    Missing Oklahoma men were shot and dismembered, police say

    OKMULGEE, Okla. (KFOR) Remains found in an Oklahoma river have been identified as belonging to the four men who went missing last week in Okmulgee.

    One week ago, family members reported 32-year-old Mark Chastain, 30-year-old Billy Chastain, 32-year-old Mike Sparks, and 29-year-old Alex Stevens missing. The Okmulgee Police Department said all four were close friends and were believed to have left Billy Chastains house on bicycles on Oct. 9.

    On Friday afternoon, search crews stumbled upon human remains in a river southwest of Okmulgee.

    On Monday afternoon, Okmulgee authorities announced the remains had been positively identified as the missing men.

    This investigation is now a murder investigation, said Okmulgee Police Chief Joe Prentice.

    Prentice said all four men suffered gunshot wounds and were dismembered before their remains were thrown in the river.

    That is what caused difficulty in determining identity, he said, adding that the river appears to have been used as a dump site.

    Prentice said they are still trying to determine a timeline for the murders, but investigators believe the bodies were dumped early last Monday.

    Before the group went missing, Prentice says he believes that the men were planning to commit a crime, according to a statement from a witness.

    We do not know what they planned or where they planned to do it, he said.

    Investigators said they searched a salvage yard where one of the mens phones was tracked, but they didnt find anything there. However, Prentice says evidence of a violent event was found at a nearby property.

    The owner of the salvage yard, Joe Kennedy, is now considered a person of interest in the case, but has not been officially named as a suspect. Officials said Kennedy has gone missing.

    Prentice said during previous interviews, Kennedy has denied knowing the men.

    Police said they are also still searching for the missing the bicycles.

    Ive worked over 80 murders in my career. I have worked murders involving multiple victims. I have worked dismemberments. But this case involves the highest number of victims and its a very violent event, said Prentice.

    So I cant say that Ive never worked anything like it, but its right up there at the top.

    Police have tracked down the person of interest in the "violent" quadruple murder that left four men dismembered in an Oklahoma river.

    On Tuesday, salvage yard owner Joe Kennedy was arrested in Daytona Beach Shores, Florida, in a vehicle that was reported stolen to the Okmulgee County Sheriff's Office on Monday, Police Chief Joe Prentice announced on Tuesday.

    On Monday, Prentice confirmed the bodies of four men pulled from the Deep Fork River, southeast of the city of Okmulgee, belonged to Mark Chastain, 32; Billy Chastain, 30; Alex Stephens, 29; and Mike Sparks, 32, who were reported missing overnight last Monday.

    Investigators did not discover any evidence during a search of a salvage yard, but said they found evidence of a "violent event" on an adjoining property, Prentice said.

    No charges were initially filed against Kennedy but investigators were looking to speak to him again before he was reported missing on Saturday, Prentice said. On Monday, police found Kennedy's blue PT Cruiser abandoned behind a business in Morris, Oklahoma, Prentice said in an update on Facebook.

    A warrant was issued for his arrest in relation to a 2012 shooting with a bond for $500,000, Prentice said.

    Police have not yet named any suspects in connection to the quadruple murder.

    "The murder investigation is ongoing and investigators continue to follow leads every day. Additional information will be relayed when it is available," Prentice said.

    The men, close friends, were believed to have left Billy Chastain's home in Okmulgee on Sunday night, reportedly on bicycles, according to police.

    Investigators believe that the men planned to commit some kind of criminal act when they left the residence, according to a witness who told police they were invited to go with the men to "hit a lick big enough for all of them," Prentice said.

    But police said they do not know what the men planned to do, or where.

    The cause of death for the men is still pending, but police confirmed all four had gunshot wounds and their bodies were dismembered before they were dumped into the river.

    VOLUSIA COUNTY, Fla. (WFLA) A person of interest in the case of four missing Oklahoma men whose dismembered bodies were found in a river appeared in a Florida court on Wednesday.

    Joseph Kennedy, 67, was arrested in Daytona Beach Shores after police alleged he was driving a car reported stolen out of Oklahoma.

