LIMESTONE COUNTY, Ala. (WAFF) - A preliminary hearing for a woman charged with capital murder in Athens was held on Monday.

Diana Rogers, 39, was arrested on a capital murder charge on April 9. According to court documents Rogers is accused of stabbing Diane Defoor, 58, with a kitchen knife and beating her with a wooden bowl. Defoor was found dead in a home on Maiden Ct.

Rogers appeared in Limestone County District Court before Judge R. Gray West on Monday, May 9.

Limestone County Investigator Stephen Ferguson said Rogers was found on the scene along with her two children. Ferguson testified that the cause of death was due to a stab wound that pierced Defoor’s lung.

Maryland Woman Indicted on Capital Charge in Alabama Killing

A Maryland woman was indicted on a capital murder charge in the killing of an Alabama woman who was found dead in a home earlier this year

    By Associated Press

ATHENS, Ala. (AP) — A Maryland woman was indicted on a capital murder charge in the killing of an Alabama woman who was found dead in a blood-splattered home earlier this year, court records show.

Diana Lynne Rogers, 40, of Mount Airy, Maryland, faces a potential death penalty if convicted in the slaying of Diane Crane Defoor, 58, of Athens. She was accused of killing the woman during a burglary.

Defoor was beaten with a wooden bowl and stabbed after someone entered a home, court records show.

Defense attorney Michael Sizemore said no arraignment hearing had been set but Rogers intends to plead not guilty. The defense is still investigating what happened, Sizemore said.

“I’m not sure either side has a full grasp of what happened,” he said.

Rogers was indicted last week, records showed.

Rogers was acting suspiciously when police found her in the backyard of a home in April, officials have said. She tried to lead officers away from the residence and then began to fight when authorities tried to detain her.

Authorities found Defoor's body inside the home, where a door had been left open. While officials have not said exactly what happened, a hard drive located at the home was believed to have recorded some events that occurred before and during the slaying, according to a motion filed by the defense.

Attorneys representing Rogers have asked a court for orders to protect evidence found at the scene including a bloody roll of paper towels, blood splatters in several locations, a cigarette butt, a can of baby formula and a vodka bottle.

    WHNT News

LIMESTONE COUNTY, Ala. (WHNT) — A Maryland woman accused of murdering an Athens resident in their home during a burglary is set to appear in court Wednesday, according to court records.

Diana Lyn Rogers, 41, was charged with capital murder, second-degree burglary and obstructing a governmental operation following an incident in April 2022.
The Limestone County Sheriff’s Office confirmed that Rogers was found in the backyard of an Athens home on Maiden Court and was “acting strange.” Authorities said she tried to lead the deputies away from the house, and when they tried to detain her, they said she started fighting back.

Deputies also confirmed they found 58-year-old Diane Crane Defoor dead inside the home. Following an autopsy, Defoor’s death was listed as a homicide, caused by “sharp-force injuries.”

Rogers was held without bond on the capital murder charge. Court records show she was indicted a few months later.

The settlement docket hearing is scheduled to begin at 9 a.m. at the Limestone County Courthouse.
