    ROGERS, Ark. (KNWA/KFTA) — Rogers police have made an arrest in a capital murder case of a two-year-old child.

    According to a news release from the Rogers Police Department, Gustavo Enrique Peraza, 29, was arrested on a warrant for capital murder and first degree battery.

    On Tuesday, August 24, Rogers police were notified by Mercy Hospital in regards to the death of the child.

    Detectives responded and initiated an investigation into the death and the child’s body was sent to the Arkansas State Crime Lab in Little Rock for an autopsy.

    The release says the result of the autopsy showed the child’s death was caused by a blunt force traumatic injury to the child’s abdomen.

    After an investigation, Rogers police arrested Peraza.

    Peraza was booked in the Benton County Jail and is being held for a bond hearing.

    Judge says prosecutors OK to use phone, Google search evidence in murder case involving Rogers man

    BENTONVILLE -- A local circuit judge ruled Friday prosecutors may use the evidence obtained from two cellphones and Google searches against a Rogers man accused of killing a 2-year-old boy.

    Judge Brad Karren made the ruling Friday after listening to testimony at a suppression hearing.

    Gustavo Enrique Peraza, 30, is charged with capital murder and battery. He has pleaded not guilty to the charges.

    Peraza's attorney filed a motion to suppress the searches related to the seizure of the phones and to obtain records of Peraza's Google searches.

    Karren upheld the warrants for the phones and searches.

    He found the searches of the two phones were not unlawful and ruled a police detective acted in good faith and did not act recklessly by putting a redacted statement in an affidavit. Karren found police had probable cause to obtain the warrants.

    Peraza is accused of killing 2-year-old Ryland McDonald.

    Peraza was the boyfriend of Breyana Sawyer, the child's mother, according to court documents. He babysat the boy while Sawyer worked, according to court documents.

    Ryland died Aug. 24, 2021. Police started investigating after being notified of the death by Mercy Hospital.

    Trauma to the stomach injured the boy's intestines, which led to a serious infection that caused his death, according to a probable cause affidavit. A doctor told police the type of injury Ryland suffered is typically caused by a punch or kick to a child's abdomen and is typically inflicted within a week of death, the affidavit states.

    Rick Yager, the lead detective on the case, testified at Friday's hearing about the warrants for Peraza's two cellphones and the warrant related to Peraza's Google searches.

    Yager said Sawyer told him she left her son with Peraza the day he died. She said Peraza texted her to tell her Ryland was ill and he brought her son to her at work.

    Yager said Sawyer immediately knew something was wrong and said her son felt like he didn't have any bones. She took him to the hospital.

    Yager said he obtained a search warrant to obtain Peraza's black iPhone X to collect the messages between Sawyer and him. Yager testified he learned all the text messages between Sawyer and Peraza had been deleted from the phone.

    Police learned Peraza had a second phone when he sent a message asking a woman to do research about parks near ponds, Yager said.

    Yager was not aware at the time Peraza had a second cellphone, he said. The woman asked Peraza for the pass code to his other phone, he said.

    Two other detectives went to see Peraza to obtain the second phone -- a Samsung -- from Peraza, Yager said.

    Yager said some questions to Google on the iPhone concerned polygraphs, whether fingerprints can be found on the stomach of a body, and the time it takes to get autopsy results back. He did not testify about any Google searches on the second phone.

    Police obtained a third warrant to obtain Peraza's entire Google search history. Yager said the searches included statements about bleeding after getting punched in the stomach, a question about autopsy results and whether fingerprints can be obtained from the stomach.

    Peraza is being held in the Benton County Jail with no bond set. His next court appearance is set for Dec. 2.

    Sawyer, 24, is charged with permitting abuse of a child. She has pleaded not guilty to the charge.

    Capital murder trial set for Rogers man accused of killing two-year-old

    BENTON COUNTY, Ark. (KNWA/KFTA) — A trial date has been set for a Rogers man accused of killing a two-year-old child in 2021.