    Police later learned Kennedy was wanted for questioning in connection to the missing mens murders.
    32-year-old Mark Chastain, 30-year-old Billy Chastain, 32-year-old Mike Sparks, and 29-year-old Alex Stevens were reported missing after disappearing on Oct. 9. They were last seen riding bikes together.

    Their dismembered bodies were found on Oct. 14 in the Deep Fork River in Okmulgee.

    No cause of death has been determined for the victims, but Okmulgee Police Chief Joe Prentice said they all had gunshot wounds.

    Kennedy has not been charged with any crimes aside from grand theft for allegedly driving a stolen car but he was reportedly speaking with Oklahoma law enforcement after they discovered signs of a violent event near his scrapyard.

    Kennedy disappeared until he was arrested in central Florida on Tuesday. Police said he does not appear to have ties to the area and they dont know why he travelled there.
    Kennedy also had an outstanding warrant related to a 2012 shooting in Oklahoma with bond set at $500,000, but a Volusia County judge decided he should be held with no bond.

    Given the total picture which has come to my attention, think at this point in time for public safety and for Mr. Kennedys situation, I think no bond is appropriate, Volusia County Circuit Court Judge Bryan Feigenbaum said.

    Kennedy will have a public defender representing him while he is in Florida, but Judge Feigenbaum said he will soon have to decide whether to fight extradition to Oklahoma.

    Wrongful death lawsuit filed against person of interest, wife in Okmulgee quadruple murders

    OKMULGEE, Okla. - Family members of three of the four men who disappeared and were later found killed in a river earlier this month — have filed a wrongful death suit against the person of interest in the case, as well as his wife.

    FOX23 obtained a copy of the suit
    , filed in Okmulgee County court Tuesday morning.

    The suit names Megan Gordon, Jessica Chastain and Karen Sparks plaintiffs on behalf of their relatives Billy Chastain, Mark Chastain and Mike Sparks respectively. The relatives are being represented by The Seacat Law Firm.

    It alleges defendants Joseph Kennedy and his wife Sandra Kennedy “knowingly caused the death of Billy Chastain, Mark Anthony Chastain and Mikel Tyrel Sparks” earlier this month.

    “The actions of defendant Joseph Lloyd Kennedy II were intentional and malicious and constitute actions that were life-threatening to humans,” the suit says. “Plaintiffs should be awarded punitive damages in an amount in excess of $75,000 each.”

    GPS records traced one of the men’s cell phones to two separate salvage yards in Okmulgee in the hours after they disappeared.

    After several days of searching, authorities found the four men’s bodies dismembered in the Deep Fork River. At that time, Okmulgee Police named local salvage yard owner Joe Kennedy as a person of interest.

    Okmulgee police also announced that Kennedy had been reported missing. He was later found in Florida, driving a stolen car.

    The wrongful death suit also alleges Kennedy’s wife, Sandra, filed for divorce from her husband to avoid being found civilly liable in the men’s deaths.

    Court records show Sandra filed for divorce on October 19, the same day police in Florida arrested her husband, Joe.

    The divorce filing says Sandra and Joe had “purchased several parcels of real property in Okmulgee and McIntosh counties,” and “all right title and interest in said real property should be granted to [Sandra.]”

    The wrongful death suit also alleges sometime after the four men were reported missing, Joe and Sandra Kennedy “sold all of the assets of a dumpster business they owned and operated to D.C. Hauling in Morris, Oklahoma.”

    The suit claims shortly after that sale is when Joe went missing.

    The suit originally alleged in the filing that Sandra pawned numerous guns to a local pawn shop just after Joe Kennedy’s arrest. Robert V. Seacat, the attorney representing the family members, told FOX23 that his office believed this because the loved one of the deceased thought they recognized a gun that the pawnshop had posted on social media.

    Seacat explained that the loved one thought the gun belonged to the deceased. Law enforcement confirmed to Seacat Tuesday that the gun in question does not belong to the deceased and was not sold to the shop by Sandra Kennedy.

    He said he will amend the petition and take out any language about the guns and the pawn shop.

    The suit goes on to the ask the court to take legal action to prevent Joe and Sandra Kennedy from taking any action that could put the case in jeopardy.

