Bail hearing set for 2 held in 2 Las Vegas holiday killings

    By Ken Ritter
    Associated Press

A Las Vegas judge said Tuesday she’ll decide next week whether to grant bail to two men facing felony murder charges in the shooting deaths of two people during what police said were a series of New Year's Eve robberies.

Jesani Carter, 20, and Jordan Ruby, 18, are charged with murder, armed robbery and conspiracy to commit robbery in the fatal shooting of a Hawaii woman during a purse-snatching in a shopping mall parking garage and the killing of a man in his 50s in a hotel-casino parking area.

Justice of the Peace Harmony Letizia’s decision to schedule a bail hearing Jan. 10 gives prosecutors time to upgrade those charges, which could lead to the death penalty.

Carter's attorney, Kristina Wildeveld, declined to comment after his brief court appearance. Edward Kane, a deputy public defender representing Ruby, did not immediately respond to messages. Carter and Ruby are being held at the Clark County Detention Center pending their court appearance next week.

The Clark County coroner said Clarice Yamaguchi, 66, of Waipahu, Hawaii, died Friday at University Medical Center in Las Vegas of a gunshot to the neck after an attack at the Fashion Show mall. Her death was ruled a homicide.

Yamaguchi and her husband were visiting Las Vegas for the Christmas and New Year holidays when she was fatally wounded by a single gunshot fired while her husband struggled with her assailant in the Fashion Show parking area, according to a police report.

About five hours later, a man was shot and killed in the Palace Station hotel-casino parking area. He has not been publicly identified.

Police said a witness identified Ruby as the shooter in Yamaguchi's death. Police said Ruby had injuries consistent with being hit with a car door by Yamaguchi's husband as he got into a vehicle driven by another man.

A witness identified Carter as the getaway driver, police said.

Police have said the two men are also believed to be responsible for at least one other shooting during an attempted robbery of a casino employee in the Sahara Las Vegas parking garage. That man was not hit by gunfire.

Carter, in a jail interview with the Las Vegas Review-Journal, said he was wrongly arrested. He said he was from California, but his hometown was not specified. Ruby declined an interview request, the newspaper said.

Carter noted that he was arrested without incident after he parked a vehicle and went into Bally’s Las Vegas Hotel & Casino.

“How stupid do you think anyone would be — me — to rob someone, three people robbed, killed, then walk the casino like a regular person?” he told the Review-Journal.

Arrest report: Officers spotted car used in deadly shooting on Las Vegas Strip

    By Matthew Seeman
    KSNV News

LAS VEGAS (KSNV) — Police officers patrolling the Las Vegas Strip for New Year's Eve last week spotted the car connected to a deadly shooting at the Fashion Show Mall just hours earlier, leading to the arrests of two suspects, according to a police report.

Officers took Jesani Carter, 20, and Jordan Ruby, 18 into custody for Friday's deadly shootings at the mall and the parking garage at Palace Station, Las Vegas Metropolitan Police said.

In their arrest report for Carter and Ruby, police wrote that Clarice Yamaguchi and her husband were walking from their car in the mall's garage around 1:30 p.m. when Yamaguchi realized she forgot a face mask.

The husband went back to their car to retrieve it while Yamaguchi waited next to the garage exit. As he walked back, a silver-colored sedan drove up near his wife and a man got out, pointing a gun at her.

The man with the gun struggled with Yamaguchi over her purse, and the husband rushed over to tackle the gunman, police wrote. A gunshot went off during the struggle, and the gunman tried getting back into his car, though the husband "used both hands against the door frame and slammed the suspect several times with the door."

The gunman was able to get back into his car, which drove out of the garage. Yamaguchi died from the shooting.

One witness told police he saw what happened and described the gunman's vehicle as a silver BMW. He said the car drove past him and provided a description to police, saying the driver had shoulder-length dreadlocks while the passenger was wearing a black mask over his face with a black hood pulled up.

Police reviewed surveillance video and determined the suspect vehicle was involved in an armed robbery reported at Wynn Las Vegas the previous day, Dec. 30. It was also listed for a missing person case for Jesani Carter from California.

The car had a temporary California registration, and officers working New Year's Eve special events spotted it parked at Bally's around 7:45 p.m. Officers watched surveillance video and saw two men get out of the car and walk into the casino, according to the report.

Both men, later identified as Carter and Ruby, were taken into custody. Police wrote that a witness picked Carter out of a six-person photo lineup and was "100% positive" he was the driver. They also said that Ruby had abrasions and reddening along his right arm and shoulder "that could be consistent with being slammed in a car door."

