    Champion man, 21, attends hearing in murder case

    WARREN — A 21-year-old man facing death-penalty level charges in the July 2022 fatal shooting in front of a popular Warren eatery appeared in Trumbull County Common Pleas Court for a pretrial hearing on Wednesday.

    Dominic M. Harvey, 21, of Hillsdale Drive NW, Champion, stood before Judge Cynthia Rice with his attorney, Morgan Caruso, as lawyers updated the judge on the case. Caruso said she is not ready to decide on any possible expert witnesses.

    She and assistant Prosecutor Christopher Becker updated the judge on what evidence has been exchanged.

    Harvey faces charges of aggravated murder, attempted aggravated murder, tampering with evidence and receiving stolen property. A jury trial is scheduled for Aug. 21 in Rice’s courtroom. The murder charges carry aggravating circumstances; if Harvey is found guilty, these would make him eligible for the death penalty.

    About 6 p.m. July 21, 2022, gunfire rang out on the street as the dinnertime crowd was at the Hot Dog Shoppe on West Market Street.

    Jauton Lee Jr., 23, was fatally shot and 24-year-old Mitchell Powell was wounded as they were in a vehicle that was struck by bullets near the restaurant. Through the help of video cameras and eyewitness accounts, Warren police detectives pieced together the crime and charged Harvey, who was arrested the day after the shooting.

    Judge Rice set the next pretrial for 11 a.m. May 8.

    Expert witness granted in fatal Warren shooting trial

    WARREN, Ohio (WKBN) – The attorney representing the man charged with capital murder stemming from a deadly shooting in Warren last July has asked the court to pay for an expert witness.

    Judge Cynthia Westcott Rice granted attorney Morgan Caruso’s ex parte motion on Wednesday. It allows the defense to have money to hire a mitigation specialist in Dominic Harvey’s case, which is scheduled to go to trial on Aug. 21.

    Harvey is charged with aggravated murder, attempted aggravated murder, tampering with evidence and receiving stolen property.

    He was arrested hours after the July 21 shooting on West Market Street near the Hot Dog Shoppe that killed Jauton Lee and hurt a 24-year-old man.

    Harvey could face the death penalty if convicted. He’s due back in court for another pretrial hearing on June 21.

    Murder defendants request mitigation expert

    WARREN — Three people facing death penalty-level criminal charges, including two accused in the arson death of a Warren G. Harding High School student, have asked the court to allow them to have a mitigation specialist.

    A mitigation expert is sought by a criminal defense team to help gather background information about the defendant that could be used to convince a jury not to impose the death penalty.

    Attorneys for Patricia Zarlingo, 27, and Brendan M. Daviduk, 28, asked for the specialist ahead of their next pretrial hearing June 14 before Trumbull County Common Pleas Court Judge Sean O’Brien.

    That request and other motions made by the defense will be discussed at the hearing. If a specialist is approved, those services would be paid for by the court.

    Also, the defense for Dominic M. Harvey, 23, who is accused in the July 2022 fatal shooting outside a popular Warren restaurant, requested the same.

    Zarlingo, Daviduk and Zackary Gurd, 23, also of Youngstown, face two counts of aggravated murder with death penalty specifications, two counts of attempted aggravated murder, first-degree aggravated arson, second-degree aggravated arson, aggravated burglary and tampering with evidence. The aggravated murder specifications state that a felony was committed in the act of the murder.

    They are accused of starting the a Jan. 19 house fire on Nevada Avenue NW that killed 16-year-old Chassidy Broadstone, a Warren G. Harding High School junior, and hospitalized her two sisters.

    Judge Cynthia W. Rice is hearing the case against Gurd.

    OTHER CAPITAL CASE

    Harvey’s request to hire a mitigation specialist ahead of his pretrial hearing June 21 was granted Wednesday by Rice. A jury trial is scheduled to start Aug. 21.

    He is charged in connection to the shooting death of Jauton Lee Jr., 23, in front of a West Market Street fast food restaurant. Harvey is being held in the Trumbull County jail without bond.

    Warren murder trial with possible death penalty delayed

    WARREN, Ohio (WKBN) – The trial against the man charged with capital murder in connection to a deadly shooting in Warren has been delayed about five months.

    Dominic Harvey will now stand trial on January 15, 2024.

    Harvey was indicted on charges of aggravated murder, attempted aggravated murder, tampering with evidence and receiving stolen property. He was arrested hours after the July 21, 2022 shooting on West Market Street that killed Jautori Lee and hurt another man.

    Harvey could face the death penalty if convicted. He’s scheduled to be back in court on August 21.

    Attorney lining up psychologist in Warren capital murder case

    WARREN, Ohio (WKBN) – The attorney representing Dominic Harvey in his capital murder case says she’s in the process of obtaining a psychologist for the defense.

    Harvey is charged with aggravated murder, attempted aggravated murder, tampering with evidence and receiving stolen property in connection to a July 21, 2022, shooting on West Market Street in Warren.

    Jauton Lee was killed in the shooting, and a 24-year-old man was hurt.

    Harvey is now scheduled to stand trial on January 16. He’s due back in court for another pre-trial hearing on November 27.

    Warren murder defendant avoids death sentence with plea

    WARREN, Ohio (WKBN) – Dominic Harvey’s capital murder case has ended with the defendant changing his plea.

    Harvey pleaded guilty to an amended indictment that removed the death penalty specification. By pleading guilty, Harvey acknowledged his part in the July 21, 2022, shooting on W. Market Street in Warren that killed Jauton Lee and hurt a 24-year-old man.

    “I don’t think anyone in the state of Ohio should get the death penalty, and I’m really thankful that through this outcome, my client was able to avoid it,” said Attorney Morgan Caruso.

    Prosecutors say Harvey used a stolen AR-15 during the commission of the crimes.

    “I’m sorry things went how it went. I wish things could have went differently,” Harvey said. “I take full responsibility for my actions. I’m sorry.”

    The courtroom was filled with Jauton Lee’s family. Lee’s father Jauton Lee, Sr. addressed Harvey directly.

    “You killed my son, my best friend, my world,” Lee said while looking directly at Harvey. “Personally, I don’t think they gave you enough time. I can’t get my son back.”

    Judge Cynthia Westcott Rice sentenced Harvey to the jointly recommended sentence of life in prison with parole eligibility after 50 to 55 and a half years. He’ll also have to register as a violent offender.

    “I really do hope Dom rots in hell for the rest of his life. I hope his family hurt just as we hurt, and I don’t ever want to see him outside of them cells again,” said Jau’Tiana Lee, Lee’s sister.

    “God gonna give him his time because he took somebody very special away from us,’ said Wynette Jackson, Lee’s grandmother.

    “He will spend the rest of his life in prison, and Mr. Harvey deserves to die in prison and hopefully that’s exactly where he will be,” said Assistant Trumbull County Prosecutor Chris Becker.