    “[The] Plaintiffs seek a temporary injunction against these Defendants from transferring, conveying, encumbering, destroying or otherwise seeking to hinder, delay or defraud Plaintiffs in pursuit of their claims against the Defendant,” the suit says.

    On Tuesday, an Okmulgee District Court judge sustained the request for a temporary injunction, writing “there is sufficient, credible information provided to the Court that demonstrates that the Defendants have sold property and have attempted to convey substantial amounts of property in an effort to avoid the Plaintiff’s claims.”

    A hearing for the temporary injunction is set for Nov. 4.

    Order prevents person of interest in Okmulgee killings from selling his property

    OKMULGEE An attorney representing relatives of three of the four men found shot and dismembered in a river earlier this month convinced a judge Tuesday to issue an order barring a man who is a person of interest in the case from disposing of any property he and his estranged wife own until circumstances surrounding the men's deaths become more clear.

    Attorney Robert V. Seacat said he obtained that temporary injunction as part of a wrongful death lawsuit he filed against Joseph Lloyd Kennedy II in Okmulgee County District Court.

    Kennedy, 67, has not been charged with a crime related to the shooting deaths and dismemberments of Mark Chastain, 32, Billy Chastain, 30, Mike Sparks, 32, or Alex Stephens, 29.

    Kennedy was identified on Oct. 17 as a person of interest a few days after the men's shot and dismembered bodies were discovered dumped in the Deep Fork River a few miles outside of town.

    The following day, Kennedy was arrested in Florida after police there said they caught him driving an Oklahoma-tagged vehicle its owner had reported stolen.

    What we know about the lawsuit that was filed

    Seacat filed the lawsuit this week on behalf of personal representatives of the two Chastain brothers and Sparks.

    It accuses Joseph Kennedy of having wrongfully caused the homicide victims' deaths, creating burial expenses, mental pain, anguish, grief and the loss of companionship for both his clients and the men's relatives. Each of the plaintiffs seeks at least $75,000 in actual and punitive damages.

    On Tuesday, Seacat said he filed the lawsuit now because it appears Kennedy and his estranged wife, Sandra Jean Kennedy, are acting to protect their jointly owned assets from potential financial risks posed by legal actions like his.

    "Typically, I like to wait until investigations have been completed, the criminal cases have panned out and prosecutors have gotten their convictions," Seacat said. "But in this case, we got information that the Kennedys were liquidating their assets, and so that made us have to move quickly."

    What prompted attorney, clients to file lawsuit this week

    The petition Seacat filed Tuesday states Kennedy and/or his wife sold a Dumpster business they owned and operated to D.C. Hauling in Morris, Oklahoma, in October.

    It also states the divorce petition Sandra Jean Kennedy filed against her husband the day after he was arrested requests for her to be awarded all rights, title and interest in properties they jointly acquired in Okmulgee County and McIntosh County over the decades they were married.

    "Plaintiff verily believes there will be no insurance policy that would provide coverage for plaintiff's losses and damages, and that any damages awarded to them will only be funded by the execution of the judgment upon and the liquidation of the defendant's assets, including but not limited the real property owned by them," the lawsuit stated.

    But Blaine Frierson, the attorney representing Sandra Jean Kennedy, said late Tuesday Seacat's petition was filed prematurely.

    He said his client had no direct involvement in the Dumpster sale it refers to, adding that Joseph Kennedy had made that deal before the homicide victims disappeared on Oct. 9.

    He also said the deal only had involved a limited number of containers, according to his client.

    "My client expresses her condolences to all victims of these horrendous crimes. Unfortunately, there was a civil case filed in Okmulgee County District Court that contains patently false allegations," Frierson said.

    "Nothing about my client in the petition is true, as time will tell. We deny each and every allegation therein, and demand strict proof thereof," he said.

    No additional criminal filings made against Kennedy, records show

    As of Tuesday, no new criminal related filings have been made against Joseph Kennedy since Oct. 18, when Okmulgee County District Attorney Carol Iski requested an acceleration hearing for Kennedy.

