    State ordered to provide hepatitis C drug to Mumia Abu-Jamal

    A federal judge in Pennsylvania has mandated that the state should provide expensive new medication to former death-row inmate Mumia Abu-Jamal to treat his hepatitis C infection.

    The Philadelphia Inquirer reports (http://bit.ly/2hPl49z) Abu-Jamal sued to improve the health care he was receiving in prison after he fell into diabetic shock and was diagnosed with hepatitis C in 2015.

    The former Black Panther spent 29 years on death row following his conviction in the 1981 murder of white Philadelphia police Officer Daniel Faulkner. Abu-Jamal's sentence was reduced to life without parole in 2011.

    Judge Robert Mariani on Tuesday ordered that a doctor see Abu-Jamal to determine whether there is a medical reason he shouldn't get the treatment drugs, which can range from $50,000 to $75,000 per person or more.

    PHILADELPHIA – Former death-row inmate Mumia Abu-Jamal asked a judge Monday to vacate his previous failed appeals attempts so he can again appeal his case.

    A judge continued the hearing until Aug. 30 after a document Abu-Jamal's defense said they need to prove their petition was not found. The judge also approved a deposition of the employee who wrote the document to see if she can remember the contents.

    Abu-Jamal's lawyers are petitioning under the Post-Conviction Relief Act, arguing that the 64-year-old's rights were violated during previous appeals because of what they say is the bias of state Supreme Court Justice Ronald Castille.

    Castille is a former Philadelphia district attorney. As prosecutor, his office succeeded in getting the State Supreme Court to uphold Abu-Jamal's conviction.

    Abu-Jamal's attorneys say Castille should not have had any involvement in deciding his appeals after he became a judge.

    Philadelphia District Attorney's office spokesman Ben Waxman said the office looked for any documents that would be relevant to the argument that Castille had direct personal involvement in the case when he was prosecutor, but found none.

    The judge also asked the district attorney's office to reach out to Castille to see if he has the document in question in his personal papers.

    Abu-Jamal, a former Black Panther, spent 29 years on death row following his conviction in the 1981 murder of white Philadelphia police Officer Daniel Faulkner. Abu-Jamal's sentence was reduced to life without parole in 2011.

    Abu-Jamal has maintained his innocence and has become a symbol for groups seeking criminal justice reform.

    Lawyers arguing for another appeal in the case of former death-row inmate Mumia Abu-Jamal were granted a 60-day continuance due to a late piece of evidence presented earlier this week by the prosecution.

    Abu-Jamal attorney Judith Ritter argued successfully that a May 5, 1988, letter from the office of then District Attorney Ron Castille to a state representative discussing death penalty cases warranted the continuance to allow an extended period of discovery to allow the search for more evidence that may link Castille to the new document.

    Ritter argued the letter demonstrated Castille’s bias in seeking the death penalty against defendants convicted of killing police officers.

    “This demonstrates a possible link that Ron Castille was involved in seeing capital executions and that he was specifically tracking capital cases involving police officers,” Ritter argued before Judge Leon Tucker in Common Pleas Court. “It (the letter) indicates his bias, and it’s on those grounds that we're seeking a continuance.”

    Abu-Jamal’s lawyers are seeking to re-appeal his conviction in the 1981 shooting death of Philadelphia police officer Daniel Faulkner.

    Castille was the district attorney when Abu-Jamal was convicted. As a member of the state Supreme Court, he twice refused to recuse himself for two separate Abu-Jamal appeals.

    As a prosecutor, Castille prevailed in getting the Pennsylvania Supreme Court to uphold Abu-Jamal’s conviction and death sentence in 1989.

    Then as a Pennsylvania Supreme Court Justice, Castille agreed with the arguments he had made as district attorney.

    In two separate failed attempts to appeal — in 1998 and again in 2012 — Castille supported his position as district attorney to deny Abu-Jamal’s lawyers’ efforts.

    Earlier this year, Tucker ordered Philadelphia District Attorney Larry Krasner’s office to search for any record of Castille’s “personal involvement” in the Abu-Jamal case.

    Krasner’s office announced that additional evidence was not found, prompting Tucker to extend the discovery period again.

    Before announcing his decision of the latest extension, Tucker appeared annoyed that the latest piece of evidence had not been turned over to Abu-Jamal’s defense.

    Widow of slain officer removed from Mumia-Abu-Jamal hearing

    PHILADELPHIA (AP) — The widow of a police officer slain almost four decades ago was ordered removed from a courtroom after protesting a judge’s decision to extend the appeal hearing of former death row inmate Mumia Abu-Jamal (moo-MEE’-ah AH’-boo jah-MAHL’).

    The Philadelphia Inquirer reports that Maureen Faulkner protested after a judge granted a 30-day extension to defense attorneys seeking to have Abu-Jamal’s previous appeals vacated so they can file a new appeal.

    The paper reports that Faulkner was ordered escorted out as she continued to protest, and said on the way out “Thirty-eight years! This is wrong!” She apologized outside the courtroom. The judge said the court was “sensitive to both sides.”

    Judge holding evidence 'under advisement' to defer Mumia Abu-Jamal appeal decision

    A city judge is set to rule on whether Mumia Abu-Jamal, the man convicted of murdering Officer Danny Faulkner 37 years ago, should get another attempt at an appeal, after a brief hearing earlier Monday morning.

