    On November 21, 2004, in Bexar County, Young, in the course of a robbery, fatally shot and killed Hasmukhbhai Patel, 55.

    Young was sentenced to death in February 2006.

    O R D E R

    In February 2006, a jury found applicant guilty of the offense of capital murder. The jury answered the statutory punishment questions in such a way that the trial court set applicant's punishment at death. This Court affirmed applicant's conviction and sentence on direct appeal. Young v. State, No. AP-75,352 (Tex.Crim.App. April 22, 2009). On June 23, 2009, this Court remanded applicant's case to the trial court and ordered the case returned to this Court on or before September 26, 2009. It has been more than two years since the application was remanded. Accordingly, we order the trial court to resolve any remaining issues within 90 days from the date of this order. The clerk shall then transmit the complete writ record to this Court within 120 days from the date of this order. Any extensions of time shall be obtained from this Court.

    HOUSTON (AP) — A federal appeals court wants further examination of claims that Bexar County jurors may have received incomplete instructions when they decided to send a convicted killer to death row a decade ago.

    Lawyers for 32-year-old Christopher Anthony Young argued to the 5th U.S. Circuit Court of Appeals that jury instructions at his 2006 trial failed to include required guidance about whether mitigating evidence presented during the trial's punishment phase could justify a life prison sentence. Attorneys also contended his trial lawyers were deficient for not spotting the instruction lapse.

    State courts and a lower federal court had declined similar appeals from Young.

    S.A. Death Row Inmate’s Appeal Rejected

    No reprieve for a San Antonio man on death row.

    33-year-old Christopher Young’s attorneys argued that the jury instructions at Young’s 2006 trial in Bexar County were incomplete.

    They say required guidance about mitigating evidence presented during the punishment phase justified life in prison.

    The 5th Circuit Court of Appeals agreed to review the questions brought up by Young’s lawyers but on Tuesday affirmed a federal district judge’s decision to reject the claims.

    Young was found guilty of killing a San Antonio convenience store owner during a 2004 robbery.