    Gustavo Enrique Peraza, 31, is charged with capital murder and battery in the first degree. Judge Brad Karren in the Benton County circuit court signed an order scheduling the trial for January 29, 2024.

    According to court documents, Peraza was arrested on September 14, 2021, following an investigation by the Rogers Police Department. Peraza was on felony probation at that time following convictions for theft by receiving, fraudulent use of a credit card and failure to appear charges.

    A probable cause sheet filed with the court details the police investigation into the death of the child, referred to as “RM2.” It began on August 24, 2021 after the victim had been seen by the Community Care Clinic in Rogers for vomiting on August 20.

    Those physicians referred RM2 to Arkansas Children’s Hospital after noting “a concern of blunt force trauma to his stomach or some type of cancer.” Investigators determined that he had routinely been in the care of four people, and all of them were interviewed.

    His mother, Breyana Sawyer, told officers that she would take RM2 to meet her boyfriend, the defendant, in Springdale on Mondays when she had to work. When asked if RM2 had suffered any “notable accidents,” she replied that he bruised easily and “always fell while running and ran into things around the house.”

    The prosecution has announced that it is seeking the death penalty. Peraza is being held in the Benton County jail without bond.

    Sawyer is facing charges of permitting child abuse, a class B felony. She told police she refused to believe Peraza did anything to harm her child.

    BENTONVILLE -- A Rogers man had his capital murder trial delayed Thursday in the death of 2-year-old Ryland McDonald in 2021.

    Gustavo Enrique Peraza, 31, has pleaded not guilty to murder and battery.

    His jury trial previously had been scheduled to begin Jan. 29.

    Benton County Circuit Judge Brad Karren granted a request last week from defense attorneys representing Shawna Cash for more time to review documents and interview possible witnesses.

    Cash, 24, of Pine Bluff is accused of killing Pea Ridge police officer Kevin Apple. Prosecutors are seeking the death penalty.

    Her trial was scheduled to begin July 31, but the judge reset the trial to begin Jan. 29, which meant Peraza's case needed a new date.

    Karren scheduled Peraza's trial to begin April 29, but Peraza's defense team had a conflict with the date. The trial is now scheduled to begin Aug. 6, 2024.

    BENTONVILLE -- Benton County Circuit Judge Brad Karren granted permission for a murder suspect to attend his 3-year-old daughter's funeral.

    Gustavo Enrique Peraza, 31, of Rogers has pleaded not guilty to capital murder and battery. He accused in the 2021 death of 2-year-old Ryland McDonald. Peraza is being held without bond in the Benton County Jail.

    Aaron Cash, one of Peraza's attorneys, asked Karren on Monday for permission for Peraza to go to the funeral. Cash said the child died last week, but did not provide any other specifics.

    Prosecutors didn't object to the request, and safeguards will be put in place while Peraza is at the funeral, Cash said.

    Peraza must be in shackles and will wear a stun belt, Cash said. Peraza won't be allowed to speak with anyone while at the funeral, Cash said.

    Karren wanted to know the location of the funeral and was concerned if it was held in Oklahoma.

    Cash said the time and location of the funeral had not been scheduled, but the services will take place in Rogers. Cash plans to file a motion with the details of the services, and he requested the motion be sealed.

    Joshua Robinson, senior deputy prosecutor, said he had spoken with Meyer Gilbert, chief deputy for the Benton County Sheriff's Office, and Gilbert did not object to deputies transporting Peraza to the funeral. Robinson said Peraza will be in the presence of deputies at all times while at the funeral.

    ROGERS, Ark. — A man accused of capital murder of a two-year-old child has new lawyers, court documents report.

    Gustavo Peraza, 29, was arrested in 2021 according to the Rogers Police Department (RPD).

    Officials say Mercy Hospital informed RPD about the death of a two-year-old child, and autopsy results revealed the child had died from blunt force trauma to the abdomen. After investigating, RPD arrested Peraza for capital murder and first-degree battery.

    In October, Peraza's previous legal team withdrew from the case. Peraza is due for a pretrial hearing on June 24, 2024, with a jury trial set for Aug. 5, 2024.
