    Jury selection begins in death-penalty murder trial of Kevin "Yummy" Mattison


    The death-penalty murder trial of a man accused of gunning down a York City resident while robbing him of a pound of pot began with jury selection Monday in York County Court.

    Kevin Mattison, 34, of Baltimore, is charged with first-degree murder, robbery and related offenses. If convicted of first-degree murder, prosecutors will seek the death penalty for him.

    Chief deputy prosecutor Tim Barker said jury selection is expected to last three or four days, meaning Mattison's trial might not begin until Thursday.

    The defendant is being represented by defense attorneys Joanne Floyd and Jeff Marshall.

    The background: York City Police said Mattison barged into the 610 W. Philadelphia St. home of Christian Agosto, 34, on Dec. 9, 2008, and shot Agosto in the head after robbing him of a pound of marijuana.

    According to court documents, Johnson had called Agosto's girlfriend, Tiffany Kenney, and told her Agosto was seeing another woman.

    Kenney met with Mattison about 11 p.m. Dec. 9, 2008, and they went to Agosto's apartment. Kenney went inside Agosto's apartment and confronted him and the woman there with him, police said.

    Mattison followed Kenney into the apartment, brandished a gun and ordered everyone to the ground, police said.

    Kenney fled into the hallway, while Mattison demanded Agosto tell him where the marijuana was hidden, police said.

    Mattison took the pound of marijuana from a kitchen cupboard, then shot Agosto in the head and fled, police said.

    Convicted murderer: Mattison, also known as "Yummy," is already a convicted murderer.

    According to prosecutors, Mattison pleaded guilty in Baltimore to the equivalent of Pennsylvania's third-degree murder in the mid-1990s, when he was 17.

    He was sentenced to 20 years in prison, with the final 10 years suspended, prosecutors said; Mattison also has a pending rape charge in Maryland.

    Jury selection still under way in death-penalty trial of Kevin Mattison

    Jury selection continued Thursday in the death-penalty trial of Kevin Mattison, accused of fatally shooting a York City resident while robbing him of a pound of marijuana.

    Kevin Mattison, 34, of Baltimore, is charged with first-degree murder, robbery and related offenses.

    Chief deputy prosecutor Tim Barker said on Thursday morning that 10 jurors have been seated so far. Including alternates, a total of 16 jurors must be chosen, he said.

    Jury selection began Monday morning.

    York City Police said Mattison barged into the 610 W. Philadelphia St. home of Christian Agosto, 34, on Dec. 9, 2008, and shot Agosto in the head after robbing him of a pound of pot.

    Mattison, also known as "Yummy," is already a convicted murderer.

    Testimony starts in murder trial

    Sixteen jurors heard two sides of the story of Christian Agosto's murder on Monday as opening arguments were presented in a case for which the death penalty will be sought if defendant Kevin "Yummy" Mattison is found guilty.

    After a week of jury selection, the trial started Monday morning before Common Please Judge Gregory Snyder.

    Mattison, 34, of Baltimore, is charged with the first-degree murder, robbery, and burglary for allegedly shooting Agosto in the head and stealing a pound of marijuana from his West Philadelphia Street apartment on Dec. 9, 2008.

    Two-timing preceded fatal shooting, witnesses say

    Christian Agosto's alleged philandering is what brought his killer to his apartment, commonwealth witnesses said Tuesday in York County court.

    Kevin Mattison, 34, of Baltimore is on trial for first-degree murder in the fatal shooting of Agosto, 34, in York. He could be sentenced to the death penalty if convicted of first-degree murder.

    On Tuesday, Julmeala Jung, Mattison's estranged wife, testified they came to York on Dec. 9, 2008, to visit relatives. She said that, after picking up her cousin, Heather Johnson, they went to an apartment building in the 600 block of West Philadelphia Street to see Johnson's baby.

    In the parking lot, Jung said, Johnson spotted Agosto with a woman. Jung said Johnson quickly called Agosto's girlfriend, Tiffany Kenney, to tell her.

    The group, with Mattison driving, left the lot, picked up Kenney and returned to the apartment building.

    Jung recalled Kenney was angry and that she said she was "going to kick in (Agosto's) door."

    Witnesses from two days of testimony in the York County Judicial Center said Agosto refused to answer the door when Kenney banged on it and called his cell phone.

    Kenney testified Tuesday that Mattison jimmied the front door to Agosto's apartment. She admitted she cursed and struck Agosto because the other woman, Paui'elle Generette, a friend of Kenney's, was with him.

    Kenney told the jury Mattison pulled a gun and ordered everyone to the floor. She said Mattison told her to leave while he kept Agosto and Generette at gunpoint. Generette earlier testified Mattison then demanded to know, "What you got?"

    Generette said Agosto pointed to a kitchen cupboard, where Mattison found and took a pound of marijuana. She said Mattison shot Agosto in the head before leaving.

    Jung, who said she had waited in the car, testified Mattison and Johnson didn't speak when they returned. Kenney, she said, kept repeating, "Oh my God."

    "She was in shock," Jung said.

    The death-penalty murder trial of Kevin "Yummy" Mattison continued Wednesday with testimony from more prosecution witnesses.

    They included York City Police Officer Jason Jay, who collected evidence from the crime scene of the Dec. 9, 2008, slaying.

    Mattison, 34, of Baltimore, is accused of breaking into the 610 W. Philadelphia St. home of Christian Agosto, robbing him of a pound of marijuana and shooting Agosto in the head.

