    Multi-state kidnapping, carjacking led to murder of Mary Ann Elvington, authorities say

    MYRTLE BEACH, S.C. (WBTW) — A Marion man has been charged with murder in a multi-state kidnapping and carjacking that left one woman dead.

    Doninique Devonah Brand, 29, of Marion, was charged in a three-count indictment with kidnapping resulting in death, carjacking resulting in death, and use of a firearm in furtherance of a crime of violence resulting in death of a person in such a manner to constitute murder.

    Brand allegedly held 80-year-old Mary Ann Elvington at gunpoint in her car, according to warrants obtained by News13. The warrants also show that Brand had a shotgun and ultimately shot her, causing her death.

    The indictment alleges that around March 28, Brand entered the home of Elvington in Nichols and kidnapped her. The indictment further alleges that Brand forced Elvington to drive him in her 2012 Buick Lacrosse to Lake Waccamaw, North Carolina, and then back to Lakeview, South Carolina.

    Elvington was reported missing March 28 after she was last seen at her home on Highway 76 in Nichols, according to Horry County police. Her 2012 Buick LaCrosse was found unoccupied on Bobby L. Davis Boulevard in Marion County Monday evening.

    Elvington’s body was found on Zion Road near Zion Grocery, according to Marion County Coroner Jerry Richardson. That’s about 10 miles from where her vehicle was found, according to previous reporting.

    Suspect in kidnapping, murder of Horry Co. woman pleads not guilty

    HORRY COUNTY, S.C. (WPDE) — A man charged in the kidnapping and murder of an 80-year-old Horry County woman appeared in federal court on Wednesday.

    Two weeks ago a federal grand jury indicted Dominique Devonah Brand, 29, of Marion, on charges in connection with Elvington's death.

    During the federal court hearing, he waived the reading of the indictment, bond, and his detention hearing.

    Brand also plead not guilty to the indictment charges of Mary Ann Elvington.

    He was charged in a three-count indictment with kidnapping resulting in death, carjacking resulting in death, and use of a firearm in furtherance of a crime of violence resulting in death of a person in such a manner to constitute murder, the release states.

    He will remain in federal custody for the time being.

    He had 2 lawyers at the hearing and can request at a later date if they will file a motion for another bond hearing.

    An indictment alleges Mary Ann Elvington was kidnapped from her home on March 28 and forced Elvington to drive him in her 2012 Buick Lacrosse to Lake Waccamaw, N.C., and then back to Lakeview, S.C. Brand then forced Elvington into the back seat of the vehicle and he drove away with her in it. It is alleged that, shortly thereafter, he shot and killed Elvington behind an abandoned grocery store at the Zion Crossroads in Marion County.

    Prosecutors said Brand could receive a sentence of up to life without the possibility of parole or death on all counts.

    He still faces state charges of murder and kidnapping.

    Defense for man accused of kidnapping, killing Nichols woman wants death penalty off the table

    NICHOLS, S.C. (WBTW) — The defense team for a man accused of kidnapping and killing an 80-year-old Nichols woman last year will ask for the trial to not proceed as a capital case, according to court documents filed earlier this month.

    Dominique Brand, of Marion, is charged with holding Mary Ann Elvington at gunpoint in her car, making her drive to North Carolina and then Lakeview, and then shooting her with a shotgun behind an abandoned grocery store in Marion County.

    He faces charges of kidnapping resulting in death, carjacking resulting in death and the use of a firearm in furtherance of a crime of violence resulting in the death of a person in such a manner as to constitute murder. The crime is eligible for the death penalty.

    The request to take the death penalty off the table is included in a motion for continuance, which states that “counsel believes they cannot effectively advise Defendant on the case until after they meet with the Capital Case Section and obtain a determination on the authorization of this case.”

    A failure to approve the postponement would “result in a miscarriage of justice,” according to the documents. The defense has spoken to Brand about the decision, and he has waived his Speedy Trial Act rights.

    In the documents, the defense asked to be excused from the Feb. 22 pretrial conference. Its meeting with the Capital Case Section of the Department of Justice is scheduled for March 7. During the meeting, the defense plans to ask for the case to proceed as a non-capital criminal case.

    Marion man requests bench trial in death of 80-year-old Horry Co. woman

    MARION, S.C. (WPDE) — Federal documents in the case of Dominique Brand, who's charged in the murder of 8-year-old Mary Ann Elvington last March, said he's requested a bench trial and it's set to start on Sept. 7.

    A pre-trial conference will take place on Sept. 1 to review any motions or new filings in the case.

    A federal grand jury indicted Brand last April on charges in connection with Elvington's death.

    He was charged in a three-count indictment with kidnapping resulting in death, carjacking resulting in death, and use of a firearm in furtherance of a crime of violence resulting in the death of a person in such a manner to constitute murder, the release stated.

    He's been in federal custody without bond since his arrest last March.

    An indictment alleges Mary Ann Elvington was kidnapped from her home in the Nichols area of Horry County on March 28, 2021, and forced Elvington to drive him in her 2012 Buick Lacrosse to Lake Waccamaw, N.C., and then back to Lakeview, S.C.

    Officials said Brand then drove the vehicle to a wooded area behind a nightclub in Marion and abandoned it.

    Federal court documents filed in February state that the case is a "death-eligible case which is in the pre-authorization stage."

    The documents showed that a meeting happened in March with the "Capital Case Section of the Department of Justice.

    According to the U.S. Department of Justice:

    The Capital Case Section (CCS) within the Criminal Division was created in response to the Department's "increased involvement in capital litigation and charged with overseeing the Department's capital prosecutions.

