One of the men accused in Columbus double murder of teens make Recorder’s Court appearance

    By Chuck Williams
    WRBL News

COLUMBUS, Ga. (WRBL) — A Thursday afternoon Record’s Court hearing turned emotional when the mother of a shooting victim erupted as one of the men accused of shooting her son stood just feet away from her.

The teen’s mother told Judge Julius Hunter, along with everyone attending the hearing that she wanted Terrance Upshaw to remember her face.

The woman is the mother of one of the two victims who survived a shooting on June 14, 2020, that left two others dead.

Terrance Upshaw, 29, and Homer Eugene Upshaw, 26, both of Columbus, Georgia, each face charges of murder, aggravated assault and possession of a firearm or knife during the gang activity charges, according to Muscogee County Jail records.

Homer Upshaw is being represented by William Kendrick and Terrance Upshaw is being represented by Stacey Jackson

District attorney Mark Jones told News 3 after the hearing he plans to seek the death penalty against the two brothers.

“Me personally, I have already talked to the family. We will be seeking the death penalty because it was a double homicide. That’s it. Sick of the gun violence,” said District Attorney Mark Jones.

Terrance Upshaw, 29, and Homer Eugene Upshaw, 26, both of Columbus, Georgia, each face charges of murder, aggravated assault and possession of a firearm or knife during the gang activity charges, according to Muscogee County Jail records.

Homer Upshaw was also charged with drug trafficking.

“Obviously, that’s a decision that the district attorney has to make that we have no control over,” Jackson said after the hearing. “There’s a certain amount of days and protocols and filings that the district attorney would have to make in obviously seeking the death penalty. We will just have to wait until the case is indicted and arraigned and see if those motions are filed.”

Homer Upshaw did not appear in court. He is being quarantined in the jail, his attorney told the court. Homer Upshaw’s Recorder’s Court hearing was delayed until a later date.

Neither of the suspects nor the two victims were Wilson Apartments residents, a Housing Authority spokesperson told News 3.

Alleged gang members face trial for barrage of gunfire that killed two Columbus teens

    By Tim Chitwood
    Ledger-Enquirer

Three alleged gang members accused of killing two teenagers in a barrage of gunfire unleashed on a car are headed to trial this month in Columbus.

The evidence includes video surveillance that shows them deploy for an ambush, police said. That video will show suspects emerging from a house in the 3100 block of 32nd Street, taking positions and firing more than 50 shots at a Dodge Dart, hitting four people and killing two.

Saiveon Pugh, 18, and Jessie Ransom, 17, died from their wounds: Ransom was dead at the scene. Pugh died in the hospital three hours later. A 19-year-old and a juvenile hit in the car were treated and released, police said. That was on June 14, 2021.

The double-murder case authorities have linked to a street gang now is set for trial Oct. 30.

The three defendants were in Muscogee Superior Court with their defense attorneys Tuesday for a pretrial hearing on multiple felony charges, many alleging gang activity.

Two are brothers, Terrance Upshaw, 31, represented by Shevon Thomas II, and Homer Eugene Upshaw, 28, represented by William Kendrick. The third suspect is Rodderick Quaterrius Glanton, 28. His attorney is Allen C. Jones.

A 21-count indictment charges all three with murder, aggravated assault, criminal damage to property, possessing guns while committing felonies, and violating Georgia’s Street Gang Terrorism and Prevention Act.

Homer Upshaw has additional weapons and drug trafficking charges because of a prior felony conviction, and because police said he had 10 pounds of marijuana when they arrested him July 26, 2021.

    THE GANG UNIT

The trio’s being prosecuted by the state attorney general’s gang unit, which alleges they’re members of the Marlow Gang, “a local hybrid street gang” associated with the more powerful US World, which began operating in Columbus in 2019.

US World is affiliated with national gangs such as the Gangster Disciples and Crips, the attorney general said.

The prosecutors, Cara Convery and McKenzie Gray, are with a special gang unit Attorney General Chris Carr established in July 2022 with $1.3 million in funding from the state legislature.

Had they not taken the case, another prosecutor likely would have been appointed, as Columbus District Attorney Stacey Jackson in private practice represented Terrance Upshaw at his July 29, 2021, preliminary hearing in Columbus Recorder’s Court.

Gov. Brian Kemp appointed Jackson district attorney in May 2022, creating a likely conflict of interest in the case.

    THE EVIDENCE

It was during a July 2021 court hearing that Detective Kyle Tuggle testified to the video evidence police recovered.

