    Facts of the Crime:

    Convicted of killing Newtown Officer Brian S. Gregg in the emergency room of St. Mary Medical Center in Bucks County in 2006. Mr. Flor also wounded another officer and a hospital worker.

    Flor was sentenced to death in Bucks County on November 17, 2006.

    Pennsylvania Supreme Court upholds death penalty in shooting of Newtown officer

    The Pennsylvania Supreme Court on Thursday upheld the death penalty for Robert Flor, who in 2005 shot a Bucks County police officer in the abdomen, then stood over him and shot him twice in the head.

    Flor, now 43, was sentenced to death for killing Brian Gregg, 46, a Newtown Borough police officer. He also shot a police officer and an emergency medical technician at St. Mary Medical Center in Middletown Township.

    The court did vacate Flor's sentence on 10 counts of a lesser offense, ruling that the prison time exceeded the statutory maximum, and sent that part of the case back to the trial court.

    The Supreme Court review is automatic for death-penalty cases, and Flor raised 11 issues for appeal. The court rejected all but 1.

    Flor was sentenced to 20 to 40 years on 10 counts of recklessly endangering another person. There is a 2-year maximum for each count, so the total should not have exceeded 20 years, the court ruled.

    Flor was arrested for drunken driving Sept. 29, 2005. He was taken to St. Mary to have his blood and urine tested.

    His handcuffs were removed for his urine test by Newtown Borough Officer James Warunek. Flor grabbed Warunek's gun and shot the officer in the chest.

    Flor then shot Gregg and Joseph Epp, the emergency medical technician. Flor returned to Warunek and pulled the trigger, but the gun had run out of bullets.

    Flor fled, but police found him in the hospital's parking garage.

    Gregg abandoned a career as a carpenter to be a police officer and was 2 days shy of his 1st anniversary with the Police Department when he was killed.

    In today's United States Supreme Court orders, Flor's petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    On May 17, 2011, Flor filed a habeas petition in Federal District Court.

    Governor Corbett signs fifth execution warrant

    August 3, 2011 marked the fifth execution warrant that Governor Corbett has signed since taking office on January 18, 2011.

    The execution warrant was signed for Robert Anthony Flor, 44, of Bucks County. Flor pleaded guilty to first-degree murder in October 2006 for the shooting death of Newtown Borough Police Office, Brian Gregg, 46. On September 29, 2005, police took Flor into custody for suspected drunken driving. Flor grabbed another policeman’s weapon and started shooting, wounding two others officers and killing Officer Gregg. Flor is a prisoner at the State Correctional Institution at Greene. His execution by lethal injection is scheduled for September 29, 2011.

    The other four execution warrants signed by Governor Corbett are as follows:

    February 8, 2011, Governor Corbett signed his first two execution warrants for Dennis C. Reed and Aquil Bond.

    Dennis C. Reed, 39, of Lawrence County, was convicted of first-degree murder in February 2008. Reed shot and killed Wendy Miller in December 2001. Reed is a prisoner at the State Correctional Institution at Greene. His execution by lethal injection was scheduled for Tuesday, April 5, 2011.

    Aquil Bond, 32, of Philadelphia County, was convicted of first-degree murder in May 2005. Bond shot and killed Rasheed Grant in December 2002. Bond is a prisoner at the State Correctional Institution at Graterford. His execution by lethal injection was scheduled for April 7, 2011

    March 14, 2011 Governor Corbett signed his third and fourth execution warrants for James A. Dennis and Richard R. Laird.

    James A. Dennis, 40, of Philadelphia, was convicted of first-degree murder in October 1992. Dennis shot and killed 17-year-old Chedell Williams in October 1991 during a robbery attempt as she walked home from school. Dennis is a prisoner at the State Correctional Institution at Greene. His execution by lethal injection was scheduled for May 10, 2011.

    Richard R. Laird, 47, of Bucks County, was convicted of first-degree murder in December 1987. He was prosecuted for stabbing to death 26-year-old Anthony Milano. Milano had given Laird a ride home from a tavern. Laird is a prisoner at the State Correctional Institution at Greene. His execution by lethal injection was scheduled for May 12, 2011.

    Since the 1978 reinstatement of the death penalty, Pennsylvania governors have signed 391 execution warrants. Gary Michael Heidnik, Philadelphia’s most infamous serial killer, was executed by lethal injection on July 6, 1999. The Commonwealth of Pennsylvania has not followed through with an execution since Heidnik’s.

    Late stay granted for Bucks County execution

    He was sentenced to death after killing a Bucks County Police officer, Thursday is the 6th anniversary of that crime and the day Robert Flor was supposed to be executed.

    But there will be no execution, at least not right now.

    Newtown Borough Police Officer Brian Gregg was shot and killed in the line of duty in 2005 after he stopped Robert Flor on suspicion of DUI.

    Flor was taken to the hospital for blood tests, where he got a hold of another officer's gun and started firing.

    Bucks County Judge Dianne Gibbons was the District Attorney back then and prosecuted the case that resulted in a death sentence.

    "To the extent that people are concerned maybe the system isn't fair and maybe we are getting the wrong people," said Gibbons. "Not in this case and not in this county."

    Governor Tom Corbett signed Flor's death warrant August 2nd. He was supposed to be executed September 29th, the 6th anniversary of the shooting rampage.

    But a federal court has issued a stay of execution.

    "There are no mistakes here. Nobody but Robert Flor committed the crime with which he is charged," said Bucks County District Attorney David Heckler. "But there are a group of people who are committed to preventing the death penalty from being imposed."

