    Apparently there's a hearing to set an execution date for Clark. Seems Clark contacted the judge and asked for a date.

    Troy Clark's execution date set for the 1998 murder of a Tyler woman

    An execution date has been set for a Tyler man sentenced to death for the 1998 drowning a young mother in his bathtub and stuffing her body in a barrel.

    Troy James Clark exhausted all his appeals and will face execution on Sept. 26, 2018. The date was announced Monday in the 7th District Court.

    Clark appealed to the 5th U.S. Circuit Court of Appeals in 2012 claiming his legal help was deficient during his trial in 2000, two years after Christina Muse, who briefly lived with him, was killed. The New Orleans-based 5th Circuit rejected the claim.

    Muse was tortured with a stun gun, beaten with a board, bound with duct tape and drowned. Her body was encased in a 55-gallon drum filled with cement and lime. Her body was left in a ravine on his landlady's property near the Tyler Pounds Regional Airport.

    Clark, 50, was convicted in 2002 of capital murder for the May 1998 murder/kidnapping of 20-year-old Christina Muse, who was believed to have been killed because Clark feared she would snitch on him for dealing drugs.

    Evidence during the trial revealed Clark tormented Ms. Muse with a stun gun, bound her with duct tape and kept her in a closet in his south Tyler home for hours.

    With help from his girlfriend, prosecutors said Clark bludgeoned Ms. Muse with a board and drowned her in his bathtub.

    Torygene Bush testified against Clark, her former live-in boyfriend, and received 20 years in prison for her part in the murder.

    Clark's attorneys had contended Ms. Bush was the mastermind behind the plot.

    Prosecutors said Clark encased Ms. Muse's body in cement and lime that he ordered Ms. Bush to retrieve from a nearby store.

    Ms. Muse's body was discovered by police, with cooperation from Ms. Bush, about four months later in a ravine on property belonging to Clark's landlady off Texas Highway 64, west of Tyler.

    While looking for Ms. Muse, police found the body of federal drug defendant Tracy Mize floating in a septic tank on the same property.

    Investigators surmised Clark fatally shot Mize because he knew about the murder of Ms. Muse and was in a position to make a deal in exchange for leniency in his drug case.

    Witnesses in Clark's trial contended he killed a man in Houston in 1988 and raped a woman the same year, but Clark was not charged with those crimes.

    Clark knew his case was over after the cert denial. The only detail that hindered a previous death warrant was his Trevino appeal, which wasted 5 years of our time and money. That slop has now worked through the federal courts completely, and now a warrant was finally set as a result.

    Has Clark not filed any further appeals since May?
    Violence and death seem to be the only answers that some people understand.

    To date, Clark's attorneys have not filed appeals to any court. His attorneys may file last minute appeals to the US Supreme Court early Wednesday for a stay of execution. Other than that, this execution is to be the 554th Texas' execution in the modern era. For Daniel Acker, same for Thursday. This is known as a twofer or back to back.

    It is my understanding that Clark (I'm embarrassed to share a last name with this guy) asked for the execution date to be set. And he has nothing left to litigate. I don't think anything will be filed. It looks like Acker will file to SCOTUS, but with the TCCA denial he's all but finished. Texas looks poised to carry out back to back executions.

    Tyler man slated to be 1st of two Texas death row inmates executed in two nights

    The East Texas man convicted of drowning a former housemate and stuffing her body into a barrel of lime is slated to die Wednesday in the first of two consecutive executions in the Lone Star State.

    If both punishments go through as planned, it'll be the first time in just over six years that Texas has put to death two prisoners in two nights.

    Both men say they're innocent, and the pair of impending executions - first of Troy Clark, then of Daniel Acker - has attracted attention from actress Susan Sarandon, author Mary Buser and renowned death penalty abolitionist Sister Helen Prejean.

    "Texas plans to execute Troy Clark on Wednesday but there are some serious problems with his case," Prejean tweeted. "Troy has always maintained his innocence. Someone else made a detailed confession and then completely changed her story in exchange for a reduced sentence."

    Clark was sentenced to die in 2000 for killing Christina Muse out of fear the young mother would snitch on him for his drug use, according to court records. He was convicted in part due to the testimony of his then-girlfriend Tory Bush, who admitted to the crime then fingered Clark - even though there was no physical evidence connecting him to the murder.

    The May 1998 slaying came just after Muse moved out of the Smith County home where Clark and Bush lived and sold meth.

    One day when Muse stopped back at the home to visit, she and Clark started talking and at some point in the conversation, according to court records, he used a stun gun to take her down, then duct-taped her arms and legs and left her in a closet for hours. Then, he moved her into the bathtub and ordered Bush to get a board so he could beat the bound woman.

