    Summary of Offense:

    Gustavo Garcia was convicted in the shotgun slaying of Craig Turski, 43, during the robbery of a beverage store. Turski, a store clerk, was shot in the head and right side. Garcia was arrested following a second robbery at a Texaco station. Police found Garcia hiding in the beer cooler and his co-defendant, Christopher Vargas, standing over the station attendant after he had been shot once in the back of the head.

    Garcia was sentenced to death in Collin County in January 1992.

    He was resentenced to death in March 2001.

    In today's orders, the United States Supreme Court declined to review Garcia's petition for certiorari.

    Man convicted twice for '90 Plano slaying, involved in '98 death row escape attempt, loses appeal

    HOUSTON — The U.S. Supreme Court has refused to review the case of a 42-year-old man set to die next month for the slaying of a Plano liquor store clerk.

    The high court, without comment Tuesday, rejected an appeal from Gustavo Garcia, who’s scheduled for lethal injection Feb. 16.

    Garcia was 19 in December 1990 when 43-year-old Craig Turski was fatally shot during a holdup in Plano. Authorities tied him to a second slaying a month later, also in Plano.

    In earlier unsuccessful appeals, Garcia’s attorneys contended his two written confessions improperly were admitted into evidence at his trial, that his trial legal help was deficient and that two prospective jurors improperly were excused.

    Garcia was one of seven inmates involved in an attempted escape from death row in 1998.

    HOUSTON (AP) — The U.S. Supreme Court has refused to reconsider its refusal of the case of a 42-year-old man set to die next week for the slaying of a suburban Dallas liquor store clerk.

    The high court, without comment Wednesday, rejected the request from Gustavo Garcia, who's scheduled for lethal injection Feb. 16.

    Garcia was 18 in December 1990 when 43-year-old Craig Turski was fatally shot during a holdup in Plano. Authorities tied him to a second slaying a month later, also in Plano.

    Garcia's attorneys contended two prospective jurors at his trial improperly were excused. The justices initially refused to review his case last month.