    The purpose of the CCS is to "promote consistency and fairness in the application of the death penalty throughout the United States and to ensure that Federal prosecutors in districts throughout the country who are prosecuting capital cases have access to the expertise and resources available through the CCS attorneys and support staff.


    Brand's attorneys were expected to present their case to the prosecution during that meeting and asked that it proceed as a "non-capital criminal case," according to documents.

    His lawyers said they can't effectively advise Brand on the case until they meet with the Capital Case Section and obtain a determination on the authorization of this case, or whether the feds will seek the death penalty against Brand.

    He still faces state charges of murder and kidnapping.

    Marion Man Convicted after Trial on Federal Kidnapping, Carjacking, and Murder Charges

    Dominique Brand faces Life Imprisonment for the Palm Sunday 2021 Murder of Mary Ann Elvington

    FLORENCE, SOUTH CAROLINA — Dominique Devonah Brand, 30, of Marion, was convicted following a multi-day bench trial on all three counts charged: Kidnapping Resulting in Death, Carjacking Resulting in Death, and Using or Carrying a Firearm During and in Relation to a Crime of Violence in a Manner Constituting Murder.

    Evidence presented by the Government at trial established that on Sunday, March 28, 2021, Brand entered Mary Ann Elvington’s home in Nichols, South Carolina. While inside the house, he fired a 12-gauge shotgun into the hallway floor at close range. Mr. Brand’s DNA was later found on multiple items inside Ms. Elvington’s home, including the spent, 12-gauge shotgun shell he fired, a pizza slice he apparently ate from while there, a water bottle he drank from, and a jewelry box he touched. Across the street from Ms. Elvington’s home, investigators found Mr. Brand’s blood and touch DNA inside a stolen church van that was stuck in the mud.

    At about 6:11 p.m. that Sunday, Brand forced Ms. Elvington to drive him from her house to Lake Waccamaw, North Carolina, and back into South Carolina. During this trip, Mr. Brand sat behind Ms. Elvington with the shotgun. Ms. Elvington’s cell site location information showed her car was initially headed back toward her home in Nichols. But in Lake View, South Carolina, surveillance video from the Lake View Police Department captured Brand directing Ms. Elvington into the back seat of her car, moving a gun to the front seat, getting in the driver’s seat, and making a U-turn, heading away from Ms. Elvington’s home. The surveillance video showed Brand was alone with Ms. Elvington—carrying a gun—shortly before she was murdered. After leaving Lake View, Brand drove Ms. Elvington to a remote crossroads in Marion County and walked her behind the abandoned Zion Grocery store. He held the shotgun to the back of her head and pulled the trigger, executing her.

    Brand then drove Ms. Elvington’s car to Marion, where he hid it behind an abandoned club. Investigators found Brand’s blood on a wooden block sitting in the driver’s seat and on a fuse puller on the ground outside the car. Ms. Elvington’s body was located the following evening, March 29, 2021. After learning he was a suspect, Brand turned himself in to authorities on March 31, 2021.

    United States District Judge Sherri A. Lydon presided over the trial and will sentence Brand after receiving and reviewing a pre-sentence report that will be prepared by the United States Probation Office. Brand faces a penalty of life imprisonment on each count

    The case was investigated by the Federal Bureau of Investigation (FBI) with significant assistance from the South Carolina Law Enforcement Division (SLED), Horry County Police Department, Marion County Sheriff’s Office, Marion Police Department, Lake View

    Police Department, and Nichols Police Department. Assistant U.S. Attorneys Everett McMillian and Katie Stoughton prosecuted the case along with Special Assistant U.S. Attorney Scott Hixson, who also serves as the Deputy Solicitor for the 15th Judicial Circuit.

    Dominique Brand sentenced to life in prison for killing 80-year-old Nichols woman in 2021

    FLORENCE COUNTY, S.C. (WBTW) — A man convicted of killing an 80-year-old Nichols woman in March 2021 was sentenced Thursday to life in prison by a federal judge in Florence.

    Dominique Brand will serve 120 months consecutively. He was found guilty on all counts in September in the killing of retired school teacher Mary Ann Elvington.

    Brand killed Elvington after kidnapping her from her home in Nichols and holding her at gunpoint in her car and forcing her to drive to North Carolina. That led to the case being prosecuted in federal court.

    Everett McMillian, Assistant U.S. Attorney, said Brand now gets to pay for his crimes.

    “You can choose your sentence, but you can’t choose your consequences,” McMillian said. “But I think it just goes to show that in this case, Mr. Brand got to make certain choices but today, those choices had consequences. And the consequences are he’s going to spend his life in prison.”

    15th Circuit Solicitor Jimmy Richardson said the case served as a good example on the importance of federal and state agencies maintaining good relationships.

    “The truly horrific nature of this case demonstrates how important developing our solid partnerships with other state and federal agencies is in solving crimes and holding those who commit them responsible to account for their actions,” Richardson said in a news release.

    Marion County Sheriff Brian Wallace talked about how what happened to Elvington was personal for him.

    “The kidnapping and subsequent murder of Mary Ann Elvington rocked not only our community, but my department. When you work where you live, it is difficult to avoid cases in which you personally know the families you serve,” Wallace said in the release. “We pray that today’s sentencing will bring much-needed closure to the Elvington family and open the door for healing for all of us.”

    Prosecutors said Brand later returned to South Carolina with Elvington and shot and killed her with a shotgun behind an abandoned grocery store at the Zion Crossroad in Marion County. He then took Elvington’s 2012 Buick LaCross and abandoned it in a wooded area behind a nightclub in Marion.

    Brand later turned himself in to authorities in Marion County.
