    Killer of Phoenix officer gets death penalty

    A Maricopa County Superior Court jury deliberated only a few hours Wednesday to bring back a death penalty for convicted cop killer Donald Delahanty.

    But it might have been a foregone conclusion. Delahanty, 22, was found guilty of first-degree murder on May 5 for shooting to death Phoenix Police Officer David Uribe during a traffic stop in May 2005.

    Delahanty did not contest that there were aggravating factors in the murder, among them that he had killed a police officer in the line of duty. And then he waived his right to present mitigating evidence to the jury to convince them to send him to prison for life instead of to Death Row.

    Delahanty still awaits sentencing on five other counts - one for arson of an occupied structure, for trying to set fire to the car in which he was riding when he shot Uribe; and two each of conspiracy to commit first-degree murder and solicitation to commit first-degree murder, for plotting to kill his accomplice and the man's mother.

    On May 10, 2005, Uribe, 48, a 22-year veteran of the police force, spotted a car driven by Delahanty's friend, Christopher Wilson, and followed it as it exited Interstate 17. He ran a check of the car's license plate, determined the plate was stolen and stopped the car near Cactus Road and 31st Avenue.

    Delahanty was sitting in the passenger seat and a third young man was riding in the backseat. Both Delahanty and Wilson were carrying guns.

    According to trial testimony, Wilson handed his gun to Delahanty with the intention of hiding it from Uribe.

    Uribe then asked Wilson for his driver's license and told him to turn off the car. Delahanty lunged in front of Wilson and shot Uribe three times in the head, neck and face.

    Wilson then sped off, but after traveling a few blocks, the men abandoned the car and Delahanty attempted to set it on fire by shooting at the gas tank.

    The men went to the home of a former Arizona Department of Corrections officer, David York, who hid a gun they were carrying and burned their clothes to destroy evidence. Two days later, Delahanty and Wilson were arrested at a mobile-home park.

    In 2005, York, 45, was sentenced to 3˝ years in prison for his role.

    Wilson, 31, pleaded guilty to second-degree murder in 2006, and agreed to testify against Delahanty.

    Then in December 2007, investigators learned that Delahanty had enlisted a girlfriend to help hatch a plan to keep Wilson from testifying -- either by having Wilson's mother killed so that he would become distraught and commit suicide, or by having someone kill Wilson.

    Convicted cop killer receives additional life sentence

    Cop killer Donald Delahanty already has been sentenced to death for the May 2005 murder of a Phoenix Police officer.

    But on Tuesday morning, he got an extra life sentence for good measure.

    Delahanty, 22, was found guilty May 5 of 1st-degree murder for the shooting death of Phoenix police Officer David Uribe during a traffic stop.

    Under Arizona law, juries impose death sentences. But Delahanty still needed to be sentenced for the other crimes for which he was convicted: attempted arson, 2 counts of conspiracy to commit 1st-degree murder and 2 counts of solicitation to commit 1st-degree murder.

    The attempted arson took place when Delahanty tried to burn the car in which he and 2 other men were riding when he shot Uribe. The conspiracy and solicitation counts stem from Delahanty's plot from prison to have his accomplice, Christopher Wilson, and Wilson's mother killed.

    Judge Warren Granville sentenced Delahanty to 7 ˝ years in prison for the arson charge, followed by 2 concurrent life sentences with chance of parole after 25 years for conspiracy and 3 ˝ years for each of the solicitation counts. Wilson, 31, was allowed to plead guilty to 2nd-degree murder in 2006 in exchange for his testimony. He is scheduled to be sentenced on July 24.

    Donald Delahanty, who senselessly ended veteran Phoenix police officer David Uribe's life in May 2005, will continue residing on death row after the Arizona Supreme Court today upheld his conviction.

    ​ The state's highest court ruled that the 24-year-old former Glendale resident received a fair trial and a just sentence after he was charged in Officer Uribe's murder during a routine traffic stop.

    We know this case well, as we were hanging with Phoenix homicide detectives when word of the tragic shooting came in, and tracked every move during the dramatic investigation.

    Here is the story we wrote about the murder, which we called "The Case of the Grim Tweaker."

    Delahanty, who was in the front passenger seat of a car driven by cohort Chris Wilson, shot Officer Uribe three times after the routine stop on West Cactus Road and 35th Avenue.

    The reason?

    None -- Delahanty was methamphetamine-fueled with a loaded gun at his beck and call and a hankering to kill a cop.

    A jury convicted Delahanty of first-degree murder, attempted arson (of the car he was riding in), conspiracy to commit first-degree murder, and solicitation to commit murder. The latter charge came while Delahanty was in jail awaiting trial -- he sent letters to a girlfriend seeking to have Chris Wilson (who had plea bargained and was about to testify against his ex-buddy) and Wilson's mother killed.

    Delahanty's appellate attorney didn't raise many compelling issues, and Justice Andrew Hurwitz disposed of all of them in a 19-page opinion -- short for death-penalty rulings.

    The defense contended that trial Judge Warren Granville should have allowed the jurors to consider less-serious murder offenses, specifically second-degree and manslaughter, instead of just first-degree murder.

    Not so, Justice Hurwitz concluded, and his four colleagues on the bench agreed.

    "The evidence does not support Delahanty's contentions," he wrote. "Delahanty shot Officer Uribe three times at close range in the face and neck during a routine traffic stop, actions almost certain to bring about death.

    "Officer Uribe was in full uniform and driving a marked police cruiser with its lights engaged. Delahanty undoubtedly knew he was shooting a police officer. Moreover, Delahanty shot Officer Uribe after telling [another passenger in the car] that if he was ever pulled over by an officer, `I would shoot him, I would kill him,' and after telling another friend that he would `shoot to kill when he got pulled over.'"

    Delahanty's statements "did not suggest anything other than intent to kill. There was no evidence that Delahanty acted in a simply reckless manner."

    What a waste of a good man's life. Dave Uribe's, of course.

    In today's United States Supreme Court orders, Delehanty's petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    On April 1, 2022, Delahanty filed a habeas petition in Federal District Court.
