    Summary of Offense:

    Randall Wayne Mays was sentenced by the same jury that convicted him Friday on a capital murder charge. His brother, Noble Mays, Jr., was executed in 1995 for the fatal stabbing of a Good Samaritan who agreed to help him with a disabled car. Henderson County sheriff's deputies Tony Price Ogburn and Paul Steven Habelt died and a third deputy was injured in May 2007 in a shootout at Mays' house in Payne Springs, about 50 miles southeast of Dallas. They were responding to a domestic disturbance call made by a neighbor who reported hearing gunshots on Mays' property. After appearing to cooperate with the deputies, Mays barricaded himself inside his house, where he used a high-powered rifle to shoot at officers. Mays was convicted in Ogburn's death.

    Mays was sentenced to death in Henderson County on May 16, 2008.

    ATHENS (AP) -- A jury in East Texas convicted a man blamed for the 2007 shooting deaths of two deputies.

    Jurors in Athens on Friday convicted 48-year-old Randall Wayne Mays of capital murder.

    The next step is the penalty phase. Prosecutors are seeking the death penalty.

    The shootout, last May 17 near Payne Springs, left two Henderson County sheriff's deputies dead and a third injured.

    Deputies Paul Steven Habelt and Tony Price Ogburn were shot and killed after responding to a domestic disturbance call at the Mays house.

    Mays, who did not testify, was convicted over the killing of Ogburn.

    Payne Springs is about 50 miles southeast of Dallas.

    Man who killed two Sheriff’s deputies in 2007 appeals again

    Athens — The man who was convicted of killing two Henderson County Sheriff’s Department officers was back in court Tuesday.

    Randall Wayne Mays was convicted of capital murder, and sentenced to the death penalty for fatally shooting Henderson County Sheriff’s Department Investigator Paul Steven Habelt, 63, and deputy Tony Ogburn, 61 on May 17, 2007.

    The officers were killed in the shootings after responding to a disturbance at a residence in Payne Springs.

    A third officer, HCSO Deputy Kevin Harris, was shot in the leg during the May 17 shooting. He did survive.

    Mays’ attorney, Jeff Haas of Tyler, filed his appeal stating Ineffective Assistance of Counsel. Some of the points he hopes to bring out are the fact that there was no Change of Venue applied to the case, as well as May’s mental state at the time of the trial.

    “This is all very standard,” Henderson County District Attorney Scott McKee said. “We don’t feel we have anything to worry about. He has a right to an appeal, and we knew they would bring up some of these issues, but they were all addressed during the case.”

    Mays filed his first appeal on Sept. 7, 2009. He was sentenced to death on May 13, 2008. In the Writ of Habeas Corpus, it states that Mays is requesting an Evidentiary Hearing to present evidence and argument in support of himself.

    According to the facts in the case, Francis Nicholson heard gunshots from the property of Mays. As Nicholson turned around to look, she saw Mays firing a handgun in the direction of his wife, Candice Mays.

    Nicholson, in fear that a school bus may be coming, called police. Deputies were dispatched to the scene. Mays shot Ogburn and Habelt after a standoff with law officials. The officers were dead on the scene.

    Mays is expected to be back in court on Thursday at 9 a.m. in the 392nd District courtroom.

    In today's United States Supreme Court orders, Mays' petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    In today's Texas Court of Criminal Appeals orders, Mays' post-conviction application for writ of habeas corpus was DENIED.

    As per the TDCJ, an execution date of August 23, 2011 has been set for Mays.

    I don't think so. I've never know the Texas Department of Criminal Justice to post administrative dates.