He said footage from a residence in the 3100 block of Seventh Avenue showed the suspects “rush out” of the residence before “taking position” as a Dodge Dart drove toward them, then firing at it.

Police got multiple calls to a shooting at the intersection of 32nd Street and Seventh Avenue, and found the four gunshot victims near Building 316 of Wilson Apartments, at 3400 Eighth Ave.

Besides murder charges for the deaths of Pugh and Ransom, the three suspects face aggravated assault counts for the victims who survived.

Prosecutor McKenzie Gray questioned Tuggle at Tuesday’s hearing, where he testified that Glanton upon his arrest agreed to speak with detectives after waiving his rights, but that Terrance Hill would not talk with police.

Gray also called William Peterson, a former detective now with the Muscogee sheriff’s office, who said that like Glanton, Homer Upshaw also waived his rights and spoke to investigators.

Judge Gil McBride ruled the police interviews with Glanton and Homer Upshaw will be admitted as trial evidence. He scheduled a followup hearing for Tuesday on other motions.

Jurors render verdicts for each of three defendants in Columbus gang murder trial

    By Tim Chitwood
    Ledger-Enquirer

The jury has reached verdicts in the trial of three alleged gangsters accused of killing two Columbus teenagers and wounding two more during a 2021 gang war.

The jury of eight men and four women found Homer Upshaw, 28; his brother Terrance Upshaw, 31; and Rodderick Glanton, 28; guilty on all charges.

They were accused of acting in the interest of the Marlow street gang when they opened fire on a Dodge Dart at Seventh Avenue and 32nd Street on June 14, 2021, killing driver Jesse Ransom, 17, and back seat passenger Saiveon Pugh, 18, and wounding Ta’Journey Lee. 16, and Wandray Harris, 19.

Police said the four teens were members of the Zohannon street gang, and defense attorneys claimed the victims had targeted their clients for a drive-by shooting, so the suspects shot first in self-defense.

The jury did not accept that argument.

Ransom’s mother Chimere Ransom was in the courtroom as a clerk read the guilty verdicts. She had sat through the entire trial, which started Oct. 30.

“It was very draining, and tiring, but at the same time it’s still sad: I never wished bad on nobody, despite of what happened to my son and his friends, or how the lawyers may have even labeled them,” she told reporters afterward.

She was unfamiliar with gang culture, before the trial, she said.

“I don’t really know anything about gangs, but I am aware of the Zohannon gang,” she said. “The only thing I didn’t like in that case is how they denied that Terrance, Homer and Glanton were part of gangs, and they were. They just made it seem like Jesse, Savo, Wandray and Ta’Journey Lee were the only ones affiliated with gangs, and how they just go through half the trial calling them gang members, thugs and this and that.”

That sometimes got to her, she said: “I’m just glad it’s over with.”

She hopes other mothers will be spared what she has endured, she said, of the defendants adding, “It’s still sad on both ends. They just threw their whole lives away.”

She still misses her son, she said: “He’s silly, real silly and goofy.” She remembers his laugh, his smile, and all their talks together, she said.

“This is something I have to live with for the rest of my life, because I lost a child,” she said. “A part of me is gone. That’s something that can’t be swept under the rug.... And then with the trial, it’s like I’m reliving it all over again from day one.”

Her advice to others is “leave the gangs alone, leave the guns alone, do right, go to school and graduate, get a job, go to the military, do something..... You don’t want to put somebody through this.”

Judge Gil McBride set the three men’s sentencings for 1:30 p.m. Nov. 29. They face life in prison.

Here are the charges on which they were convicted:

Glanton and Terrance Upshaw were found guilty on seven counts of violating the state Street Gang Terrorism and Prevention Act; two counts of malice or deliberate murder; two counts of felony murder; four counts of aggravated assault; three counts of first-degree criminal damage to property; and one count of using a gun to commit a felony.

Homer Upshaw, was found guilty on eight counts of violating the state Street Gang Terrorism and Prevention Act; two counts of malice or deliberate murder; four counts of felony murder; four counts of aggravated assault; three counts of first-degree criminal damage to property; and one count each of using a gun to commit a felony, of being a convicted felon with a firearm, and of trafficking marijuana.

    The Evidence

The shooting happened outside a house across the road from Wilson Homes apartments, a complex police described as a 20-building housing area at 3400 Eighth Ave.

The suspects were in a single-family home in the 3100 block of Seventh Avenue, which prosecutors called a “trap house” where the men sold drugs.

Wilson Homes “has cameras all over it,” a police officer testified, and they recorded the teens’ Dodge Dart pass the house five times, before it crashed into a parked car after flashes of gunfire from outside the house.

