Murderer Accused in Cross-Country Killing Spree Sentenced to Death

AUSTIN, Texas — A man accused in a cross-country killing spree was sentenced to death Thursday for the murder of two Texas teenage girls.

Jurors agreed that Paul Devoe should not be imprisoned for life because he would continue to present a threat to society even from behind bars. The same jury convicted Devoe on Friday of capital murder for the 2007 deaths of 15-year-old Haylie Faulkner and Danielle Hensley, 17. He also is accused of murdering four other people.

Devoe watched quietly, but did not react, as the judge read the verdict.

Robert Faulkner, Haylie's grandfather, was among family members allowed to address Devoe after sentencing in Travis County.

"The day you are executed we will be there to see justice done for our children and we fill find peace in the fact that you will never hurt anyone again," he said. "May the state of Texas show no mercy on you and may you burn in hell."

Prosecutors argued for the death penalty all along, saying Devoe's violent nature shows he would be a danger to prison employees and other inmates.

"The evidence is overwhelming; he has a lifetime of hurting people, threatening them," prosecutor Dayna Blazey said during closing arguments.

Devoe's defense attorneys argued that Devoe does not have a history of disciplinary problems while incarcerated. He has a lengthy criminal record and has spent his adult life in and out of jail.

"He's going to answer to God for what he did, for the crimes he did," defense attorney Tom Weber said, adding that the issue always was whether Devoe deserved to die.

The burden was on the state to prove "beyond a reasonable doubt that he will commit acts of violence ... that's their burden that they have to do that," Weber told the jury. "I would submit to you that they failed to do that."

Devoe is also accused of fatally shooting 41-year-old Michael Allred at a bar where he worked in Marble Falls. Prosecutors say he then drove to the home of ex-girlfriend Paula Griffith in Jonestown and shot her, her 48-year-old boyfriend, Jay Feltner, her daughter, Haylie Faulkner and Danielle Hensley, a 17-year-old friend of Haylie's.

Prosecutors say after the killings, Devoe fled Texas for Long Island, N.Y., where he grew up and where his mother lived. They say he had car trouble near State Line, Pa., then shot and killed 81-year-old widow Betty Jane Dehart and stole her car.

Prosecutors can still seek trials for the other four deaths.

Danielle's mother and stepfather wept as prosecutor Gary Cobb showed photos of each victim before their deaths, followed by photos from the crime scene. Devoe's family also wept as lawyers recounted his childhood and violent past.

Death penalty upheld on man charged in Pa. woman's death

Texas' highest criminal court on Wednesday upheld the conviction of a man condemned for killing two teenage girls as part of a cross-country murder spree four years ago that left six people dead, five in Texas and another in Franklin County, Pa.

Lawyers for 48-year-old Paul Devoe raised nine points of error from his trial in 2009 in Austin, including claims of insufficient evidence, improper jury selection and jury instructions and improper conduct by trial prosecutors.

The Texas Court of Criminal Appeals rejected each of the claims. Devoe does not have an execution date. He can take his case to the federal courts and can return to the state courts for additional review.

"I'm disappointed to hear his death sentence has been affirmed but there's a number of avenues for relief that he still has yet to explore," Karyl Krug, who filed the appeal for Devoe, said. "So I'm still hopeful that he'll get some kind of relief."

Devoe was arrested in August 2007 after a short standoff with police in Shirley, N.Y., where he grew up and where his mother lived, three days after four people were killed at a home in a rural area near the northern end of Lake Travis, outside Austin. He also was accused of killing a bartender in Marble Falls, northwest of Austin, and 81-year-old Betty Jane Dehart in Greencastle, Pa., whose car he stole en route to New York.

Devoe specifically was convicted of capital murder for the deaths of Haylie Faulkner, 15, and a friend, Danielle Hensley, 17. Faulkner was the daughter of his ex-girlfriend, Paula Griffith, 46, who also was killed along with her boyfriend, Jay Feltner, 48.

Evidence showed they were shot at Griffith's home after he tried to kill another former girlfriend, Glenda Purcell, at a bar. The bartender there, Michael Allred, 41, was fatally shot as he stepped between Purcell and Devoe. The gun then jammed as he tried to shoot Purcell and he fled.

Police were alerted by Hensley's parents after they were unable to reach her by phone. She was with Faulkner for a planned trip to a San Antonio amusement park.

Evidence showed Devoe had a lengthy criminal history and long history of abusing women.

He was jailed in Suffolk County, N.Y., more than 20 times between 1980 and 2004 and spent five years in a New York state prison. His mother once obtained a protective order against him after he tried to strangle her with a telephone cord.

Devoe told a psychiatrist that on the day of the Texas shootings, he smoked methamphetamine and drank a liter of rum. He described the shooting of Allred as an accident, said he shot Feltner in self-defense and said he killed Griffith, the teens and Betty Jane Dehart, a widow whose car he took from her home in Greencastle, Pa., because they were screaming. Evidence showed he left Texas in Griffith's car, which began having mechanical problems as he reached Greencastle.

The blood of Feltner and Allred was found on his boots. Ballistics evidence showed all the victims were killed with the same .380-caliber pistol. Police recovered a box of 100 bullets from a bag inside the car he was driving.

Devoe has not been tried in the four other slayings.

The Texas Court of Criminal Appeals has rejected the appeal of a man condemned for killing two teens in Travis County during a 2007 crime spree blamed for six deaths. The state's highest criminal court Wednesday rejected appeals for Paul Devoe. Devoe was arrested in Shirley, N.Y., where he grew up, several days after four people were slain in Jonestown, near Austin. Devoe was condemned for killing 15-year-old Haylie Faulkner and 17-year-old Danielle Hensley. Faulkner was the daughter of Devoe's ex-girlfriend, Paula Griffith, who also was slain along with her boyfriend, Jay Feltner. Devoe was also accused of killing bartender Michael Allred. Prosecutors say Devoe was bound for New York, had car trouble near State Line, Pa., then killed 81-year-old Betty Jane Dehart and stole her vehicle.