Police got a warrant for their car and found a black backpack that contained a black hoodie and black ski mask, along with a gun with an extended magazine and a cartridge casing.

The arrest report did not include any information on the deadly shooting at Palace Station.

Both Carter and Jordan are currently detained, charged with open murder, attempted robbery with a deadly weapon, and conspiracy to commit robbery. They are scheduled to appear in court on Jan. 10 for a bail hearing.

Man shot to death in Palace Station parking garage identified by coroner

    By Greg Haas
    KLAS News

LAS VEGAS (KLAS) — A man who was shot and killed on New Year’s Eve in a Palace Station parking garage has been identified as Hyo Sup Um, a 60-year-old Asian man.

The Clark County Coroner’s Office reports he was shot in the back.

Police accounts of the shooting indicate two men who were involved in an earlier shooting at the Fashion Show mall parking garage were also responsible for the shooting at Palace Station. Thus far, 20-year-old Jesani Carter and 18-year-old Jordan Ruby have only been charged with one murder.

Metro Lt. David Valenta told 8 News Now that Carter and Ruby tried to rob an employee in the Palace Station garage. When the robbery attempt failed, they targeted a man, shooting and killing him.

The Palace Station shooting was reported just after 6 p.m. on New Year’s Eve. The shooting at the Fashion Show mall took place at about 1:30 p.m.

The shooting at the Fashion Show parking garage left 66-year-old Clarice Yamaguchi, a tourist from Hawaii, dead from a gunshot wound.

Two Men Who Went to Las Vegas on New Year's Weekend Now Charged With 13 Felonies

    By Aaron McDade
    Newsweek

After a hearing on Monday, two California men have now been charged with 13 felonies in connection to their time allegedly committing armed robberies leading up to New Year's Eve in Las Vegas.

Justice of the Peace Harmony Letizia also denied a chance on Monday for Jesani Carter, 20, and Jordan Ruby, 18, to be released from jail until their charges progress.

Authorities allege that the two men committed several armed robberies in and around Las Vegas parking garages December 30 and 31, two of which ended in shootings that killed 66-year-old Clarice Yamaguchi and 60-year-old Hyo Sup "Richard" Um.

Letizia refused to release the men, saying they were clearly a danger to their communities, and called them criminal predators. Neither of the men entered a plea to the charges.

Three detectives testified about the circumstances surrounding the December 31 arrests, and a preliminary evidence hearing is set for February 10.

"They came to town on the busiest weekend of the year to terrorize the community, to terrorize tourists," Letizia said.

Yamaguchi, from Waipahu, Hawaii, was shot and killed December 31 in the parking garage near the Fashion Show mall after the two men allegedly stole her purse and her husband fought back, police said.

Hours after that, Um was shot and killed in the Palace Station parking garage. Police said he was seen on security footage gambling in the casino before his death, and a detective testified that Um's wallet was not found on his body.

The charges were expanded Monday from an initial three counts to 13 felony counts that include attempted murder, robbery with a weapon and conspiracy to commit robbery. Prosecutor Marc DiGiacomo has said the case may be considered for the death penalty.

Attorneys for Carter and Ruby declined outside court to comment on their behalf or provide their clients' California hometowns. Carter's family members who attended the bail hearing declined to speak with a reporter.

Um's hometown was not immediately known, the Clark County, Nevada, coroner said.

Detectives described security camera images and witnesses who linked Carter and Ruby with a silver BMW sedan with a temporary California license tag seen at armed robberies also at parking structures for the Wynn resort on December 30 and Sahara hotel-casino on December 31.

DiGiacomo alleged that the two defendants "came to Las Vegas for the purpose of robbing people on New Year's."

The judge acknowledged receiving messages from people in Hawaii about Yamaguchi and the bail hearing, but said she left them unread until they could be shared with prosecutors and defense attorneys. The messages were made part of the evidence cache in the case.

Police said Carter and Ruby also tried to rob an employee at the Sahara who said a gunman grabbed his backpack and fired a shot as the employee ran toward an elevator. That man was not hit by gunfire.

Um's killing in the Palace Station parking area came on a different parking level and minutes after a woman was confronted by a man who took her belongings at gunpoint but returned them when she pleaded to be able to keep her phone and identification, Detective Tate Sanborn testified.

