.

    The following day, they say Brown threw her son off the bridge while he was still alive in the middle of the night.

    The little boy’s body has never been found despite exhaustive searches that combed miles of the river banks in Ohio, Kentucky and Indiana.

    Prosecutors have said in news conferences and prior court hearings in the case that Brown researched online how to clean up blood and then tried to clean up the crime scene, bought a body bag on eBay and lied to the Uber driver who took him to the river by saying the body bag he had with him was full of clothes and other personal items.

    Three psychologists who interviewed Brown testified at his most recent hearing.

    Two said he has bipolar disorder but one said it doesn’t impact his ability to know right from wrong.

    The third psychologist said Brown doesn’t have a serious mental illness.
