    Summary of Offense:

    Coble was convicted of the August 1989 slaying of his estranged wife's parents, Robert and Zelda Vicha, and their son, Waco police Sgt. Bobby Vicha. He shot the three to death at their home. He later kidnapped his wife at gunpoint after handcuffing her four children to a bed. While being pursued by police, Coble wrecked and was sent to jail after being released from the hospital. Karen Coble, his wife, was also hospitalized, but survived.

    Coble was resentenced to death in McLennan County in September 2008.

    Billie Coble Resentenced to Death

    WACO, Texas — A cop killer whose death sentence was overturned on appeal is going back to Texas death row.

    A Waco jury on Thursday sentenced triple-murderer Billie Wayne Coble (COBBLE) to death during his sentencing re-trial.

    Coble was convicted in the 1989 shooting deaths of a Waco police sergeant and his parents.

    Coble spent more than 17 years on death row. Then last year, a federal appeals court in New Orleans overturned his death sentence — and ordered his retrial on the punishment only.

    The jurors had the choice of sentencing Coble to death or life in prison.

    Triple killer in Waco case loses appeal

    HOUSTON -- The Texas Court of Criminal Appeals has upheld the conviction of a triple-murderer whose previous death sentence for killing a Waco police sergeant and the officer's parents 23 years ago had been overturned on appeal.

    Billie Wayne Coble was returned to death row in 2008 in a retrial in Waco.

    The 62-year-old electrician first was convicted of capital murder in the 1989 shooting deaths of Waco police Sgt. Bobby Vicha and his parents, Robert and Zelda Vicha. The victims were the brother and parents of Coble's estranged wife.

    In 2007, a federal appeals court in New Orleans overturned his death sentence and ordered a new punishment trial. The Texas court on Wednesday rejected what attorneys claimed were 25 errors at the new trial.

    Convicted killer says his last trial was unfair

    WACO -- A convicted killer is claiming his last trial was unfair.

    Billie Wayne Coble was convicted 20 years ago for the murder of his ex-wife's parents and brother.

    He won a new hearing in 2007 but was put back on death row in 2008.

    He was at the McLennan County Courthouse Friday morning for a writ hearing.

    Coble says because his case received so much media attention his lawyers should have asked for a change of venue.

    Supreme Court Refuses Convicted Killer's Appeal

    WASHINGTON, D.C. — The U.S. Supreme Court on Monday declined to review the capital murder convictions of Billy Wayne Coble and has upheld his death sentences.

    Coble was tried and found guilty of the 1989 slayings of Robert Vicha, Zelda Vicha and Sgt. Bobby Vicha of the Waco Police Department.

    The ACLU filed a petition seeking review because the group claimed Coble’s constitutional rights were violated in testimony from one of the state’s expert witnesses.

    Officially, the filing was for a Writ of Certiorari, meaning the appellant asked the high court to review an issue in a lower court ruling that was unsatisfactory.

    The court issued a ruling of Certiorari Denied, which means the Supreme Court has declined to review the petition and upheld the lower court’s ruling.

    The petition also claimed a portion of the State of Texas’ death penalty law is unconstitutional.

    Coble was originally convicted of three counts of capital murder in 1990.

    The 5th Circuit Court of Appeals, acting on a writ of habeas corpus, overturned Coble’s death sentence in 2007.

    In 2008 a lower court retried Coble on punishment and again sentenced him to death.

    The Texas Court of Criminal Appeals denied a direct appeal on that sentence but another habeas corpus issue is pending in that court.

    If that writ is denied, Coble still can file a writ of habeas corpus in federal court before the sentence can be carried out.

    Death sentence stands for man accused of capital murder

    A man who has been sentenced to death on two separate occasions has been denied a third chance to appeal.

    Billy Wayne Coble was convicted of Capital Murder back in 1990 and given the death penalty. Coble was retried in 2008 and again sentenced the death.

    Coble again appealed to the Texas State Court of Criminal Appeals, but was denied a third chance on Wednesday.

    Coble had been sentenced for gunning down Zelda, Robert, and Sergeant Bobby Vicha at their Axtell homes back in 1989.

    During the trial, the prosecutor described Coble as having no conscience and a heart full of scorpions.