    The judge told the courtroom, packed with supporters from both sides, that he will hold all evidence and documents pertaining to the case “under advisement” and will make a decision at a later date, likely in a court filing.

    Faulkner’s widow, Maureen, flew in from California for the hearing, which lasted about five minutes.

    "I think that Judge Tucker wanted to make it formal, and so I decided to fly in. I think it’s perfectly fine, because now it’s on the record, and no one is able to say they did not understand or there was a misunderstanding," Faulkner said Monday.

    Outside Mumia Abu-Jamal supporters rallied, saying they will continue to fight for the 64-year-old.

    The latest appeal attempt stems from a 2016 U.S. Supreme Court decision, which ruled that former state Supreme Court Justice Ron Castille improperly ruled on another death penalty appeal, because he had significant prior involvement in that case.

    The defense has made the same argument for Abu-Jamal, and want another chance at a post-conviction appeal.

    Next Sunday will mark 37 years since Faulkner was shot and killed while making a traffic stop in Center City.

    PHILADELPHIA – A judge issued a split ruling Thursday that grants Mumia Abu-Jamal another chance to appeal his 1981 conviction in a Philadelphia police officer's death.

    Abu-Jamal spent nearly three decades on death row before his sentence in the shooting death of Officer Daniel Faulkner was thrown out over flawed jury instructions. Prosecutors then agreed in 2011 to a sentence of life without parole.

    The Pennsylvania Supreme Court rejected his final appeal in 2012. But after the defense this year pushed to get more documents in the case, Philadelphia Judge Leon Tucker ruled Thursday that former Justice Ronald Castille should have recused himself because of statements he made as a prosecutor about police killers that suggest a potential bias. They include campaign speeches and letters advocating the issuance of death warrants in such cases.

    The ruling, first reported by KYW-AM, gives Mumia the chance to reargue his appeal because of that perception of bias. However, Tucker rejected defense arguments that Castille had played a "significant" role in Abu-Jamal's appeal when he was Philadelphia district attorney and then ruled on the case as a judge.

    District Attorney Larry Krasner, through a spokesman, said he was reviewing the decision and had not yet decided whether to challenge it. Defense lawyer Judith Ritter said Tucker recognized the "need for a new appeal untainted by such bias."

    The case against Abu-Jamal, a former radio journalist, has received international attention among death-penalty opponents and criminal justice reform advocates.

    Faulkner's widow, Maureen, had a rare outburst in court earlier this year, noting the legal proceedings had gone on for 38 years and asking, "When is this case going to end for us?"

    PHILADELPHIA (AP) — A former Black Panther and death row activist convicted of killing a Philadelphia police officer decades ago will get a new appeals hearing after the city prosecutor on Wednesday dropped his opposition to it.

    Mumia Abu-Jamal, 64, is serving a life sentence after spending decades on death row in the 1981 slaying of Officer Daniel Faulkner, who had pulled his brother over in an overnight traffic stop.

    Abu-Jamal, who was shot during the encounter, was largely tried in absentia at his 1982 capital murder trial, after being removed over his repeated objections and efforts to serve as his own lawyer.

    A former radio journalist, Abu-Jamal's prison writings made him a popular cause among death penalty opponents worldwide — and a foe of police unions and the slain officer's widow. The attention to his case quieted after his death sentence was set aside over flawed jury instructions in 2011, and his appeals appeared exhausted.

    However, in December, Philadelphia Common Pleas Judge Leon Tucker granted Abu-Jamal a new chance to argue his initial appeal after the U.S. Supreme Court said a former Pennsylvania Supreme Court justice had improperly heard a murder case he had overseen as Philadelphia district attorney. The justice, Ronald Castille, had done the same in Abu-Jamal's case.

    District Attorney Larry Krasner initially fought Tucker's order, fearing it could affect a large number of cases. On Wednesday, he dropped his challenge, citing a revised ruling from Tucker that narrows the scope of his order.

    Krasner agreed that Castille should not have worn "two hats" in the case, a fact made more egregious, he suggested, by the discovery of a 1990 note Castille sent Gov. Robert Casey about "police killers," urging him to issue death warrants to "send a clear and dramatic message to all police killers that the death penalty actually means something."

    "Although the issue is technical," said Krasner, a longtime civil rights lawyer, "it is also an important cautionary tale on the systemic problems that flow from a judge's failing to recuse where there is an appearance of bias."

    Castille told The Associated Press last year that Abu-Jamal's lawyers never asked him to step down from the appeal. He served as district attorney after Abu-Jamal's murder trial. He said his colleagues on the Supreme Court "knew I'd signed off on the appeal (filings), but I had nothing to do with the trial."

    Tucker, in his opinion, said "the slightest appearance of bias or lack of impartiality undermines the entire judiciary."

    Judith Ritter, a lead lawyer for Abu-Jamal, said her client will now get a chance to air the alleged trial errors at "a fair appellate hearing."

    “The D.A’s decision is in the interests of justice. We look forward to having our claims of an unfair trial heard by a fair tribunal,” said Ritter, a professor at Widener University’s Delaware Law School.

    Mumia is going to get to walk because Krasner is a Soros shill. When Mumia gets out he won't enjoy his "freedom" that long however.