Carter and Ruby were arrested after parking a silver BMW sedan with a temporary California license tag at the Bally's Las Vegas hotel-casino.

Sanborn said a search of the vehicle found a Glock 9 mm handgun with an extended magazine clip and checks belonging to a woman who had been robbed at gunpoint at the Wynn a day earlier. The gun matched a bullet casing found at the Sahara, Sanborn said.

DiGiacomo also played for the judge an audio clip from a jailhouse telephone call in which Ruby allegedly told a woman he was "the driver, not the shooter" and that he "wanted to make some money (but) just did it the dumb way."

2 men indicted in case of New Year's Eve robbery-killings near Las Vegas Strip

    By Ken Ritter
    Associated Press

(AP) -- Two California men were indicted Friday on murder and other felony charges in a series of New Year’s weekend robberies and shootings on the Las Vegas Strip that left two people dead.

Jesani Carter and Jordan Ruby also face charges including attempted murder, armed robbery and conspiracy in the 13-count indictment filed in Clark County District Court.

Attorney Caitlyn McAmis, representing Carter, said her client plans to plead not guilty at an arraignment Feb. 16 in state court.

Ruby’s appointed attorney, Ed Kane, did not immediately respond to a message about the indictment.

Carter, 20, and Ruby, 18, are being held without bail at the Clark County Detention Center.

Prosecutor Marc DiGiacomo has said their case may be considered for the death penalty.

The two men were arrested Dec. 31, hours before a Las Vegas Strip fireworks show that tourism officials said drew hundreds of thousands of New Year’s revelers.

A Las Vegas judge who last month ordered the two defendants held without bail said she believed they “came to town on the busiest weekend of the year to terrorize the community, to terrorize tourists.”

The indictment alleges the two drove from Southern California to Las Vegas and acted together to kill Clarice Yamaguchi, 66, of Waipahu, Hawaii, on Dec. 31 during a purse-snatching-turned-shooting in a parking garage at the Fashion Show mall.

It accuses them of robbing and killing Hyo Sup “Richard” Um, 60, a few hours later in a parking structure at Palace Station.

Police said Carter and Ruby also tried to rob an employee at the Sahara who said a gunman grabbed his backpack and fired a shot as the employee ran toward an elevator. That man was not hit by gunfire.

Security camera images and witnesses linked Carter and Ruby with a silver BMW sedan with a temporary California license tag seen at an armed robbery in a Wynn resort parking structure on Dec. 30.

Carter and Ruby were arrested at Bally’s Las Vegas hotel-casino, where police said they found a Glock 9 mm handgun with an extended magazine clip in their parked silver BMW.

Death penalty sought for suspects in fatal New Year’s Eve robberies

    By Katelyn Newberg
    Las Vegas News-Journal

Prosecutors plan to seek the death penalty for two men accused of committing a string of armed robberies that left two people dead on New Year’s Eve.

Jordan Ruby, 18, and Jesani Carter, 20, each were indicted in February on 13 counts, including two counts of murder with a deadly weapon of a victim 60 or older. Prosecutors filed court documents on Friday indicating that they will seek the death penalty for both suspects.

“The evidence will show that the two defendants came to Las Vegas on the busiest day of the year to ‘make money’ by robbing people in the tourist corridor,” Chief Deputy District Attorney Marc DiGiacomo wrote in the notice of intent to seek the death penalty.

“During the course of their actions to ‘make money,’ the two defendants killed two innocent bystanders while taking their money and/or property.”

DiGiacomo declined to comment on the case on Tuesday, and District Attorney Steve Wolfson did not reply to a request for comment. Attorneys for Ruby and Carter also did not reply to a request for comment.

The suspects have been linked to five robberies in parking structures at casinos and the Fashion Show mall over a period of two days, the Metropolitan Police Department has said. Two of those robberies involved a fatal shooting.

Detectives narrating surveillance footage testified during a court hearing in January that two men in a silver BMW would drive up to parking structures. Once they spotted a victim, one would get out of the car, threaten that person with a gun and demand their belongings. Four of the crimes were caught on video.

The first robbery was reported at the Wynn Las Vegas on Dec. 30, police said.

On the afternoon of New Year’s Eve, 66-year-old Clarice Yamaguchi of Hawaii was shot and killed near the Fashion Show mall on the Strip. She was walking back to her car with her husband to get a face mask when a passenger in a passing BMW got out and tried to take her purse, police have said. A round went off and struck Yamaguchi when her husband tried to tackle the man.

