    Idaho trial for Chad and Lori Daybell delayed to January

    BOISE, Idaho (AP) — A woman charged in Idaho with killing her two youngest children and her new husband’s previous wife will be tried alongside her husband and their trial has been delayed until early next year because the judge says that will give her lawyers enough time to effectively prepare a defense.

    Judge Steven Boyce on Thursday ruled that delaying Lori Vallow Daybell’s trial another 90 days to Jan. 9 would not violate her rights for a speedy trial.

    Vallow and her husband Chad Daybell have pleaded not guilty and could face the death penalty if they are convicted.

    The Daybells are charged with murder, conspiracy and grand theft in connection with the deaths of 7-year-old Joshua “JJ” Vallow and 17-year-old Tylee Ryan.

    Idaho law enforcement began investigating the Daybells in November 2019 after extended family members reported the children were missing. While the children were missing, police said the couple lied about the children’s whereabouts. Their bodies were found buried later on Chad Daybell’s property in rural Idaho.

    Chad and Lori Daybell married just two weeks after his previous wife, Tammy Daybell, died unexpectedly. Tammy Daybell’s death was initially reported as “natural causes,” but investigators had her body exhumed after growing suspicious when Chad Daybell quickly remarried.

    Lori Vallow Daybell is also charged with conspiracy to commit murder in Arizona in connection with the death of her previous husband. Charles Vallow was shot and killed by Lori Daybell’s brother, Alex Cox, who claimed it was self-defense. Cox later died of what police said was natural causes.

    Vallow in April entered a not guilty plea and invoked her right to a speedy trial, which legally needed to take place by October. That complicated plans for a combined trial for her and her husband.

    On May 19, prosecutors asked that Vallow’s trial be postponed until Jan. 9. Prosecutors expressed concern that if Vallow was tried separately in October that an “improper severance” would happen with the couple’s cases.

    Boyce also expressed concern whether Vallow’s recently appointed attorneys had enough time to prepare for the trial and said the 90-day delay would give them more. He noted that prosecutors have worked on the case since 2020.

    An Idaho judge has banned cameras from the courtroom in the high-profile triple murder case against a mother and her new husband, saying he fears the images could prevent a fair trial

    BOISE, Idaho -- An Idaho judge has banned cameras from the courtroom in the high-profile triple murder case against a mother and her new husband, saying he fears the images could prevent a fair trial.

    Seventh District Judge Steven Boyce made the ruling on Friday, saying that news organizations will no longer be able to shoot still photography or videos inside the courtroom in the criminal case of Lori Vallow Daybell and Chad Daybell. The couple are charged with conspiring to kill Lori Vallow Daybell's two youngest children and Chad Daybell's late former wife, and the strange details of the case have drawn attention from around the world.

    Both Vallow Daybell and Daybell have pleaded not guilty to the charges, which carry a potential death penalty.

    Late last month, Vallow Daybell's attorneys asked the judge to ban cameras from the courtroom. They contended that one news organization abused the privilege by repeatedly zooming in on Vallow Daybell's face during an Aug. 16 hearing. The attorneys, Jim Archibald and John Thomas, also claimed the cameras and microphones could potentially be used to overhear private conversations or to view private notes on the defense table, though they did not suggest that the equipment had ever actually been used in that way.

    A coalition of more than 30 news organizations including The Associated Press asked the judge to reject the defense attorneys' motion.

    Steve Wright, the attorney for the news coalition led by EastIdahoNews.com, told the judge that banning cameras would not stop the widespread public interest in the case but instead prevent people from seeing the most accurate depiction of the proceedings.

    The news organizations also noted that the coverage was done to inform members of the public, most of whom are unable to attend in person.

    Wright told the judge that banning cameras completely would be a “vast overreaction,” but acknowledged that the judge had the authority to limit the visual coverage as he saw fit.

    The prosecuting attorney in the case, meanwhile, sided with the defense and said the cameras should be banned. Prosecuting attorney Rob Wood said the news coverage could make it hard for the court to find an impartial jury when the case goes to trial next year.

    In his ruling, Boyce said there was no indication that the news organizations had ever violated the court orders that allowed cameras in the courtroom.

    “The presence of media during the hearings has in no way interrupted those proceedings, and attending media have been respectful and professional,” Boyce wrote in the ruling. Still, the judge said, the concerns raised by the defense attorneys are “well founded.”

    Boyce said he has had to proactively avoid viewing the news coverage of the case because it is routinely part of local and sometimes national news. He noted that he has already decided to move the trial across the state to Ada County in hopes of improving the chances of finding impartial jurors.

    He said the camera ban would continue even after the jurors for the trial are selected — even though jurors are always admonished not to discuss or consume any news coverage about the case they are working on. Visual news coverage could also taint potential witnesses and stress out the attorneys involved in the case, he said, “knowing their every expression, utterance and appearance will be captured and circulated without their control in perpetuity.”

    That pressure could interfere with the “fair administration of justice,” Boyce said.