    After pleading guilty to a felony charge of assault and battery in March 2013, Kennedy had received a 10-year deferred sentence that required him to stay in Oklahoma unless he received prior permission to leave, among other things.

    Iski told a judge that Kennedy's arrest in Florida violated that provision and asked that Kennedy be sentenced immediately for violating terms of his earlier release.

    The judge issued a warrant for Kennedy's arrest, setting bail at $500,000.

    Attempts to reach Iski or Okmulgee's police chief on Tuesday were not successful.

    Meanwhile, Joseph Kennedy remained in custody Tuesday at the jail in Daytona Beach, Florida, held on a fleeing from justice charge, along with another accusing him of felony grand theft.

    Seacat said Tuesday that Kennedy's actions after the bodies' discoveries are what led his plaintiffs to believe he was involved in what happened to the victims.

    Okmulgee DA claims Kennedy confessed to killing four men, raises bond

    TULSA, Okla. (KTUL) The Okmulgee County District Attorneys Office alleged Friday Joseph Kennedy confessed to killing and mutilating four men in October.

    The revelation was announced in an affidavit to increase Kennedys bond. The sum has been raised from $500,000 to $10 million.

    The affidavit claimed Kennedy told a woman he killed four Okmulgee men and dismembered their bodies in the early morning hours of Oct. 15, a day after the bodies were discovered in the Deep Fork River. He allegedly claimed the victims were stealing from him.

    Kent Morlan, a former Tulsa County Assistant District Attorney with 50 years of legal experience, said its important to note Kennedy is not in jail for a murder charge.

    He was on probation, Morlan explained, and going down to Florida violated the terms of his probation. So they had a basis for arresting him, to get a warrant out on him. Now theyve got him down there, in jail, on a 2012 charge, and theyre just gonna jack up the bail bond on him to where he cant get out.

    Kennedy was arrested in Florida and extradited to Okmulgee County in relation to a 2012 charge of assault and battery with a dangerous weapon. He has not been charged in relation to the four mens deaths, but the affidavit revealed what authorities believe to be the timeline of events.

    • Joseph Kennedy was seen entering his Okmulgee scrapyard on October 9th at 3 p.m.
    • The victims arrived at the scrapyard at 5:37 p.m., according to one of the victims cell phone records.
    • Gunshots were reported in the area at 6:22 p.m.
    • Kennedy was seen leaving the scrapyard, wearing a different shirt, at 8 p.m.
    • Kennedy was seen returning to the scrapyard with a pickup truck four times between 10 p.m. and 6:30 a.m. the next morning.
    • The bodies were discovered in the Deep Fork River on October 14th and could be seen from a bridge in the direction which Kennedy traveled.
    • Police also found personal items belonging to one of the victims in a field next to Kennedys scrapyard.
    • The items, also found on October 14th, were covered in what is believed to be blood.

    Because the defendant fled the state immediately after the bodies were recovered, the affidavit reads, it is believed that if he makes bond, he will again flee.

    Kennedys booking paperwork, filed upon his arrival at the Okmulgee County Jail on Nov. 12, said he had $4,214 in his inmate trust account.

    However, inmates dont actually have to pay bond in full. Most of the payment is backed by insurance, and Morlan said inmates typically pay about 10% of the bond.

    Im representing a person whos been charged with murder who had a million-dollar bond, Morlan said. He was able to put up $70,000 and hes out.

    The increase in bond means Kennedy would now be required to pay approximately $1 million in bond instead of about $50,000.

    Morlan said the smaller sum is more typical for an assault charge. He believes theres a good reason why Kennedy is yet to be charged in connection with the quadruple homicide.

    Theyve got a lot of moving parts in this thing and theyre still collecting the evidence, he explained. I think theyll probably go for capital murder in this case.

    Thats just an opinion, he continued. Everybodys entitled to one. I think theyll go for the death penalty on this guy. And if youre gonna do that, you really need to have your ducks in a row.

    Morlan said capital murder charges take more time to prepare for, which would explain why Kennedy is still being held on decade-old charges.

