    The decision reached by the Fifth Circuit on February 9th was actually an en banc decision. Chief Judge Owen (G.W. Bush), Judges Jones (Reagan), Smith (Reagan), Southwick (G.W. Bush), Costa (Obama), Willett (Trump), Ho (Trump), Duncan (Trump), Engelhardt (Trump) and Oldham (Trump) voted to deny Lucio's appeal, whereas Senior Judge Higginbotham (Reagan), Judges Stewart (Clinton), Dennis (Clinton), Elrod (G.W. Bush), Haynes (G.W. Bush), Graves (Obama) and Higginson (Obama) dissented. Incidentally, I had thought that senior judges' votes didn't count en banc.

    No not really. Ruben Gutierrez was stayed 3 times in a row because the county clerk kept messing up the death warrants

    However, he gave him a new date once a stay was lifted. He will seek a date for Lucio once cert is denied.

    Cameron has executed only a single person in the past 23 years. It took three years for a warrant to even be requested for Gutierrez after his appeals ran out. It's an absolute pipe dream to even consider that Lucio ever gets executed.