    Agosto, 34, was a marijuana dealer, testimony revealed.

    On the witness stand, Jay reviewed the evidence he collected from Agosto's home, including a single spent shell casing and a blood trail from the living room of the apartment to the victim's bedroom.

    Jay testified he also found a stash of money atop a set of kitchen cabinets and about 4 pounds of pot in the cabinet under the kitchen sink.

    Set up? Defense attorney Joanne Floyd has suggested Mattison was framed by his estranged wife, her cousin, Agosto's girlfriend and another woman with whom Agosto was sexually involved.

    Mattison is charged with first-degree murder, robbery and related offenses.

    If Mattison is convicted of first-degree murder, chief deputy prosecutor Tim Barker will seek the death penalty.

    Mattison is already a convicted murderer.

    York murder case in hands of the jury

    York, PA - The jury in the Kevin Edward Mattison capital murder trial began deliberations Thursday afternoon and will continue Friday morning.

    Mattison, 34, of Baltimore, is accused of robbing and shooting Christian Agosto in Agosto's West Philadelphia Street apartment Dec. 9, 2008. Agosto, 34, died a week later at York Hospital from a gunshot wound to the back of his head.

    The York County District Attorney's Office is seeking the death penalty because Mattison allegedly killed Agosto while committing another felony -- breaking into Agosto's West Philadelphia Street apartment and robbing him of a pound of marijuana -- placed a witness in risk of death, and had been previously convicted of a murder in Maryland for which he served 10 years.

    If Mattison is convicted of first-degree murder, the penalty phase of the trial is expected to begin immediately in York County court.

    Mattison sentenced to death for York City killing

    Kevin "Yummy" Mattison will be sentenced to death for killing a York City drug dealer.

    The jury this morning found him guilty of all charges related to the 2008 slaying; then determined this afternoon that he should be executed for the crime.

    Family members cried after the sentence was read, and Mattison turned to tell them he loved them as sheriff deputies led him away.

    Jurors deliberated about three hours Thursday evening and Friday morning before announcing they'd found Mattison guilty of first-degree murder, two counts of robbery, and burglary.

    Friday afternoon, they deliberated on whether the defendant will face the death penalty or life in prison.

    Prosecutor Tim Barker said the jury had to weigh whether the aggravating circumstances of the case -- the fact that the murder was committed in the perpetration of a felony and the fact that Mattison has already served time for murder -- reached the level necessary to warrant the death penalty in Pennsylvania.

    Mattison pleaded guilty in Baltimore to the equivalent of Pennsylvania's third-degree murder in the mid-1990s, when he was 17.

    Baltimore man sentenced to death for 2008 York City murder

    Perhaps Pavi-Elle Generett will be able to sleep through the night, now that the man who robbed her and murdered her friend has been sentenced to death.

    Kevin "Yummy" Mattison appeared for sentencing Tuesday morning before Common Pleas Judge Gregory M. Snyder. Although a jury in December determined Mattison should die for his crimes of first-degree murder, robbery and burglary, a judge must still formally impose the punishment.

    Snyder sentenced Mattison, 34, of Baltimore, to death for executing Christian Agosto "in cold blood," plus a consecutive 30 to 60 years in prison for robbing both Agosto and Generett and burglarizing Agosto's apartment. The judge said there is no question in his mind the sentence is appropriate.

    Given the opportunity to speak in court, Mattison calmly brought up a procedural issue in his case, and said "nobody helped me prepare for my case," meaning his attorneys.

    He was stopped by Judge Snyder, who called it "an inartful attempt" to raise post-conviction appeal issues. In Pennsylvania, death-penalty cases are automatically appealed to the state Supreme Court.

    'Predator': York City Detective Al Clarkson, lead investigator in the Agosto murder case, said he wasn't surprised Mattison didn't apologize in court Tuesday.

    "I didn't see any remorse (from him) over this two-year process," Clarkson said. "He's a predator. He knows what he did -- he's not going to have remorse."

    Generett, who saw Mattison gun down Agosto, expressed disappointment.

    "He could've apologized for his actions. I was just an innocent person," she said. "As many times as he looked back at me (Tuesday in court), I just feel like he could've apologized."

    Generett testified against Mattison at his death-penalty murder trial in December.

    She was visiting Agosto, 34, at the victim's 610 W. Philadelphia St. home Dec. 9, 2008, when Mattison burst in, robbed Agosto of a pound of marijuana and fatally shot him in the head. Trial testimony revealed Agosto was a marijuana dealer.

    'Nightmare': Generett said she was satisfied with Mattison's sentence.

    "I just feel like justice was finally served. I can move on with my life," she said. "These last two years have been a nightmare for me."

    Generett said she suffers nightmares regularly due to having witnessed the murder, but said she was able to stay strong for her young daughter.

    Now, she hopes the worst is over.

    "I'm OK," Generett said. "I'm happy."

    Chief deputy prosecutor Tim Barker described Generett as "truly just an innocent bystander who was robbed as well."

    Barker said he's pleased Judge Snyder ran Mattison's robbery and burglary sentences consecutively to his death sentence.

    "It demonstrates the full scope of what the defendant did," he said. "This is an aggravating a circumstance as you can have."

    Barker also said he's confident the conviction and sentence can withstand any appeal.

    Second murder: This is Mattison's second murder conviction.

    According to prosecutors, Mattison pleaded guilty in Baltimore to the equivalent of Pennsylvania's third-degree murder in the mid-1990s, when he was 17.
