Darnell Hammond and Jim Langston Sentenced in 2016 CA Murders of Heriberto and Juan Luis Aceves

    Lamont double murder trial begins

BAKERSFIELD, Calif. (KGET) — A prosecutor presented his opening statement Monday as a double murder trial began in the “senseless deaths” of a father and son who owned and operated a gas station in Lamont.

Darnell Hammond, 27, and Jim Langston, 45, are charged with two counts of murder and robbery, among other charges, in the slayings of the father and son at Quality Gas in 2016. The District Attorney’s office is seeking death for Hammond and life without parole for Langston.

Jim Langston listens during the prosecution’s opening statement.

Prosecutor Marcus Cuper asked the jury to find both men guilty for the “tragic and senseless deaths” of Heriberto and Juan Aceves.

The attorneys for Langston and Hammond reserved their opening statements until after the prosecution rests.

Darnell Hammond glanced toward a camera as his murder trial began Monday.
Hammond and Langston are accused of entering Quality Gas to rob it then exchanging gunfire with Heriberto Aceves.

Heriberto Aceves, 60, and Juan Luis Aceves, 27, were shot dead. Autopsies revealed Heriberto Aceves was shot 13 times, Juan Aceves four times.

Surveillance footage played for the jury shows three men wearing masks, two of them armed with guns, enter the business the morning of Oct. 14, 2016. Juan Aceves is forced behind the counter by two of the men while the third holds Heriberto at gunpoint.

The men grab items behind the counter. One of them then pistol whips Juan Aceves multiple times. Heriberto Aceves is then pistol-whipped on the back of the head and blood drips onto his shirt.

Heriberto pulls a gun and almost immediately falls. He holds the gun up while on his back as one of the masked men fires at him with a handgun. That man then points the gun at Juan Aceves.

The robbers flee the business. One of them briefly returns and goes behind the counter to where the body of Juan Aceves lies, Cuper said. He leaves again, carrying cash trays.

Hammond was arrested shortly after the robbery, Langston several days later. DNA testing of items found near the scene helped tie them to the killings, Cuper said.

Langston is seen on surveillance video entering the business about 15 minutes before the robbery occurred. He cashed a payroll check then left.

Both Hammond and Langston are alleged members of the Country Boy Crips criminal street gang. Cuper displayed photographs of tattoos on their bodies saying “Country Boy Crips” and abbreviations related to the gang.

The trial is expected to last about two months.

Two convicted on all counts in Lamont double murder trial

    KGET

BAKERSFIELD, Calif. (KGET) — When the first verdict was read, Darnell Hammond looked toward the ceiling and began to cry. A woman in the audience dropped her head and weeping soon came from her direction.

Any hope Hammond had of being released evaporated as he and co-defendant Jim Langston were found guilty of two counts of murder, robbery and other offenses in the shooting deaths of a father and son who operated a gas station in Lamont.

Additionally, a Kern County jury found the men acted on behalf of the Country Boy Crips street gang. The verdicts were read Tuesday morning before Judge John Oglesby.

The jury will return to court next week to begin the penalty phase for Hammond, 27, who faces the death penalty. Jurors found he fired the fatal shots.

During the penalty phase, jurors will weigh aggravating and mitigating factors and make a recommendation on whether Hammond should be sentenced to death or life without parole.

Langston, 45, is set for sentencing Oct. 20 and faces life in prison. He showed no emotion during the hearing.

Attorneys declined comment until the penalty phase is over. It could last about two weeks.

Heriberto Aceves, 60, and Juan Luis Aceves, 27, were shot dead during the Oct. 14, 2016, robbery at Quality Gas. Autopsies revealed Heriberto Aceves was shot 13 times, Juan Aceves four times.

Surveillance footage played at trial showed masked men entered the store and exchanged fire with Heriberto Aceves. The footage captured the shooting of Aceves and his son.

Hammond was arrested shortly afterward, and DNA evidence linked him and Langston to the crime, prosecutors said.

Langston was seen on surveillance video entering the business about 15 minutes before the robbery occurred. He cashed a payroll check then left.

Three masked men then entered the store, two carrying handguns. They grabbed items and one of them pistol whipped Juan Aceves several times. Heriberto Aceves was then pistol whipped.

Heriberto Aceves pulled a gun and immediately fell, the footage showed. He held the gun up while on his back as a masked man fired multiple shots at him before turning the gun on Juan Aceves.

Authorities said the store may have been targeted because payroll checks were cashed there.

Kern jury recommends life sentence, without the possibility of parole for murder

    The Bakersfield Californian

A Kern County jury recommended a life sentence without the possibility of parole for a man Thursday in connection to a 2016 shooting in a Lamont convenience store, which led to the death of a father and son, according to a Kern County District Attorney’s Office’s news release.

The jury found Darnell Hammond and co-defendant Jim Langston also guilty of two counts of first-degree murder and robbery with a firearm on Sept. 21, among other charges, according to the news release. Langston and Hammond’s sentencing is set for Oct. 20 and Nov. 3, respectively, according to the Kern County Superior Court.

In October 2016, father Heriberto and son Juan Aceves were working in their family’s convenience store in Lamont. Before 10 a.m., three masked men with guns rushed into the business and demanded money, according to the DA’s news release.

Hammond struck Heriberto and Juan with a gun, the news release said. Heriberto pulled out a gun to defend himself and a shooting followed. Heriberto and Juan were shot and killed by Hammond, the DA’s news release said.

Two of the robbers fled the scene while Hammond collected cash, the news release stated. When Hammond left the store, the robbers had left in a getaway car. Hammond ran through a neighborhood and hid in a shed, according to the news release.

He was found by Kern County Sheriff deputies with the money, the news release said. Langston was arrested days later and acknowledged his role as a driver, the DA stated. Hammond and Langston were also members of the Country Boy Crips criminal street gang, the news release stated.

    The Bakersfield Californian

A man convicted of double murder and robbery for a 2016 incident in a Lamont convenience store, which killed a father and son, was sentenced Friday to a life in prison without parole.

Darnell Hammond walked into father Heriberto and son Juan Aceves' convenience store in Lamont and struck both with a gun. Heriberto pulled out a gun to defend himself and Hammond killed both, according to a Kern County District Attorney’s news release.

Hammond then remained in the store and collected the cash, the news release said. The other accomplices, including co-defendant Jim Langston, left Hammond behind.

Kern County Sheriff's Office deputies found Hammond hiding in a shed with the money from the robbery next to him. Langston, who was arrested the next day, acknowledged his role as the getaway driver, the news release said.

The jury found both Hammond and Langston to be members of a criminal street gang, and the murders were committed in the furtherance of gang activity, the DA's office said.