    After drowning Muse, according to court records, Clark ordered his girlfriend to go get lime. When she got back, he dumped the slain woman's body in a blue barrel filled with lime, cement mix and water.

    Later, according to the state's theory, Clark and some friends loaded the barrel into a truck and ditched it in a remote spot on his landlord's property.

    When authorities found the gruesome remains, they also discovered the body of Tracy Mize decaying in a septic tank on the same property.

    In trial, the jury also heard evidence that Clark allegedly killed two other people and robbed others.

    But Clark denied his involvement, saying he wasn't at home at the time of the slaying, and that he was out delivering drugs. No physical evidence linked him to the crime, defense lawyers pointed out.

    In the years since he was sent to death row, Clark has argued that he suffered bad lawyering, didn't get to show evidence rebutting claims he would be a future danger to society, and that his girlfriend's testimony was self-serving and unreliable - especially considering she once confessed to the crime herself.

    "Clark's death sentence is the product of the largely uncorroborated testimony of an incentivized co-defendant and a trial attorney whose performance was abysmal," attorneys David Dow and Jeff Newberry wrote in a clemency petition, alleging the trial team failed to present evidence of Clark's traumatic childhood and Fetal Alcohol Syndrome Disorder.

    But the Board of Pardons and Paroles on Monday afternoon denied his request for clemency. As of early Tuesday, he had no pending appeals, his attorneys said.

    A day after Clark's scheduled date with death, Acker is slated for execution. The Sulphur Springs man was sent to death row in 2001 after he was convicted of strangling his girlfriend and pushing her from a moving car - though the state abandoned the strangulation theory after trial.

    The Lone Star State has already executed eight men this year, and another nine death dates are on the calendar.

    East Texas man to be executed in 1998 murder of Tyler mother

    TYLER, Texas (KETK) - Editors notes: The trial of Troy Clark took place in 2000, not 2002 as stated in the video. It was also days, not weeks, before the discovery of Mize and Muse's body, in which Clark and Bush were questioned by authorities.

    On Wednesday September 26, 2018 former Tyler resident Troy Clark will be put to death for the brutal murder of Christina Muse in 1998.

    In October 2017, the Supreme Court of the United States refused Clark's, 50, appeal claiming he had insufficient legal counsel during his 2000 trial in Smith County.

    THE DISAPPEARANCE OF CHRISTINA MUSE

    On May 1, 1998 Christina Muse, 20, went missing in Tyler.

    The mother of a two-year old was described as being a bright, and sweet person. Her family said she was a "loving mother, and a loving daughter," but at times she was naive which lead her to Clark.

    Muse lived with Troy Clark and his girlfriend Tory Gene Bush for more than half a year before her disappearance. Clark was known as a drug "king pin" who was an intimidating figure in the crime community.

    It was believed that Muse was a drug user, but her family insists that she was not involved in drugs.

    Christina's family said she had moved out of Clark's house and was looking to move on with her life. On the day she went missing she had gone to Clark's house to collect money he owned her. She parked her vehicle behind Clark's truck before going inside where she would be murdered.

    TROY CLARK AND TORY GENE BUSH

    Tory Gene Bush and Troy Clark has been in a long-term relationship for several years. In an interview with police during the investigation, Bush would described their relationship as being a "common law" marriage.

    Clark was a well known player in the illegal drug game in the East Texas community. He was known as a man who "you didn't want to cross" and was someone who had "a bad temper." He oversaw a large drug operation and was a known meth user.

    In several instances he had gone out of his way to send a "message" to those who were thinking of crossing him.

    "I think like a lot of meth users, they get paranoid," Bobby Mims, Clark's defense attorney would later say.

    He described Clark's personality as that of three different people.

    "He was very funny, actually could have been a standup comedian. But his record indicts he's a very dangerous individual."

    In his final appeal to the courts, a dark picture of Clark's troubled childhood was painted.

    "Clark was born with a cleft palate that led to speech difficulties and ridicule by his peers; (his mother) used drugs for most of her adult life and supported her habit through prostitution, resulting in her incarceration for much of Clark's life; Clark's father had "very little to do with" him; Clark cycled between living with different family members during his formative years; while Clark lived with his mother's brother-in-law he was subjected to physical abuse; Clark married at fifteen to avoid being placed in the foster care system; Clark's brother committed suicide when Clark was twenty, and Clark blamed himself because he had had an argument with his brother the night before . . ."

    Mims said, "that is no excuse for what he did."

    DEATH OF CHRISTINA MUSE

    On May 1, 1998 when Christina Muse entered Troy Clark's house she was trying to retrieve money he owed her.

    Muse had knowledge of Clark's drug operation, which worried him. If she were to go to the police it would mean a swarm of officers smashing down his front door and carrying him away to face decades behind bars. Not only that, he would spend those years away from his own children.