    Idaho law enforcement officers started investigating Lori Vallow Daybell and Chad Daybell in November 2019 after extended family members reported her two youngest children, Joshua “JJ” Vallow and Tylee Ryan, were missing. At the time, JJ Vallow was 7 years old and Tylee Ryan was nearing her 17th birthday.

    Chad and Lori Vallow Daybell had married just two weeks after his previous wife, Tammy Daybell, died unexpectedly. The children’s bodies were later found buried on Chad Daybell’s property in rural eastern Idaho.

    The couple was eventually charged with murder, conspiracy and grand theft in connection with the deaths of the children and Daybell’s late wife. They have pleaded not guilty and could face the death penalty if convicted.

    Prosecutors say the couple promoted unusual religious beliefs to further the alleged murder conspiracies. Lori Vallow Daybell’s former husband, who died while the two were estranged, said in divorce documents that Vallow Daybell believed she was a god-like figure responsible for ushering in the apocalyptical end times. Chad Daybell wrote doomsday-focused fiction books and recorded podcasts about preparing for the apocalypse.

    Friends of the couple told law enforcement investigators the pair believed people could be taken over by dark spirits, and that Vallow Daybell referred to her children as “zombies,” which was a term they used to describe those who were possessed.

    Vallow Daybell is also charged with conspiracy to commit murder in Arizona in connection with the death of her previous husband. Charles Vallow was shot and killed by Lori Daybell’s brother, Alex Cox, who said it was self-defense. Cox later died of what police said was natural causes.

    The Arizona legal proceedings are on hold while the Idaho case is underway and Vallow Daybell has not been scheduled to make a plea in the Arizona case.

    An Idaho judge has ruled murder suspect Lori Vallow competent to stand trial after her initial Jan. 9, 2023, trial date was vacated pending her evaluation.

    Vallow, who is accused of killing her two children and collecting their Social Security benefits in 2019, was scheduled to appear in court for a joint murder trial with her husband, Chad Daybell, who faces the same charges as his wife.

    The court is now expected to reschedule Vallow's trial date.

    Daybell, meanwhile, is asking for his trial to be severed from his wife's, because Vallow faces the death penalty for her alleged crimes. The pair is at the center of not only the murders of Vallow's two children, 7-year-old Joshua "J.J." Vallow and 17-year-old Tylee Ryan, but both of their deceased ex-spouses, as well.

    Prosecutors: Lori Daybell intended for her children to die and participated in their killings

    ST. ANTHONY — Prosecutors plan to present “sufficient evidence” that shows Lori Vallow Daybell intended her two children and Tammy Daybell to die and that she participated in the killings of her kids.

    That’s according to court documents filed Thursday from Madison County Prosecuting Attorney Rob Wood and Fremont County Prosecuting Attorney Lindsey Blake.

    The prosecutors also expressed “serious reservations” about Daybell’s request to meet with her husband Chad, and they argue her alleged actions make her eligible for the death penalty.

    Lori and Chad Daybell are charged with multiple counts of first-degree murder and conspiracy to commit murder for the deaths of 7-year-old Joshua “JJ” Vallow and 16-year-old Tylee Ryan – two of Lori’s children – along with Chad’s previous wife, Tammy Daybell.

    Death penalty response

    Prosecutors are seeking the death penalty against the Daybells, but Lori’s attorneys filed a motion this month arguing Blake and Wood have not been specific enough in stating why their client is eligible for death.

    Defense attorney Jim Archibald asked District Judge Steven Boyce to declare the death penalty unconstitutional in the case and take it off the table.

    In the newly filed objection to Archibald’s motion, prosecutors explained why they believe Daybell qualifies for the death penalty.

    “Sufficient evidence existed for the grand jury to find probable cause that the defendant intended for her children and Tammy Daybell to die. Further, there is sufficient evidence for a jury to conclude that the defendant participated in the killing of her own children,” Blake wrote.

    Blake calls the facts in the case “egregious and heinous.”

    “The evidence the state will introduce at trial, some of which a grand jury has already reviewed, will establish that the defendant intended for her children and her boyfriend’s wife to die, and that she affirmatively acted to make those deaths happen.”

    Lori’s attorneys filed a notice of alibi this month, saying her children died in the apartment of her brother, Alex Cox, while she was in her own apartment and that she was in Hawaii when Tammy Daybell died.

    Response to Chad and Lori meeting

    In a separate court filing, prosecutors responded to Lori’s request to meet with Chad in person and talk with him on the phone for “strategy sessions” ahead of their trial.

    Archibald said he and co-counsel John Thomas will attend the meetings and phone conversations, along with John Prior, Chad’s attorney, and the conversations will not be recorded or used as evidence.

    “The state has serious reservations about allowing the co-defendants to have face-to-face, or other communication directly with each other,” Wood wrote. “The state recognizes that the defendants have agreed to not use any evidence or information they may obtain through any discussions or meetings against each other; nevertheless, the state is not willing to make a similar agreement.

    “Any communications between each individual defendant and his/her attorney(s) are confidential; however, having the other defendant and/or his/her counsel present would make them potential witnesses of statements made by the other defendant and eliminate any claim to attorney/client privilege,” Wood continues.

