    Kent William Sprouse - Texas Execution - April 9, 2015

    Facts of the Crime:

    On October 6, 2002, in Ellis County, Sprouse was experiencing car trouble at a gas station. He approached a customer and asked for assistance. When the customer was not able to repair his vehicle, Sprouse shot a man, Pedro Moreno, who was filling his car with gas. The store clerk called the police. Upon arrival, Sprouse shot the responding 28-year-old police officer, Harry Steinfeld III, resulting in his death.

    Sprouse was sentenced to death in March 2004.

    On February 17, 2010, Sprouse filed a habeas petition in Federal District Court.

    On March 29, 2013, Sprouse's habeas petition was denied in Federal District Court

    On May 3, 2013, Sprouse filed an appeal in the US Fifth Circuit Court of Appeals over the denial of his habeas petition in Federal District Court

    The US 5th Circuit Court of Appeals will hold a special hearing regarding Sprouse's appeal on January 21, 2014.

    Today, the US 5th Circuit Court of Appeals denied Sprouse a COA and affirmed the denial of his federal habeas petition.

    In today's orders, the United States Supreme Court declined to review Sprouse's petition for certiorari.

    Appeals exhausted. Ruling could result in an execution date.

    Texas death row inmate loses at Supreme Court

    The U.S. Supreme Court has refused to review an appeal from a 42-year-old man sent to death row for killing a North Texas police officer and another man in a shootout at an Ellis County convenience store 12 years ago.

    The ruling without comment from the justices Monday moves Kent Sprouse a step closer to lethal injection.

    Evidence showed Sprouse had been using drugs and marijuana within 48 hours of the slayings of 28-year-old Ferris police officer Harry Steinfeldt and a convenience store customer, 38-year-old Pedro Moreno of Red Oak.

    Moreno was shot while pumping gas. Steinfeldt was fatally shot as he responded to a 911 call about Moreno's shooting.

    Attorneys argued jurors deciding his punishment should have been allowed to consider voluntary intoxication as a reason for Sprouse's actions.

    As per the TDCJ, Sprouse has been given an execution date of April 9, 2015.

    Due to Randall Mays' halt of execution on March 18, Sprouse would ultimately receive the last remaining dose of Pentobarbital for now set for April 9.
