    A Blount County jury voted 11-1 today to recommend Thomas Crowe, 34, be executed for his part in the brutal 2009 Thanksgiving Day slaying of 71-year-old Marvin Allen Dailey, Blount County District Attorney Pamela Casey said.

    Crowe was convicted Wednesday on three counts of capital murder in Dailey's death.

    Dailey was bludgeoned, likely with a hatchet or other sharp object, and burned alive in his home on Nov. 26, 2009.

    Each of the three counts represents the other crimes committed that morning -- robbery, burglary and arson.

    A judge will decide whether to accept the jury's death sentence at a Dec. 11 sentencing hearing, Casey said.

    Another suspect in the case, Toni Michelle Collins, 36, in May 2011 pleaded guilty to murder, according to court records.

    Crowe and Collins were arrested a few days after Dailey's murder.

    Collins testified in Crowe's trial, but has not yet been sentenced. As part of the plea agreement, prosecutors agreed to recommend a life sentence for Collins, records showed.

    Casey said she expects Collins to be sentenced soon.

    Thomas Crowe was sentenced to death today in the brutal 2009 Thanksgiving Day slaying of 71-year-old Marvin Allen Dailey, Blount County District Attorney Pamela Casey said.

    Blount County Circuit Court Judge Steven King followed the jury recommendation made in September.

    "As Mr. Crowe's attorneys, it goes without saying that we disagreed with the original jury finding of guilt and are disappointed in today's decision of the Judge to impose a sentence of death in this case," said attorney Steven Goldstein.

    "The judge's decision to follow the jury's recommendation of death in this case was appropriate. Mr. Dailey suffered a cruel death at the hands of Thomas Crowe. As I argued to the judge, murder is the taking of innocent life. The death penalty is putting to death the murderer of an innocent person," Casey said.

    Court reverses Blount County death penalty case

    MONTGOMERY, Ala. (AP) - An Alabama appeals court has struck down one death penalty conviction and re-instated another.

    The Alabama Court of Criminal Appeals on Friday reversed the capital murder conviction and death sentence that Thomas Doyle Crowe received for the November 2009 killing and robbery of Marvin Dailey in Blount County. The appeals court said the trial judge gave improper instructions to the jury about Alabama's capital murder law.

    The appeals court ordered the capital murder conviction and death sentence be reinstated for Emanuel Aaron Gissendanner Jr. in Dale County. A lower court had ruled that he should get a new trial because of ineffective attorneys at trial. The appeals court reversed that in a 3-2 decision.

    Gissendanner was convicted of killing Margaret Snellgrove during a kidnaping and robbery in November 2009.

    State inmate found dead in Donaldson prison cell identified as Blount County man convicted of murder

    A state inmate found dead in his cell at William Donaldson Correctional Facility in western Jefferson County has now been identified.

    The Jefferson County Coroner’s Office identified the inmate as Thomas Doyle Crowe. He was 45.

    Crowe was found unresponsive in his cell about 11:30 p.m. Wednesday. Correctional officers made the discovery.

    He was pronounced dead at 11:45 p.m.

    Yates said cause of death has not been determined but there were no signs of foul play or trauma.

    Crowe and Toni Michelle Collins, 36, were charged with capital murder on Dec. 1, 2009, after 71-year-old Marvin Dailey was found dead on Thanksgiving Day.

    Firefighters found Dailey shortly after they were called to his home about 2 a.m. on Nov. 26, 2009. He lived just off Blount County 29, about 6 miles north of Oneonta.

    Dailey was bludgeoned, likely with a hatchet or other sharp object, and burned alive in his home, police said.

    A jury in 2012 convicted Crowe on three counts of capital murder - one each for robbery, burglary and arson - and voted 11-1 to recommend that Crowe be executed.

    Blount County Circuit Court Judge Steven King followed the jury’s recommendation, sentencing Crowe to death.

    Crowe was later granted a new trial due to jury instructions by the judge. He pleaded guilty and was sentenced to 50 years in prison.

    Collins is serving life in prison.
