    Summary of Offense:

    King and two co-defendants, Lawrence Russell Brewer and Shawn Allen Berry, were convicted of torturing and killing James Byrd, Jr., a 49-year old handicapped black male, in rural Jasper County. The victim was observed in the back of a pickup truck occupied by King and the co-defendants. King and his co-defendants drove to an isolated spot on a logging road where they beat and tormented the victim, then tied him to a logging chain, which was hooked to the pickup truck. King and his co-defendants then dragged the victim to his death, leaving his decapitated and dismembered body to be found the following day by citizens and law enforcement officials. It was argued in court that King and his co-defendants engaged in this criminal act, in part, due to their racially separatist affiliation with the Confederate Knights of America and the Ku Klux Klan. Brewer and one co-defendant were documented members of the Confederate Knights of America and a large number of Ku Klux Klan and other racial separatist organization paraphernalia was discovered in a residence occupied by the three.

    King was sentenced to death on February 25, 1999. Berry received a life sentence. Brewer was sentenced to death in September 1999 and executed on September 21, 2011. For more on Brewer, see: http://www.cncpunishment.com/forums/...awrence+brewer

    With Brewer dead, when will John King be executed?

    Shortly after Texas prison officials pronounced Lawrence Russell Brewer dead on Wednesday, Clara Taylor said justice for her brother, James Byrd Jr., was one step closer to being served.

    Brewer, 44, was one of two men sentenced to death in Byrd's murder, and the first to die for his part in it.

    John William King, 36, also was sentenced to death for the crime but his execution date has not been set. The people of Jasper say once King is executed, the town finally will be able to put the tragedy of the Byrd murder - and all of the attention the city got after it - behind them.

    The question now is when that will be, a decision that rests with the judge who presided over King's trial. Once all appeals in the case have been exhausted, the judge will set the date, according to the Texas Department of Criminal Justice. Then, King's name goes on a prison system list of scheduled executions.

    King has been in the Polunsky Unit for 12 years, convicted of capital murder by a Jasper County jury on February 23, 1999, and sentenced two days later.

    According to the Texas Department of Criminal Justice, offenders are on death row for an average of 10.6 years before execution.

    Does anyone know where this guy is in the appeal process? Couldn't find any information online.

    In today's Texas Court of Criminal Appeals opinions, King's subsequent application for writ of habeas corpus filed pursuant to the provisions of Texas Code of Criminal Procedure Article 11.071, § 5.1 was DISMISSED as an abuse of the writ without considering the merits of the claims.
    An uninformed opponent is a dangerous opponent.

    16 years after infamous hate crime murder, convicted killer still on death row

    POLK COUNTY, TX - This week marks 15 years since an East Texas man was sentenced to death for the racially motivated killing of another Jasper man back in 1998.

    John William King was one of three men found guilty in 1999 of the hate crime against 49 year old James Byrd, Jr., after chaining him by the ankles to the back of a pickup truck and dragging the man for three miles.

    But 15 years later, King argues he had no involvement in the crime and that the evidence used against him didn’t belong to him.

    King’s appeal is currently under review by a U.S. District Judge in Plano, just north of Dallas. Since his sentencing, King has been on death row at a Polk County facility.

    One of the other men found guilty in the case, Russell Brewer, was executed in 2011, after about 12 years on death row. The other, Shawn Berry, who was also the driver of the pickup truck, is currently serving a life sentence. Berry will be eligible for parole in 2038.

    Byrd’s case not only gave Jasper the national spotlight, but it also lead to positive changes on the national scale. In 2009, President Obama signed the Hate Crimes Prevention Act into law in 2009, a move partially prompted by Byrd’s brutal death.

    At this time, it is unclear when the decision will come down on King’s appeal.

    I saw a film about this heinous crime on TV last night, glad to hear that Brewer is no longer an oxygen thief on this planet - but all these years later & King is still not executed??? I suppose at least his 'life' on death row isn't an enjoyable one. I don't know why he doesn't just give up with all this appealing & accept his fate.

    That opinion refers to John Troy King, not John WILLIAM King. John William King is the animal on our death row, not John Troy King.

    I was actually going to say I'm not positive this is him cause it's in the southern district court which does not cover Jasper County. I'll see if I can find anything else on Justia.
