    Death Row Inmates Jones, Williams Denied Motions for Preliminary Injunctions

    LITTLE ROCK, Ark. - Legal proceedings ahead the remaining scheduled executions are beginning to stir.

    District Judge Kristine Baker denied Thursday the motions for preliminary injunctions filed by Inmate Jack Jones and Inmate Marcel Williams in their claims that the drug midazolam will not work on them due to their obesity.

    Jones and Williams are both scheduled to be executed Monday, April 24.

    The court determined that the evidence presented in the hearings fell short of demonstrating a significant possibility that the Arkansas protocol is ‘sure or very likely’ to cause severe pain and needless suffering. Therefore, the motions were denied.

    Do we know which one is executed first? I assume one is scheduled for 7 pm and one for 9 pm.

    Would that also mean that the one who is scheduled for 9 pm has 2 hours less to be executed, or does the warrant expire later?

    If they both expire at midnight, then I guess the second one has a good chance to prevent the execution from happening if SCOTUS has to consider a flurry of appeals of two different inmates in such a short amount of time.

    Two Arkansas inmates slated for Monday executions

    KARK - LITTLE ROCK, Ark. -- As of Sunday morning, there are no legal orders preventing the state from carrying out its plan to execute two death row inmates Monday night.

    Jack Jones and Marcel Williams are slated to die by lethal injection at 7:00 p.m. and 8:15 p.m. respectively. They would be the second and third convicted killers put to death by the state in a period of four days.

    Jones was convicted in 1996 of the brutal murder and rape of 34-year-old Mary Phillips and attempted murder of her 11-year-old daughter Lacy in Bald Knob. Jones has said he’s prepared to die for him crime.

    Williams is on death row for killing Stacy Errickson, a mother of two. He confessed to raping, beating, choking, and abducting her after she stopped for gas in Jacksonville.

    On Friday, a federal district judge declined the two inmates' plea to block the use of a controversial lethal injection drug. Jones and Williams argued they suffered from diabetes, sleep apnea and hypertension, which could lead to "botched" executions.

    This week, Arkansas executed its first inmate in 12 years. Weeks of controversy, protest, legal wrangling, and constant last-minute developments culminated Thursday night at 11:56 p.m. with the death of convicted murderer Ledell Lee.

    Arkansas gained international attention for its original plan to execute eight death row inmates over a period of 11 days. It would've been a record.

    Following intervention from the courts, four scheduled executions dwindled down to one: Ledell Lee. With three executions scheduled next week, it's still possible Arkansas could put four inmates to death over a period of seven days. Only Texas has executed more convicted killers over that many days.

    Kenneth Williams is slated to be executed on Thursday.

    Judge denies inmates' request to change execution viewing policy

    A district judge has denied motions by two death row inmates in the days leading up to their scheduled execution.

    On Sunday, District Judge Kristine Baker denied the request made by inmates Marcell Willams and Jack Jones Jr. to change the execution viewing policy.

    The inmates had asked that their attorneys be able to observe the entire execution process, starting when the inmates entered the death chamber as opposed to when they were strapped in and on the table.

    Also on Sunday, Williams and Jones filed an appeal with the 8th Circuit Court of Appeals on the decision made by Judge Baker to deny their motions for preliminary injunction in their as-applied Midazolam claims.

    The inmates were asking the judge to halt their executions, claiming their poor health could make the lethal injection procedure painful.

    Both Williams and Jones are set to be executed Monday night.

    The Latest: Arkansas Supreme Court rejects death row stays

    LITTLE ROCK, Ark. — The Latest on Arkansas' attempt to carry out the nation's first double execution since 2000 (all times local):

    12:40 p.m.

    The Arkansas Supreme Court has rejected requests for stays of execution from two inmates set to die in the nation's first double execution since 2000.

    Jack Jones Jr. and Marcel Williams had asked the state's highest court to stop their executions, which are set for Monday night. Arkansas is trying to use a sedative that expires at the end of the month, and if the men don't receive lethal injections as scheduled their executions will be off indefinitely. The state has said it has no new source for midazolam.

    In separate one-paragraph orders, justices said they would not reopen the men's cases and refused to issue stays of execution.

    Jones is scheduled to die at 7 p.m., with Williams' execution set for 8:15 p.m.

    A federal appeals court on Monday also rejected a stay request for Jones, while a stay request from Williams is still pending.

    Arkansas death row inmate Marcel Williams executed

    GRADY (KATV) — Marcel Williams was the second death row inmate to be executed by the state of Arkansas Monday night.

    Williams was put to death by way of lethal injection. The drugs were administered at 10:16 p.m. and Williams was pronounced dead at 10:33 p.m.

    Williams was convicted of killing Stacy Rae Errickson, a 23-year-old mother of two, in Jacksonville in 1994.

    The execution was scheduled for 8:15 p.m., but United States District Judge Kristine Baker issued a temporary stay to allow the court to investigate the claims that the previous execution of inmate Jack Jones "appeared to be tortuous and inhuman."

    The Court denied the emergency motion, and the stay was lifted at approximately 9:30 p.m.

    Earlier Monday, both the Supreme Court of the United States and the Arkansas Supreme Court denied all requests for a stay of execution.

    Before Williams' execution, death row inmate Jack Jones was executed. Their deaths mark the nation's first execution of two people in a single day in more than sixteen years.

    Attorney General Leslie Rutledge issued the following statement following Williams' death:

    “After years of delay, Stacy Errickson’s family and friends have seen justice carried out for her brutal death on November 20, 1994. Stacy was a young mother of two when she was kidnapped, raped and strangled to death with the drawstring from the hood of her own jacket. I hope that tonight’s lawful execution brings much-needed peace to all of Stacy’s loved ones, particularly her now-adult children Brittany and Bryan.”
