    Pa. Supreme Court weighs competency of mass killer

    The Pennsylvania Supreme Court is weighing whether a man convicted of killing 13 people is competent to face execution.

    The Citizens' Voice of Wilkes-Barre says an attorney for 68-year-old mass murderer George Banks told the high court that the defendant is completely psychotic.

    But a state prosecutor argued in Harrisburg on Tuesday that Banks has moments of clarity and the capability to understand he is facing the death penalty.

    Banks has been on death row since being convicted of a 1982 shooting rampage in Wilkes-Barre and Jenkins Township.

    A Luzerne County judge ruled in May that Banks is incompetent to help his attorneys and unfit for execution. Prosecutors want the high court to overturn the decision.

    Pa. high court rules mass killer George Banks not competent to be executed

    Pennsylvania's highest court has ruled that mass killer George Banks is mentally incompetent to be executed.

    The state Supreme Court issued a unanimous ruling Wednesday regarding the man who killed 13 people with a semi-automatic rifle in northeastern Pennsylvania nearly 30 years. The victims included five of his own children.

    Banks was convicted and has been on death row since the shootings near Wilkes-Barre occurred in 1982.

    In 2004, then-Gov. Ed Rendell signed a death warrant for Banks but the execution was stayed after his mother filed a petition asserting that it would violate the U.S. Constitution.

    In the latest ruling, the justices said testimony by medical experts at a competency hearing last year established that Banks suffers from severe mental illness and is delusional about his crimes and punishment.

    Given that it was a unanimous ruling, Banks must be truly over the rainbow...or else a mighty good faker.

    Today, the US Supreme Court declined to review the Pennsylvania Supreme Court's decision that Banks is mentally unfit to be executed.
