and....all of Pennsylvania's executions since 1976 have been volunteers, and....Pennsylvania has not adopted a lethal injection protocol.

    Briggs remains on death row

Dustin Briggs was tried and found guilty in 2006 by a 12-member jury from Bradford County for the murders of Michael VanKuren and Christopher Burgert.

The jury imposed the death sentence on Briggs for his crimes.

The Pennsylvania Attorney General's office, which prosecuted the case, reported recently that Briggs remains on death row at the Greene State Correctional Institution in Waynesburg, Pa. His case has been appealed to the U.S. District Court, and his attorneys have until May 19 to file their motions before the judge.

    Bradford County Death Sentence Overturned

BRADFORD COUNTY, Pa. (18 NEWS) - The man sentenced to death for the 2004 murders of two Bradford County Sheriff's Deputies is no longer on death row.

The sentence for Dustin Briggs has been reduced to life without parole.

Briggs had filed a petition under the Post-Conviction Relief Act, which allows review of cases after appeals have been denied.

Today a judge ruled the jury in Briggs' case was given improper instructions about weighing evidence for the death penalty.

"There is a point in the history of a society when it becomes so pathologically soft and tender that among other things it sides even with those who harm it, criminals, and does this quite seriously and honestly. Punishing somehow seems unfair to it, and it is certain that imagining ‘punishment’ and ‘being supposed to punish’ hurts it, arouses fear in it." Friedrich Nietzsche
