    Death row inmate Pruett faces May 21 execution date for 1999 killing of Texas prison guard

    A condemned killer faces execution May 21 for the 1999 stabbing death of a Texas prison guard.

    The Corpus Christi Caller-Times (http://bit.ly/1ftv2EB ) reports a judge Wednesday set the execution date for Robert Pruett.

    Judge Bert Richardson ruled DNA testing would not have changed a jury's decision. Additional DNA testing ordered last year also led to inconclusive results.

    Dan Nagle was a guard at the McDonnell Unit near Beeville. Prosecutors say Pruett, who was serving 99 years for a Harris County slaying, was mad over Nagle's disciplinary report about the inmate trying to take a sack lunch to a recreation yard.

    Pruett faced execution last year but the penalty was halted to allow additional DNA testing on a partial palm print on the report. The source of the print remains unknown.

    The next hearing is set for March 12, 2014. The DNA issue will be discussed then, among other new issues in the case. There’s a chance the judge could set another execution date then, but even if he does there’s plenty of reason for hope that it won’t stick because #1) I have the right to appeal any negative ruling on the DNA issue and #2) my attorneys are preparing litigation exposing huge errors in both phases of the trial; these issues should warrant further review and ,hopefully, help me off death row and out of here someday…. I’ll keep you all posted.

    Life and Death Row: Student fights to prevent prisoner facing execution

    A UNIVERSITY student was involved in a last ditch attempt to save a death row prisoner from execution in a compelling documentary broadcast tonight.

    Kelly Hickman tried to get Robert Lynn Pruett a stay of execution as part of her volunteering work at the University of Houston's death row clinic.

    It was set up in the face of a shortage of legal counsel for prisoners facing a death sentence and to help law students hone their skills.

    Her efforts to save Pruett, who was convicted of killing prison guard Daniel Nagle in 1999, were the focus on BBC Three documentary Life and Death Row.

    He was originally sentenced to life in prison when he was 16 after the murder of neighbour Ray Yarborough at the hands of his father.

    Pruett was present at the murder but his father testified that his son did not take part in the killing of Mr Yarborough.

    Ms Hickman came to help six weeks before his execution date which was set for May 21 2013.

    Ms Hickman began by pouring through evidence and consulting Pruett's family to find out information she could use in mitigation.

    Before taking on the case, she said: "Generally when a case first comes in we pour into it.

    "We're looking for any possible avenue to get a stay of execution."

    A few hours before his murder Mr Nagle wrote a report on Pruett for breaking prison rules.

    Witnesses claimed they had seen Pruett stab Mr Nagle and that it appeared he was sitting on top of him when striking him.

    The witnesses added that it looked like the victim's body trembled as he was being hit so hard by Pruett.

    The murder weapon was recovered and next to Mr Nagle's body investigators found the report on Pruett which had been ripped up.

    Pruett claimed he did not kill Mr Nagle and never touched the disciplinary report.

    As she delved into Pruett's family history she learnt of childhood abuse which she could use in mitigation.

    The widow of Mr Nagle and their two children were interviewed in the weeks leading up to Pruett's planned execution.

    Son Michael Nagle said: "The first memory I have of [my father], I do remember being at his funeral."

    The children were raised by their grandparents after they lost their father at a young age and then their mother was placed in jail.

    Before any execution there is a clemency stage where the state governor can reduce any death penalty to life in prison without parole.

    Mr Nagle's sister Della Nagle and her daughter Julianna supported Ms Hickman's efforts to stop Pruett's execution.

    Ms Nagle said: "When Kelly called me and asked me to write a letter I was so angry. I wanted retribution. I wanted to go down there and strangle him myself.

    "And then I realised this boy has family and you want to murder him and you want to be happy that you're murdering him and making a hole in his family like the hole that is in ours."

    After weeks of efforts from the law student Pruett was given a sixty day reprieve.

    She said it was "the best feeling" in the world after breaking the news to Mr Pruett's mother.

    It was given so further DNA testing could be conducted which could take up to a year.

    After hearing the news, Ms Nagle said: "I always knew the right guy was in jail.