After the killing, the suspects targeted an employee at the Sahara Las Vegas, a Metro detective testified during the January court hearing. The employee had reported that someone tried to take his backpack and then fired a round at him when he ran away.

The BMW then was seen at Palace Station, where a woman was robbed at gunpoint in a parking garage, the detective testified.

A short time later, 60-year-old Hyo Sup Um was shot in the same parking garage, and his wallet was missing after the shooting, police have said. He died at University Medical Center.

DiGiacomo has said that during a recorded phone call from jail, Ruby told a woman that “he came to Las Vegas for the purpose of robbing people on New Year’s.”

Carter, a California resident, denied his involvement in the robberies during an interview with the Review-Journal.

The two suspects remained in the Clark County Detention Center on Tuesday without bail, according to jail records. They are scheduled to appear in court again on Aug. 25.

Evidence in Las Vegas Strip crime spree, murders includes DNA, jail phone call

2 indicted in 2 murders, other incidents around New Year's Eve

    By David Charns

    8 News Now

LAS VEGAS (KLAS) — Evidence in the cases against two young men accused of going on a crime spree on the Las Vegas Strip, which left two dead, includes DNA and a jail phone call, where one says he tried to “make money… the dumb way,” prosecutors said in newly filed court documents.

Jesani Carter, 21; and Jordan Ruby, 19, are accused in two homicides, an attempted murder and a robbery from Dec. 30 to Dec. 31, 2021, at several locations.

Grand jury evidence, including several videos and photos, shows how prosecutors believe the pair committed the crimes. Four videos seemingly show the same thing: A silver BMW with a California temporary tag rolling through a parking garage.

One video shows a man getting out of the car inside a garage at the Fashion Show mall and then attacking Clarice Yamaguchi, 66. The man steals her purse and then shoots her as several other cars move through the structure.

Yamaguchi was shot and killed during the attempted robbery in the garage near the Dillard’s entrance. She and her husband came to Las Vegas on Christmas Day, and were on their way into the mall when a man confronted her with a pistol.

Other videos, such as one from a Wynn parking garage the night before, show the car stopping as a woman walks by. One of the suspects then gets out and steals her purse.

The second homicide of the night, which happened in the garage at Palace Station, is not caught on camera. Hyo Sup Um, 60, an employee, was killed in the robbery attempt gone wrong, police said. The video evidence includes a security guard in the garage biking to the scene after hearing gunshots. The same BMW is also shown in the garage seconds later.

About a half-hour later, the pair went into Bally’s to get something to eat, police said. Police said they also have a video of Carter and Ruby getting out of the car, though the video was not in the evidence reviewed by the 8 News Now Investigators.

Attorneys for Carter have asked a judge to re-consider setting bail. A judge ordered both he and Ruby held without bail due to their murder charges.

In documents opposing the two men’s release, prosecutors said Carter’s and Ruby’s DNA were found on several items, including a gun, which was in the BMW. Shell casings and a bullet inside a victim’s body also matched the same gun, prosecutors said.

Police also found several ski masks with Carter’s and Ruby’s DNA, a sweatshirt with Ruby’s DNA and paperwork from a victim in the car, prosecutors said.

In a phone call at the Clark County jail in January 2022, Ruby told his mother “he came to Las Vegas on New Year’s Eve to make money, he just went about it in a dumb manner,” prosecutors said.

“I was trying to make some money… I did it the dumb way, obviously,” a person, who prosecutors identified as Ruby, said in the recording.

In addition, prosecutors allege Carter attacked and robbed a woman in California in March 2021 and also robbed a California jewelry store in October 2021, documents said.

Carter’s attorneys write in court documents that their client should be offered bail and that he “is highly motivated to participate in his defense and return to court to face these charges.”

Carter spoke to the 8 News Now Investigators’ David Charns via video at the Clark County Detention Center shortly after his arrest.

David Charns: So, you’re saying police have the wrong person.

Jesani Carter: For sure. For sure. For sure.

When Carter talked to the 8 News Now Investigators, he said he was the driver. Prosecutors said Ruby told his mother he was the driver. They believe Carter was the gunman in the Wynn and Palace Station incidents and Ruby was the gunman at Fashion Show Mall and the Sahara, documents said.

Attorneys for Ruby have filed a request for a judge to consider dismissing the case.

Prosecutors have said they intend to seek the death penalty should the men be found guilty.

Trials for both men were scheduled for 2024.
