      Summary of Offense:

      On July 21, 1997, McCarthy entered the residence of Dr. Dorothy Booth, 70, in Lancaster with the intent to rob her. A struggle took place and Booth was stabbed numerous times resulting in her death. McCarthy then used Booth's credit cards and stole her car.

      McCarthy was sentenced to death in Dallas County on December 7, 1998.

      Lancaster woman's capital murder retrial set to start

      October 28, 2002

      DALLAS (AP) - A Dallas County woman whose death penalty conviction was overturned by the state's highest criminal court is set to begin her second fight in four years to avoid the death penalty.

      Kimberly McCarthy, a former nursing home therapist, is accused of stabbing and robbing Dorothy Booth, her 71-year-old Lancaster neighbor in 1997.

      Testimony in McCarthy's trial was scheduled to begin this morning.

      An appeals court overturned her 1998 conviction and granted her a new trial.

      McCarthy is only the second Dallas County woman in a century sentenced to death.

      McCarthy was granted a new trial in December when the Texas Court of Criminal Appeals agreed that a statement taken by a Dallas police detective violated her constitutional rights.

      In her first trial, McCarthy denied playing a direct role in the crime, in which Booth was stabbed five times with a knife and bludgeoned with a candelabra before her finger was cut off to remove her wedding ring. She blamed the grisly killing on two drug dealers.

      DNA samples used in the first trial have been analyzed a second time using a newer genetic-testing method. Blood found under the handle of a butcher knife found in McCarthy's home matched that of Booth's DNA profile.

      Prosecutors also linked McCarthy, a college graduate and an admitted crack user, to the pawning of Booth's wedding ring for $200 after the slaying.

      Prosecutors say McCarthy also was caught with Booth's credit cards.

      McCarthy also faces capital murder charges in the December 1988 deaths of two other women who befriended her, Maggie Harding, 81, and Jettie Lucas, 85.

      Lucas was beaten with a claw hammer and stabbed with a knife.

      Harding also was stabbed, and bludgeoned with a metal meat tenderizer.

      The two women died within days of each other, and prosecutors have DNA evidence to link McCarthy to their deaths.

      HOUSTON (AP) - A Dallas County woman on Texas death row has lost a federal court appeal, moving her a step closer to execution for the fatal stabbing and bludgeoning of a 71-year-old neighbor during a robbery 15 years ago.

      The 5th U.S. Circuit Court of Appeals Wednesday refused an appeal from 51-year-old Kimberly McCarthy . She was sentenced to die for the murder of a retired college professor, Dorothy Booth, at the woman's home in Lancaster, about 15 miles south of Dallas. Evidence showed Booth was attacked with a metal meat tenderizer and knives and her finger was cut off while she was still alive to remove her wedding ring.

      McCarthy was tried twice for the slaying, most recently in 2002. A state appeals court threw out her previous conviction in 1998.

      How quickly do you think the Dallas DA will move to set a date for this X for a woman? My bet is it takes a good long while ......even though her date is very deserved!

      A woman on Texas death row for the stabbing and bludgeoning of a 71-year-old woman has received a Jan. 29 execution date.

      Kimberly McCarthy was sentenced to die for the July 1997 killing of retired college professor Dorothy Booth during a robbery at Booth’s home in Lancaster, about 15 miles south of Dallas.



      The Dallas County District Attorney’s office disclosed the date Wednesday.

      The 51-year-old McCarthy is one of 10 women sentenced to die in Texas but is the only one with a scheduled execution date. Since Texas resumed carrying out capital punishment in 1982, only three of the 482 people put to death have been women.

      Dallas County is the fastest to get X dates in all of Texas, while Harris County has been relectant to sign X warrants for men........a woman would be far down the list.

      Of all the X eligible prisoners look how many are from Harris County on the Texas Inmate Status page.

      Just my guess.