    Death penalty cases get drawn out when they hit the federal appeals process, Hecker said. The timing in which cases are resolved is the responsibility of the court. The federal court is just not getting it done, he said.

    "However it is decided it should be decided so we can move on. If we need to retry him we're ready to do that," said Heckler.

    Heckler says he expects if Flor is put to death, it will be many years from now.

    Something that offers little comfort to the people Officer Gregg left behind.

    "The community misses him terrible and so do we," said Newtown Borough Police Chief Anthony Wojciechowski.

    Pa. man on death row says he's mentally disabled

    A Pennsylvania man convicted of fatally shooting a police officer in a hospital emergency room says he is mentally disabled and his death sentence should be overturned.

    Forty-six-year-old Robert Flor is on death row for the September 2005 killing of Newtown police officer Brian Gregg at St. Mary Medical Center.

    The Bucks County Courier Times (http://bit.ly/GUs7ek) said Flor was in court Friday with a team of lawyers, who argued his former attorneys didn't work hard enough to keep him off death row.

    Flor's new lawyers say jurors who handed down his death sentence weren't told he is mentally disabled. The U.S. Supreme Court has ruled that executing mentally disabled people is unconstitutional.

    Prosecutors say Flor's attorneys in 2006 presented several experts at trial, none of whom concluded he's intellectually disabled.

    Cop killer Robert Flor wants to fire his attorneys.

    In a brief, profanity-laced outburst at his appeal hearing in Bucks County Court in Doylestown Thursday, Flor used foul language to describe his team of attorneys from the Federal Community Defender Office and complained about their work.

    Bucks County Judge Alan Rubenstein called a recess and the lawyers talked to Flor. After a few minutes, the hearing continued without further fireworks.

    But outside the courtroom, Flor reiterated his wish to get rid of his counselors.

    “Cause they're not doing what I asked,” he explained.

    Flor did not elaborate, but promised to talk more if a reporter visited him in prison.

    Flor, 47, of Falls has been on Pennsylvania's death row since 2006. That's when a Bucks County jury sentenced him to capital punishment for the 2005 murder of Newtown police Officer Brian Gregg.

    The jury found that Flor fatally shot Gregg and wounded two others during a rampage at St. Mary Medical Center in Middletown on Sept. 29, 2005.

    Gregg and another officer had brought Flor to the hospital for blood testing as part of a DUI arrest. The incident began after Flor's handcuffs were removed so that he could use a restroom.

    Witnesses said Flor grabbed the other officer's gun and leveled it at Gregg, then stood over the dying officer and shouted, “die pig, die!” as he fired more shots.

    Thursday's hearing was part of a Post Conviction Relief Act appeal that Flor filed. His attorneys have said that Flor's death sentence should be overturned because he is intellectually disabled and, therefore, legally ineligible for execution.

    Several mental health experts who previously testified at Flor's murder trial took the stand and answered questions about Flor's intelligence and mental health. Experts' reports were referenced that said Flor has “sub-average intellectual functioning” due to fetal alcohol syndrome, as well as an IQ of 73, which is below average.

    Under cross-examination by First Assistant District Attorney Michelle Henry, the doctors conceded that they did not diagnose Flor as intellectually disabled — previously called mentally retarded — in 2006, saying they came to that conclusion after receiving more information as part of the appellate process.

    More hearings are scheduled in the case later this year, then Rubenstein will rule on the matter. The judge asked the experts numerous questions, confirming that Flor knew what he was doing at the time of the attack.

    Flor's execution was scheduled in 2011 but stayed due to numerous appeals filed on his behalf. After the outburst Thursday, he was sedate for the rest of the hearing, appearing at times to be on the verge of falling asleep at the defense table.

    Cop killer's appeals to resume Thursday

    Robert Flor’s most recent appeal begins again Thursday.

    The convicted cop killer’s last appeal hearing featured a profanity-laced outburst after which Flor, 47, said he wanted to fire his attorneys.

    Members of the Federal Defender’s Office and the Bucks County Public Defender’s Office did not return calls for comment Wednesday. It is unclear who is defending Flor at this point as both offices have filed motions on Flor’s behalf in the past year.

    Flor, formerly of Falls, has been on death row since 2006 and is currently kept in the State Correctional Institute at Graterford. He was sentenced to death by a Bucks County jury for the murder of Newtown police Officer Brian Gregg in 2005. Flor was in St. Mary Medical Center in Middletown Sept. 29, 2005, awaiting blood testing following his arrest for a suspected DUI. Flor grabbed another officer’s gun when his handcuffs were removed for him to use a restroom.

    He shot Gregg and then stood over the dying man, shouting, “die, pig, die!” as he continued to fire. Flor also wounded the officer whose gun he took as well as a hospital technician during the incident.

    Flor’s attorneys at the time his appeal was filed were seeking to have his death sentence overturned, citing an intellectual disability that would exclude him from execution by the state. The appeal is based on the Post Conviction Relief Act, or PCRA, that allows a defendant to challenge his or her conviction, or, in Flor's case, the legality of his sentence.

    At the earlier hearing in May, several experts testified that Flor has “sub-average intellectual functioning” due to fetal alcohol syndrome. His IQ is 73, below average.

    However, First Assistant District Attorney Michelle Henry cross-examined the experts, who admitted their assessments were done during the appeals process and that during his trial they had not deemed him intellectually disabled.

    Common Pleas Judge Alan Rubenstein is scheduled to hear more arguments from the attorneys Thursday and Friday before making a ruling on the appeal.
