    Louisiana man gets death in church worker's murder

    A Louisiana man who murdered 77-year-old Betty Blair has been sentenced to die for his role in the strangulation and robbery of the Pasadena church worker, school teacher and community leader.

    Roosevelt Smith Jr., 43, is appealing the sentence announced Tuesday by a 9-woman, 3-man jury, after a 19-day trial.

    Smith, of Napoleonville, La., relocated to the Houston area in the wake of Hurricane Katrina, claiming to be a storm evacuee to get rent money and other financial aid.

    He rented an apartment in Pasadena at 900 Randall along with Jimmy Hoang Le and Stephanie Jacobo, both 18, from Beaumont, who claimed to be evacuees of Hurricane Rita.

    Blair, an active member of St. Pius V Catholic Church, met the three while helping evacuees. She hired them to do yardwork and odd jobs at her house, where she lived for 40 years.

    Blair was found dead in her home by one of her 3 daughters. She had been hit in the head and strangled, first by hand, then by a telephone cord.

    Her wedding ring, jewelry, purse, computer, television, video equipment and 2000 Buick were missing.

    Using a locating device in her car, police arrested the three that night at a toll booth on the West Sam Houston Parkway.

    Le is scheduled to go to trial in January and Jacobo in March.

    Harris County Assistant District Attorneys Maria McAnulty and Brad Hart prosecuted what McAnulty described as "a sad story, a tragic story."

    "Betty Blair was a fine lady," McAnulty said. "She felt it was her obligation to give back to her community and she did that every day of her life."

    Gerald Bourque, Smith's court-appointed attorney, said it was a "difficult case" because "it's hard for people, it's hard for 12 citizens who get up every day and go to work to ever be able to relate to a defendant like Roosevelt."

    Smith was "a vagabond," who had been physically and sexually abused by the adults in his family at age 6, Bourque said.

    "This kid never had a chance. The problem is, when he's 43, you can't see him as a 6-year-old kid crying for help," Bourque said.

    Smith probably would never have left Louisiana if not for Hurricane Katrina, Bourque said.

    "He sees FEMA money being thrown at this situation, and he got the apartment in Pasadena," Bourque said.

    McAnulty said evidence in the case was "strong." And, the jury also heard that Smith "had been in and out" of the Louisiana prison system for the past 19 years on 3 burglary convictions.

    In today's United States Supreme Court orders, Smith's petition for a writ of certiorari and motion for leave to proceed in forma pauperis DENIED.

    A Louisiana man's death sentence in Texas has been reduced to life in prison without parole in the killing of a woman who helped him when he relocated after Hurricane Katrina.

    Attorneys for 50-year-old Roosevelt Smith Jr. contended he's mentally impaired and ineligible for execution under Supreme Court guidelines.

    A state-appointed psychologist determined Smith was impaired. The Texas Court of Criminal Appeals on Wednesday agreed.

    Smith, who was from Napoleonville, La., was condemned for beating and strangling 77-year-old Betty Blair in October 2005 at her home in Pasadena, just east of Houston. She'd been helping evacuees at a church and hired Smith and others to do odd jobs. He earlier had several burglary convictions and prison stints in Louisiana.