    "And now they're telling me it might not be and my question is why are you telling me this now?"

    The victim's widow Crystal added: "Robert Pruett has to live with his conscience. When he sleeps at night I hope he has nightmares. I'm sure he does."

    While his son said: "He's still rotting. Is there anything I can do? No. Can I keep on living my life? Yes."

    Death penalty attorney David Dow said doing the line of work Ms Hickman does requires an "emotional resilience".

    He said: "Doing the work requires a certain emotional resilience that is common to death penalty lawyers.

    "For every reprieve that you get you have nine clients that are executed. If you are going to stay in this line of work as a matter of survival you narrow your emotional range.

    "You don't go out celebrating when you get a stay because the flip side is when you don't you jump off of a bridge."

    I'm finding myself struggling with 2 cases out of the many i have gone through, Pruett being one of them, not due to the BBC show recently aired as I am not shouting his innocence, I do think there are some facts that cast a little doubt. The BBC documentary did have me researching him.
    That aside and firstly a little about me to understand my thinking.
    Some 30 years ago in my stupid youth I spent time in an old Victorian prison in London 23hr bang up, slop out 3 times a day to empty the bucket, no toilet, Tv, electric, slop for food etc.. When I look at the DP pen pal site most of them are quoting size of their cell and the hours being alone, it's not inhumane, why would you want to go and mix with the rest of the scum unless your one of them...
    Back to Pruett or Robert as I shall now call him.
    My Son Connor was 14 when he passed away over a year ago, not due to crime, he had severe epilepsy, a seizure took him away. He was a very innocent little man it has ripped me apart.
    I find myself looking at Robert at 15yrs being brought up by trash knowing nothing,a child still, immature, in an environment that calls for being hard, flash and drug fuelled looking up to his scum peers. 15 years old! Arrested and sentenced to 99 years leaving him to fight his way through a mans prison as a vulnerable boy. He maybe an adult now but still a child in life and mind not able to grow in the free world we know. He may or may not of murdered Nager but he was convicted by a jury, he is guilty. Who neutered the killer. The trash life? The father? The State?
    He is an adult to look at but in his mind still a stupid teenager in my opinion
    I feel it will be a sad day when he is executed and feel other parties should reach into their heart and part blame themselves

    Pruett murdered a corrections officer because he didn't get his hot lunch and couldn't take his sack lunch in the rec room and was going to be written up.

    I get what you are both saying and I didn't need to "click that" as I have been there, I'm not arguing what he has done nor the doubts as I see most of them are crying their innocence and its ridiculous, especially the ones pretending they accidentally killed their child, if I had accidentally killed my son I'd be the first to end my life... Yet there they are all smiles 'spray string over graves' etc...).
    But yes I do feel when he was sentenced originally to this parties thing with 99yrs must of fried him. He was 15 when he was nicked, a child. Stupid and trying to be a man.
    Yep been found guilty of killing a guard, only capital punishment is the sentence and its just terrible a man doing his job is killed for it. The family would hate me for feeling this way, an by god I feel for the Nagel family, listening to his little boy was heart breaking...

    Robert Pruett was incarcerated as a child only a year older than my little man who use to snuggle up to me, com on 99 years, his brother only got 40yrs.
    If that young lad hadn't received that ridiculous sentence? We can only speculate.

    OK..........do you believe at age 15 Mr. Pruett knew or could tell the difference between right and wrong, if your answer is yes......then his actions, decisions, choices must of necessity have consequences.

    I'm sure he could, though a back yard scrap turns into a murder due to his coward of a father stabbing the guy umpteen times.
    Hey people I'm not here to be attacked is this a forum to discuss or just be angry?
    Maybe I'm just feeling soft being that my son died at 14 and he was only 15 when he got put away. He had a trailer park trash up bringing, a lot different than my son, and he is well into his adulthood now as he was when he killed Daniel Nagel.
    My only thinking is if he hadn't of received that rough justice originally

    P.S. Am I allowed to discuss the other one of the two I'd like to question or would you prefer me to shout kill him/her on the other 43 I have researched first?