The video was not close or clear enough to recognize faces, but it showed bystanders walk to and from the wrecked car, some reaching inside, before police arrived.

The first officer to find the shot-up Dodge said a woman was standing nearby, staring at it. “They’re all dead,” she told him.

Though about 60 bullets were fired at the car, only two or three shots were fatal.

Those bullets came from the same gun, a rifle that left 27 cartridge casings at the shooting scene, all from 7.62-millimeter rounds, according to state firearms expert Catherine Jordan.

Prosecutors said Glanton fired that rifle from the front steps of the Seventh Avenue house the suspects came from.

Homer Upshaw shot a .223-caliber rifle at the car, and Terrance Upshaw fired a 9-millimeter pistol at it, prosecutors said.

Lead prosecutor Cara Convery said no shots were fired from the teens’ car, though they had at least two guns inside.

Pugh was found in the back seat with a .22-caliber rifle in his lap, and Lee, the front-seat passenger, admitted having a 9-millimeter pistol that was never found.

Defense attorneys claimed bystanders walking to and from the car after the shooting likely removed other firearms.

Homer Upshaw was represented by William Kendrick; Terrance Upshaw by Shevon Thomas II; and Glanton by Allen C. Jones.

The shooting was part of a spate of gun violence that erupted in Columbus in 2021 as the Zohannons went to war with a gang called US World, authorities said. The Marlow gang was allied with US World.

The Marlows were a local, hybrid gang that included individuals from larger street gangs. Convery said Glanton was a Gangster Disciple, and Terrance Upshaw was a Crip.

A gang expert said the Marlows had two predecessor gangs based at Wilson Homes: the 5150 Taliban, known for wearing camouflage, and the Lime Green Money Gang, which used lime green as its signature color.

The name “Marlow” comes from the TV crime drama “The Wire,” in which the character Marlo Stanfield is an ex-drug kingpin and killer, the expert said.

Wilson Apartments double murder defendants get life sentences

    By Cristina Feliciano
    WRBL News

COLUMBUS, Ga. (WRBL) — Three men found guilty in a high-profile Columbus murder and gang trial, returned to the courtroom Wednesday afternoon to be sentenced.

Roderick Glanton and Terrance Upshaw were sentenced to life in prison with the possibility of parole, plus 25 years to be served consecutively. Homer Upshaw was sentenced to life without the possibility of parole, plus 25 years to be served consecutively.

Superior Court Judge Gil McBride says he did not come to the decision lightly, but due to Homer Upshaw’s prior history, McBride believes that any rehabilitation that can be expected of Homer Upshaw, must be done in a confined and secure environment.

Their sentences resulted from the deadly 2021 Wilson Apartment shooting that claimed the lives of Saiveon Pugh, 18, and Jesse Ransom, 17.

Just before the men were sentenced, Judge McBride recalled a witness’s testimony describing the shooting. The witness said her toddlers ran for cover when their home was struck with bullets. McBride says what took place on June 14, 2021 should never be acceptable.

As I thought through this evidence, and note that Columbus can and should do much better than this. That should not be the norm in that community. That children know what to do when bullets start flying into their home. That babies know what to do when the bullets start flying through their home.

    - GIL MCBRIDE, MUSCOGEE COUNTY SUPERIOR COURT JUDGE

Top gang prosecutor in the state, Cara Convery, recommended Homer Upshaw be sentenced to life without the possibility of parole. Defense attorney William Kendrick, who represents Homer Upshaw, argued the State’s consecutive sentencing recommendation is inappropriate.

Unfortunately, what the jury decided in this case, of course, we respect it, but we do disagree with it. I do believe that the State has done what they wanted to do, and they wanted to turn this case into a political statement case when it came down to gang violence in Columbus and the gang counts helped them to do that.

    - WILLIAM KENDRICK, HOMER UPSHAW’S ATTORNEY

During the trial, the prosecution made its case against the Upshaw brothers and Glanton by putting the city’s gang culture and the violence in the Wilson Apartments at the forefront.

This process has not been about me. It has not been about a political statement. It’s not been about any office locally or regionally. It’s just not about that. This entire process, from my perspective and thankfully for the jurors as well, has been about seeking the truth and getting it right.

    - CARA CONVERY, LEAD PROSECUTOR, GEORGIA ATTORNEY GENERAL’S GANG PROSECUTION UNIT

This is the first case in Muscogee County tried by the Georgia Attorney General’s Gang Prosecution Unit. This unit was established by the General Assembly last year.