    In most cases like this one, theyre gonna have a lot of solid evidence, Morlan said. Obviously, they have four dead dudes, and its just a question of how they got dead and who cut them up. Its the chopping them up thats gonna get him the death penalty, in all probability.

    NewsChannel 8 asked Morlan why he believed the District Attorney will pursue the death penalty.

    Well, youre really just saying to your community, Im tough on crime. If you think this guy oughta be killed, Im with you, so Ill seek the death penalty, he said. Its a political act.

    Morlan said if he was representing Kennedy, and capital murder charges were filed, he would immediately ask for the trial to be held outside of Okmulgee County. He said its common to claim a clients reputation has been damaged and moving the proceedings would create a fairer trial.

    I would expect there will be an application for change of venue, he said, which are not frequently granted in Oklahoma. But if I were defending him, I would want to get it as far away from the Okmulgee County Courthouse as I could for trial purposes.

    Morlan said the next move for Kennedys defense should be obvious: try to keep Kennedy from speaking.

    Dont talk to anybody! he exclaimed. Particularly in jail.

    One of the allegations in the affidavit is he told somebody he killed the guys, Morlan continued. Well, it doesnt help you if youre being held in the Okmulgee County Jail and you tell other people that you have committed the crime, and those people go to the DA and say, Hey, I will tell you what he told me if you give me a better deal on the charges against me.

    Morlan said if Kennedy is charged with capital murder, his trial could end up taking years. Since pleading guilty could lead to the death sentence, defendants usually try to stretch out proceedings for as long as possible.

    Person of Interest Now Formally Charged with Murdering Four Men Who Were Found Dismembered in River

    Prosecutors have charged the man suspected of murdering and dismembering four others in Oklahoma. Joseph Lloyd Kennedy, 67, was previously locked up in Florida after authorities said he was driving a stolen car and had violated the terms of his probation for a 2013 assault and battery case.

    Speaking on Monday, Okmulgee County District Attorney Carol Iski told reporters that the four victims sustained gunshot wounds and were also transected at the waist. Mike Sparks also had both arms removed, she said.

    As previously reported, the four men were last seen leaving Billys home on bikes on Sunday, Oct. 9. Marks wife and Billys girlfriend reported the brothers and Sparks to be missing on Oct. 10. Stevens mother reported him missing that same day.

    Using an app that Mark and his wife used to keep track of each other, investigators said they traced his phone to a gas station. There, surveillance footage allegedly did not show the four missing men but depicted Kennedy standing next to his blue PT Crusader.

    From there, the phone wound up at Kennedys salvage yard, Iski said. It stopped emitting a signal there, however.

    According to the district attorney, Kennedy submitted to a voluntary interview, in which he claimed that he had been experiencing thefts from the scrapyard, but he denied seeing the men. Investigators believe that he was at the scrapyard when the Chastains, Sparks, and Stevens was there.

    Iski said that a woman, whom she only described being in a romantic relationship with Kennedy, stepped forward to tell investigators that Kennedy, acting very strangely, came to her home on the morning of Oct. 10 and left a bike for her son. Billys girlfriend would later identify this bike as his, Iski said.

    The woman also allegedly told investigators that Kennedy returned on Oct. 15. He was allegedly very agitated, told her he was leaving, and that she would never see him again.

    He told her they were all against him, and he lost it, and he just started shooting, Iski said. Kennedy allegedly told her he cut them up.

    Okmulgee Police Chief Joe Prentice previously said that the victims were planning some sort of criminal enterprise, but he did not say what.

    Iski dismissed any notion of a self-defense claim.

    Well, I would never be so bold as to predict what the defense might bring up, she said, answering a reporter, but the last time I checked, regardless of what happened, we dont have a death penalty in Oklahoma for stealing.

    Kennedy was arrested in the city of Daytona Beach Shores, Florida. Iski said he was driving a Toyota Tundra that belonged to his friend. That friend reported it stolen.

    Other evidence that the D.A. mentioned against Kennedy included blood on the ground near the scrapyard, a bullet in a tree, and 7.62 caliber rounds found near the tree. A deputy who lived near the scrapyard reported hearing 1o to 12 shots from a high-powered rifle, Iski said.
