Derrick Utsey’s Killer Gets 50 Years

Saline County Prosecuting Attorney Ken Casady announced today that Jason Lee Taylor, 30, pled guilty to Murder and Kidnapping.

Circuit Judge Gary Arnold accepted the State’s recommendation and sentenced Taylor to fifty years’ incarceration at the Department of Correction to be followed by thirty years’ suspended imposition of sentence.

After a trial in June 2009, Taylor was convicted of the Murder and Kidnapping of Derrick Utsey and sentenced to death. Taylor met Utsey in the parking lot of a motel in Little Rock. He later tied up Utsey and placed him in the bed of his truck with the help of his accomplice Bradley Carter. Taylor and Carter beat Utsey with the butt of a handgun and later shot and killed Utsey.

Following his trial, the Arkansas Supreme Court affirmed Taylor’s conviction and sentence. During the course of his appeals, Taylor’s attorney at trial, Dustin Dyer, was indicted for several drug offenses. In 2011, Taylor requested that his conviction be overturned due to Dyer’s arrest and Dyer providing ineffective assistance at trial.

Casady stated that he absolutely believes that Taylor is guilty and deserving of the death penalty. He stated, “a Saline County jury reviewed the evidence, listened to the testimony, and decided that death was an appropriate punishment.” The guilty plea puts an end to the case and gives some closure to the family. Casady said that neither he nor the family was completely satisfied with this result, but it was best choice given the circumstances.

According to Casady, he was left with no good options after Dyer pled guilty to conspiracy to distribute methamphetamine in federal court. Casady stated that he was not confident that some court would not reverse the conviction down the road. “Dyer’s actions at trial and subsequent conviction jeopardized the verdict even though every other part of the trial worked as it should. This was not a case of a criminal making frivolous claims about the fairness of the death penalty. Trial counsel’s failings are yet another bite at the apple that killers can rely upon in pursuing endless appeals and avoiding the death penalty.”

Deputy Prosecuting Attorneys Rebecca Bush and Brian Clary handled the proceedings for the State. Defense attorneys Toney Brasuell and Patrick Benca were appointed to represent Taylor for purposes of post conviction.

An inmate from Saline County apparently committed suicide on Thursday at the Maximum Security Unit at Tucker.

Staff observed Jason Lee Taylor unresponsive in a locked single-man cell. Taylor was taken to the infirmary and pronounced dead at 4:31 p.m.

The Arkansas State Police was notified and is conducting an investigation into the death. The Department of Corrections will be conducting an internal investigation into the death.