    While not completely objecting to the idea of the Daybells meeting, Wood asks Boyce to consider objections raised by prosecutors.

    DNA testing

    Prosecutors acknowledge in another court filing that hair samples recently discovered by the Idaho State Lab may be used to determine if there is sufficient DNA to create a DNA profile.

    Based on court documents filed in July, it’s likely the hair came from duct tape inside a body bag used to transport JJ’s remains, but the new filings do not provide specifics.

    The hair may be destroyed while the lab is testing for DNA, prosecutors wrote.

    “In the event sufficient DNA is available to create more than one profile, the DNA sample will be split between the parties for testing, and each party may have the expert of their choice test their respective portions of the DNA,” prosecutors said. “In the event sufficient DNA is available for only one profile to be created, the parties agree the State Lab shall halt any further testing and the parties will reconvene at that time to determine who should conduct any further testing.”

    Jury sequestration and timing of trial

    Legal counsel for both Chad and Lori filed separate motions objecting to having the jury sequestered when the trial begins in the spring.

    “The state has failed to provide any rational justification for placing jury members in an isolated environment for almost three months,” wrote Prior, Chad’s attorney. “… The court has taken the necessary precautions to limit exposure of the evidence in this matter, and an instruction from the court should be more than acceptable to limit outside influences.”

    Lori’s attorneys noted a media camera ban, issued by Boyce in September, has helped reduce pre-trial publicity, and there is no need to sequester members of the jury.

    “For the jury to be sequestered away from their family, children and homes for two months, without phones and TV and internet, would cause an undue burden on the jurors,” Archibald wrote.

    Prosecutors also responded to Prior's motion to postpone the trial until April 2024. In a motion filed this month, Prior said he needs a substantial amount of time to prepare for the trial.

    “Counsel has represented the defendant for over three years regarding the allegations which are part of this case,” prosecutors wrote. “Presumably, given the length and nature of the representation, it would seem the defendant has had adequate time to consult with his counsel and provide him information necessary to obtain any relevant documents and evidence.”

    What’s next

    The motions will be heard in front of Boyce on Thursday in Fremont County. Additional hearings are scheduled in February and March before the trial is set to begin April 3 in Ada County. Chad and Lori Daybell have pleaded not guilty to all charges.

    Can you think of any other Death Penalty cases where there were two or more defendants being tried together in the same trial?

    Yeah there have been quite a few I know of. In California 3 inmates were tried together and all got the Death Penalty. There are also some in the federal death row that were tried together

    An Idaho judge has denied alleged "cult mom" Lori Vallow's request for a joint, 30-minute "strategy session" with her husband, Chad Daybell, ahead of their April murder trial.

    Vallow and Daybell are charged with murdering Vallow's two children, seven-year-old Joshua "J.J." Vallow and 17-year-old Tylee Ryan, in September 2019, and their trial has been delayed several times since it was initially scheduled for 2021.

    "[T]he two defendants would be like to be able to talk about their options in settlement," Vallow's attorney, Jim Archibald, said in court Thursday, according to East Idaho News director Nate Eaton. "This is unusual to make a request like this. Typically, the law enforcement want defendants to stay apart while their cases are pending."

    Archibald pressed Fremont County Judge Steven Boyce for the meeting during Thursday's hearing in which the judge heard arguments on several motions including the proposed "strategy session," the couple's anticipated April trial date – which Daybell asked to delay – and the possibility of having a sequestered jury during the trial.

    The attorney noted that there will be more than 100 witnesses who can speak with each other about the case, but Daybell and Vallow will not be allowed to communicate with one another.

    "After our court hearings today, I'd like an order from the court that we are allowed to spend 30 minutes together in a jury room, Lori and Chad and their attorneys. ... This is an important issue for my client," Archibald said, according to Eaton, who was reporting from inside the courtroom. " . . . The state sent us a letter asking if we wanted to settle the case or not. I took that to my client, and she said, ‘What does my husband think?’ She is married, and that's why I filed this motion."

    Meanwbile, Daybell's attorney argued that he and his client would not "waver from the true and accurate facts of this case."

    "I'm not going to engage with Ms. Vallow Daybell in terms of taking a plea offer. I find that inappropriate, and I'm not going to engage in that," attorney John Prior said of the proposed meeting to discuss possible settlement options.

    The state argued that the meetings would not be about "strategy" but rather about "trial prep."

    Boyce ultimately decided to block the meeting, saying: "[I]t's an idea that is full of pitfalls that would far outweigh any conveniences."

    The judge in September decided to ban cameras inside the courtroom for the trial, which was schedule to take place on Jan. 9 but was pushed back until April at Daybell's request. Meanwhile, Vallow has not waived her rights to a speedy trial, meaning she would like the trial to move forward as soon as possible.

    Eaton also reported that while Vallow peered in Daybell's direction more than once, Daybell avoided eye contact with her the entire time they were in the same courtroom on Thursday.
