HOUSTON (AP) - The U.S. Supreme Court has refused to review an appeal from an East Texas man on death row for killing two men days apart during a crime trek across the state more than 14 years ago.
The high court made no comment Monday in its decision on the appeal from 32-year-old Clinton Lee Young.
The ruling upholds a federal appeals court's rejection last summer of arguments that Young had deficient legal help at his 2002 trial in Midland and that prosecutors improperly withheld evidence.
Young, from Ore City in Upshur County, was convicted and condemned for the November 2001 fatal shootings of Doyle Douglas in Longview and then Samuel Petrey a day or two later in a Midland oilfield after carjacking him in Eastland, about 53 miles east of Abilene.

Judge signs execution warrant for Clinton Young
Judge Robert Moore, visiting judge for the 238th District Court, issued a warrant of execution on Monday for Clinton Lee Young, according to the Midland County District Attorney’s Office. The 33-year-old has an execution date of Oct. 26 at the Texas Department of Criminal Justice Huntsville Unit.
Young was sentenced to death in 2003 after he was convicted of the 2001 murders of Doyle Douglas and Samuel Petrey — who were killed near Midland — according to previous Reporter-Telegram reports. Young is being held at the Polunsky Unit in Livingston, according to TDCJ records.

If this is all true, I can guarantee that the TCCA will stay this. I wasn't holding my breath for this to happen anyway. Considering how unreliable Texas has become, I take every execution date they set with a grain of salt. This is no exception.

He has a better case than Pruett or Reed, that's for sure.
Young has very strong exculpatory ballistic evidence based on hard science that was not presented at trial, and which heavily implicates his co-conspirator, who has since confessed to making a deal. The other cases, and I'll throw in Hank Skinner as another example, claim an extraordinary series of coincidences left them victims of an elaborate network of corrupt police officers and lawmakers.
IMO Young should be in jail but not on the gurney.

Young shouldn't be on death row given the evidence. I think (and hope) he gets commuted.
Hearing scheduled in Clinton Young case
A hearing is scheduled this month for Clinton Lee Young -- the only current death row inmate who was convicted in Midland County. An order for the hearing signed by Judge Robert H. Moore, presiding by assignment, came after evidence was tested, according to court documents.
The hearing in the 385th Judicial District Court will allow parties to present documents and witness testimony and hear counsel arguments, according to the order. The hearing is set for Oct. 16, 10 days before Young’s execution date at the Texas Department of Criminal Justice Huntsville Unit.
Young, 34, was sentenced to death in 2003 after he was convicted of the murders of Doyle Douglas and Samuel Petrey.
Young’s attorneys submitted a motion to the 385th Judicial District Court to “withdraw or modify the execution date,” according to a document filed Aug. 28.
The motion states a pair of gloves found near Petrey’s body contained DNA from David Lee Page, a co-defendant in the case.
Moore signed an order on May 25 granting Young’s motion to authorize the release of the gloves for independent examination, according to a document.
The gloves weren’t tested for gunshot residue before trial but were tested in 2015, according to the motion filed Aug. 28.
After additional testing, the gloves were found to contain gunshot residue “in locations and in amounts that are most likely the result of the shooter wearing them,” the motion states. Other new evidence includes Page’s admissions to people, according to the document.
Both Douglas and Petrey were fatally shot during a 2001 crime spree, according to previous Reporter-Telegram reports. Douglas, 41, was killed near Longview, and Petrey, 52, was kidnapped in Eastland and killed in an oilfield near Midland, according to the reports.
Young’s warrant of execution was signed in June, and the date was set for Oct. 26. Young is being held in the Polunsky Unit in Livingston as of Friday, according to TDCJ records.
Page, 35, was serving a 30-year sentence for aggravated kidnapping as of Friday, according to TDCJ records. Moore signed an order that was filed on Sept. 15 granting use immunity — except for perjury — to Page as a witness at the hearing.