    Clark, fearful of this, "stunned Muse with a stun gun to her neck and told her she "should have kept [her] mouth shut."

    According to court records, "when Muse fell to the floor, Clark bound her hands, legs, and mouth with duct tape. Clark then placed Muse in a closet in the second bedroom."

    Tory Gene Bush, who was home at the time said she hear Clark talking to Muse.

    "After "a couple of hours, Clark moved Muse into the bathroom and told Bush to get him a board. Bush complied and returned to the kitchen, shortly after which she heard the loud "whack" of a board striking something.

    "Clark yelled for Bush to come to the bathroom where she found Muse in the bathtub, blood on the back wall of the tub, and Clark filling the tub with water. Clark told Bush to help him hold Muse's head under water and threatened her when she hesitated.

    "After drowning Muse, Clark told Bush to go buy some lime. Bush then went . . . to get a ride to the store.

    "When Bush returned, she took the lime to Clark in the back storage room of the house where she saw Muse's body in a blue barrel filled with cement mix. Clark poured the lime into the barrel, mixed in water, and put a lid on the barrel.

    "The next morning, Clark woke Bush and instructed her to clean up the backyard and to put some debris and garbage in the barrel over Muse's body. When Ben Barnett, Mike Coats, and Amber Scoggins arrived later, Clark and the two men loaded the blue barrel in the back of Clark's truck.

    "After the others left, Clark and Bush transported the barrel and other trash to the property of their landlord."

    SEARCH FOR CHRISTINA MUSE

    In May Muse's family became worried when they did not hear from her. They reported her missing to the local authorities who began their search.

    Months would go by with no solid leads or evidence were to point to where Muse might have gone to.

    In the days before her body was discovered, authorities would bring Troy Clark and Tory Gene Bush in for questioning.

    Witnesses told authorities they had seen Muse enter the couple's house and had seen her truck parked in their driveway the day she went missing.

    In an interview with police, both denied knowing anything about Muse's whereabouts. Authorities then confronted them with the rumor that had been swirling around the community at the time. That Muse had been murdered at their house.

    Both heavily denied the allegations.

    Bush screamed at authorities, "I didn't do anything to her, I don't know anything."

    Clark said, "When you guys find a body, I don't know nothing."

    Tory Gene Bush would later lead investigators to a privately owned patch of land just west of Tyler Pounds Regional Airport.

    Once at the scene investigators notice a strong, distinct odor coming from a large pile of trash. Equipment was brought in to dig into a small mound of dirt where authorities found a barrel.

    Inside was not the body Muse, but rather Tracy Mize. "We took the lid off and observed the body of what appeared to be a white male floating in about three feet of water," sheriffs deputies would tell KETK crews at the scene.

    "It's as bad as I've seen in nearly 25 years. The body was very badly decomposed."

    Mize was a known associate of Clarks, and had helped him in his drug operation. Claims even circulated that he had helped Clark dispose of Muse's body.

    Mize had recently been arrested for an unrelated drug charge. He was days away from revealing the large drug operation Clark ran when he went missing. He was shot five times and dumped into a barrel which was buried near Muse.

    Though Clark was never tried and found guilty of his death, court documents show Clark was charged in his murder.

    Five days after finding Mize's body, Christina Muse's body was found nearby.

    Both Clark and Bush were arrested and charged.

    TRIAL OF TROY CLARK

    Troy Clark would stand trial for Muse's murder in 2000. The state's case and evidence was strong against Clark. Not only did they have a large number of people who were willing to testify against Clark's character, they had made a deal with Tory Gene Bush to testify in Clark's role in Muse's murder.

    "We had nothing," Mims would later tell KETK.

    He explained that his mission was to do anything he could to help Clark avoid the death penalty. "We did everything we could for Troy. . . We had family members who were there for the state. Willing to testify for him to get the death penalty."

    Clark would be found guilty of murder.

    During the sentencing phase he went against his council's advice and took the stand in his own defense.

    While addressing the jury Clark told them to give him the death penalty. "I mean if you turn to them and ask for the death penalty that's probably what you're going to get," Mims told reporters.

    The jury listened, and in March of 2000 they would sentence him to died.

    18 years later Clark still claims he's innocent and that the true mastermind behind it all was Tory Gene Bush.

    Mims, who continues to practice law said he feels, "If Clark hadn't taken the stand, maybe we might have avoided the death penalty . . . I hope he has made his peace."

    Clark will be executed on Wednesday 26, 2018 in Huntsville, Texas.

    Months before his execution Clark wrote a poem titled " The Fate." In it, he continues to stand by his innocence and insists that Tory Gene Bush was the mastermind behind everything.
