    Facts of the Crime:

    On January 23, 2005, Gardner entered the residence of his soon-to-be ex-wife, Tammy Gardner, with the intent to burglarize the home. During an altercation, Gardner shot her. She was transported via life flight and later died from her injuries.

    Gardner was sentenced to death in Collin County in November 2006.

    On October 21, 2009, the Texas Court of Criminal Appeals affirmed John Steven Gardner's conviction and death sentence.

    Appeals court refuses to hear Collin County capital murder conviction

    A Collin County man facing the death penalty for breaking into his estranged wife's home and killing lost another step in the appeal process.

    The Texas Court of Criminal Appeals denied a request last week to hear the case of 54-year-old John Steven Gardner, a Collin County man sitting on Texas Death Row for shooting his estranged wife 41-year-old Tammy Dawn Gardner, according to state court records.

    Mrs. Gardner was shot in the back of the head on Jan. 22, 2005 at her home located in the 9100 block of Farm to Market Road 2862. called 911 just a few minutes before midnight Jan. 23, 2005, and told police she had been shot during a domestic dispute. Police arrived on the scene and found she had been shot in the head. She was transported by helicopter to Parkland Hospital in Dallas, where she remained in critical condition. She was taken off life support and passed away Jan. 26, 2005.

    John Gardner was arrested Jan. 26, 2005, in Laurel, Miss., in connection with the murder, and later returned to Collin County, where he has been awaiting trial in Collin County Detention Center.

    Prosecuting attorneys said during his trial that Mr. Gardner drove from Laurel, Miss., with a stolen .44 Magnum to Mrs. Gardner's home. She managed to call 911 and tell the county dispatcher's office that her husband shot her. A medical helicopter flew her to Parkland Memorial Hospital where she was kept alive on life support. Family members decided to take her off life support, and she passed away four days later.

    Gardner had also served time for killing his second wife in Mississippi. He previously pleaded guilty to a charge of aggravated assault for shooting Rhoda Gardner of Laurel, Miss., back in 1983. She was pregnant at the time of the shooting.

    According to court documents and clippings from the Laurel Leader Call, Mr. Gardner shot Rhoda Gardner on Dec. 13, 1982 multiple times in the neck and stomach in a parking lot with a .45-caliber automatic handgun. Gardner turned himself in to sheriff's deputies the following day and was charged with aggravated assault, the story said. He later pleaded guilty, and was sentenced to eight years in the state penitentiary on May 3, 1983. She died nearly a month later during a surgical procedure.

    Other than SCOTUS denying him back in 2010 I can't find any thing he filed with them since.

    I wonder why they went so easy on him in the first slaying in Mississippi. Normally, they're not exactly soft on crime there. A mere eight years for aggravated assault when shooting his first wife and the baby she was carrying multiple times leads to her death a month afterwards?

    Well he probably wishes MS had sentenced him to life or even death now. He'd be facing a glorified life sentence rather than staring down the prospect of death in 3 months.
