    Gregory Russeau - Texas Execution - June 18, 2015




    Summary of Offense:

    A Smith County jury found Gregory Russeau guilty of the May 30, 2001 capital murder of James Syverston in 2002. Russeau beat the 75-year-old Syverston to death in his Tyler auto repair garage. The jury answered the special issues in such a way that the trial court was required to sentence him to death.

    In 2005, the CCA affirmed Russeau's conviction, but reversed as to punishment because the State had introduced jail records that contained narrative descriptions of Russeau's jail infractions. The jury again answered the special issues against him, and the trial court again sentenced him to death. Ultimately, the CCA affirmed in an opinion authored by Judge Holcomb and joined by six of the other judges. Judge Johnson joined most of the opinion, but concurred on the issue of future dangerousness. Judge Keasler also concurred. Neither wrote an opinion.

    On August 25, 2010, Russeau was denied a writ of habeas corpus by the Texas Court of Criminal Appeals.

    In today's Texas Court of Criminal Appeals orders, Russeau's application for writ of habeas corpus was denied.

    On January 22, 2013, Russeau filed an appeal in the US Court of Appeals for the Fifth Circuit over the denial of his habeas petition in Federal District Court.

    East Texas Man on Death Row Loses Federal Appeal

    A federal appeals court has rejected an appeal from a 44-year-old East Texas man condemned for the slaying of an auto mechanic during a robbery in Tyler more than a decade ago.

    The 5th U.S. Circuit Court of Appeals ruling late Monday moves Gregory Russeau a step closer to execution for the fatal beating of 75-year-old James Syvertson at his shop. His wallet and car were stolen. Russeau was arrested the next day in Longview in the stolen car.

    Russeau's initial death sentence was thrown out on appeal and he was sentenced a second time.

    He unsuccessfully argued his trial legal help was deficient, that trial prosecutors used planted evidence and lawyers at his second punishment trial had a conflict because they also represented him at his first trial.

    In today's orders, the United States Supreme Court declined to review Russeau's petition for certiorari.

    Appeals exhausted. Ruling could result in an execution date.

    The U.S. Supreme Court has rejected an appeal from an East Texas man condemned for the slaying of a 75-year-old auto mechanic during a robbery in Tyler more than a decade ago.
