    Mother gets death penalty

    A Harlingen woman is the first in Cameron County's history to be given the death penalty.

    After hearing almost three days of testminoy, a jury gave Melissa Lucio the death penalty for killing her two-year-old daughter Mariah Alvarez.

    The jury convicted the Harlingen mother last week and begain hearing testimony for her sentencing on Monday.

    The 12 jurors decided on Wednesday that Lucio should be given death by lethal injection.

    Defense attorneys tried to blame her past.

    They said Lucio was physically and sexually abused as a child.

    Lucio's family was sobbing during the final moments before she was sentenced to death.

    Her family left the courtroom in utter distraught.

    Cameron County District Attorney Armando Villalobos said jurors didn't buy the defense's claims.

    "I think the jury understood the seriousness of the abuse and based on that, I think this is the only true verdict," Villalobos said.

    This case began last year when Harlingen police found Melissa Lucio's two-and-a-half-year-old daughter, Mariah Alvarez, unresponsive at the family's home.

    Mariah was pronounced dead at the hospital soon after.

    An autopsy revealed that the two-year-old girl was killed by blunt trauma to the head.

    Child Protective Services said Lucio has 13 other children.

    The Harlingen mother had been investigated for allegations of abuse and neglect several times over the past 13 years.

    "It was clear to us from the injuries to her body and her behavior that this was going on with more than one child," Villalobos said.

    Lucio's live-in boyfriend is awaiting trial.

    He faces charges of injury to a child.

    Although investigators do not believe he participated in the abuse, prosecutors said he did nothing to stop it.

    State records show that there are only nine other women on death row in Texas.

    Jurors in Cameron County have sentenced 17 people to death.

    Most have already been executed, so there are only three people from Cameron County sitting on death row.

    Harlingen mom who killed toddler to stay on death row

    The Texas Court of Criminal Appeals has refused to overturn the conviction of Harlingen mom Melissa Elizabeth Lucio, who was convicted of capital murder in the death of her toddler.

    In its opinion handed down today, the higher court wrote that it found "no reversible error" and affirm the trial court’s judgment.

    A Cameron County jury in July 2008 found Lucio guilty of murdering her 2 ½ year-old daughter Mariah Alvarez.

    The little girl died from blunt trauma to the head in 2007. She also had bruising, bite marks on her back, and injuries to her kidney and liver, court testimony revealed.

    Lucio, 43, remains on death row at the Mountain View facility in Gatesville, Texas.

    A separate jury found her husband Roberto Antonio Alvarez guilty of causing seriously bodily injury to Mariah by failing to provide medical care to his daughter.

    He was sentenced to four years in prison.

    In today's United States Supreme Court orders, Lucio's petition writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    Mother on death row appeals conviction

    A Harlingen woman on Texas’ death row convicted of murdering her child in 2007 has exhausted the state appellate process and is now appealing her conviction in federal court.

    Melissa Elizabeth Lucio, now 44 years old, was convicted in 2008 of capital murder in state district court in Brownsville in the death of her 2-year-old daughter, Mariah Alvarez. Records show that Lucio has exhausted appeals before the Texas Court of Criminal Appeals.

    Her state file is slated to be stored Jan. 31, the record shows.

    The federal record states that Senior U.S. District Judge Hilda G. Tagle recently appointed attorney Margaret Schmucker to represent Lucio in federal court in Brownsville.

    Lucio, originally from Lubbock County, has been jailed since Feb. 17, 2007, when Harlingen EMS and police went to Lee Street apartment where the child lived after receiving an emergency call of a child in cardiac arrest, according to previous reports. When they arrived, emergency personnel found the child on the floor and not breathing.

    According to the Texas Department of Criminal Justice’s report, EMTs also found the child had no vital signs. TDCJ noted that while EMT personnel tried to treat the child, they cut off her shirt and found purple and green bruises on her torso, head, face and right shoulder.

    The child was taken to Valley Baptist Medical Center in Harlingen, where she was pronounced dead.

    Prosecutors subsequently said that the child died from blunt trauma to the head, and had bruising, bite marks on her back and injuries to her kidneys and liver. Doctors said some of the bruises had been there for weeks.

    The child’s father, Roberto Antonio Alvarez, was convicted of causing serious bodily injury to his daughter by failing to provide medical care for her. He was sentenced in November 2009 to four years in prison, although he received credit for time served since his February 2007 arrest.

    In the court system, Lucio is known as No. 999537.
