    Summary of Offense:

    When Beverly Guenther got off work on November 20, 2003, she was attacked on her employer's parking lot in Earth City, a light industrial area across the Missouri River from St. Charles. Her assailant stabbed her, raped her, and took her body that night to a wooded area off South Broadway in St. Louis, near Bellerive Park. Before her death, Guenther, 45, of Moscow Mills, Missouri, had filed written statements of domestic violence in Lincoln County against a former boyfriend with whom she had broken up that summer. She wrote that she had been repeatedly harassed by phone and in person by Scott McLaughlin, and at one point, she said, he had jumped out of bushes at her on the Earth City lot.

    A hearing on her domestic violence allegations had been set for November 21, 2003, the morning after her disappeance. On the night she disappeared, a worried neighbor at her mobile home park called her boss, who called police and they found Guenther's pickup truck on the parking lot where she worked, along with a trail of blood. Guenther was already dead when her killer raped her, an autopsy showed. McLaughlin, of Wright City, admitted the murder in audiotaped and videotaped statements to police but never admitted the sexual assault on either an alive or dead victim. He led police to her corpse after his confessions.

    Man convicted in stabbing death will ask judge to reconsider sentence

    A man convicted of stabbing his former girlfriend to death will be back in St. Louis County Circuit Court this morning to ask the judge who sentenced him to death to reconsider.

    A hearing is set to begin at 9 a.m. Monday in Judge Steven H. Goldman's courtroom.

    Scott McLaughlin, of Wright City, was accused of abducting Beverly Guenther, 45, of Moscow Mills, from her workplace in Earth City and killing her in November 2003. In 2006, jurors convicted McLaughlin of first-degree murder, rape and armed criminal action in the guilt phase of his trial but could not agree on punishment. Goldman ordered the capital sentence a month later.

    Attorneys who filed McLaughlin’s appeal are asking Goldman to reconsider the sentence, claiming their client received ineffective assistance of counsel during the penalty phase of the trial. In their motion, McLaughlin’s new attorneys argue that his trial lawyers should have called a psychiatrist and neuropsychologist who would have testified about McLaughlin’s brain damage.

    Attorneys also want Goldman to review new DNA evidence and testimony that may link someone else to the crime.

    Condemned man has disorders

    Two mental health experts testified Tuesday that a man sentenced to death for murdering his ex-girlfriend suffered from developmental disorders and other mental problems.

    Testimony came during a hearing in which attorneys for Scott McLaughlin, of Wright City, are asking St. Louis County Circuit Judge Steven Goldman to reconsider the death sentence.

    McLaughlin was convicted of abducting Beverly Guenther, 45, of Moscow Mills, from her workplace in Earth City and killing her in November 2003.

    A neuropsychologist told the judge that McLaughlin may have suffered from a brain injury when he was a child.

    A psychiatrist testified that he diagnosed McLaughlin with borderline personality disorder, among other disorders.

    The experts' findings were similar to those of four mental health professionals who testified during the penalty phase of McLaughlin's trial in 2006, the judge noted. The hearing was to continue today.

    Mo. court rejects appeals of 2 death row inmates

    The state Supreme Court rejected the appeals Tuesday of two death row inmates from eastern Missouri who had claimed their attorneys provided ineffective aid during their murder trials.

    The court issued unanimous decisions upholding the convictions and death sentences for Carman Deck and Scott McLaughlin.

    Deck was convicted of the fatal shootings of James and Zelma Long during a robbery of their home near De Soto in 1996. His two death sentences were twice overturned, most recently by the U.S. Supreme Court in 2005 because he had been shackled in the presence of jurors. But at a third re-sentencing hearing, Deck again received two death sentences, which were upheld by the state Supreme Court in January 2010.

    In his latest appeal, Deck argued that his attorney erred in a variety of ways, including by not calling additional mitigating witnesses to testify about his troubled childhood and by failing to conduct neuropsychological testing on him.

    McLaughlin was convicted of raping and fatally stabbing his former girlfriend, Beverly Guenther, in St. Louis County in 2003. He was sentenced to death by a judge after jurors agreed he had acted with the necessary depravity of mind to be executed but deadlocked on whether that was trumped by other mitigating factors. The state Supreme Court upheld his death sentence in 2008.

    In his latest appeal, McLaughlin argued that the judge who sentenced him to death should have been disqualified from presiding over his subsequent claims that his trial attorney was ineffective. Among other things, McLaughlin claimed his attorney should have presented evidence about his mental health and neuropsychological impairments as mitigating evidence in the penalty phase.

    Probably the state could appeal the decision, and if upheld then yes he would no longer be under a death sentence. The state would then either have to retry the sentencing phase or give him a lesser sentence.
