    Death row inmates win 2nd chance in lawsuit

    A trio of Kentucky death row inmates (Robert Foley, Roger Epperson and Vincent Stopher) will get another chance to show they have a right to a sweat lodge, pow wow and traditional foods to conduct Native American religious ceremonies behind bars at the prison.

    The U.S. 6th Circuit Court of Appeals in Cincinnati on Friday ordered part of a lawsuit brought by those inmates be reinstated after concluding that state officials failed to show compelling reasons for denying their requests.

    The appeals court also turned away a related bid by two condemned inmates (Randy Haight and Gregory Wilson) to get monetary damages from prison officials for changing the rules on pastoral visits to those on death row.

    U.S. District Judge Thomas B. Russell ruled in 2013 that the prison's rejection of the requests were necessary for the security of inmates and others.

    Kentucky death row inmate asking high court to review case

    FRANKFORT, Ky. (AP) - A Kentucky death row inmate is asking the state Supreme Court to review his conviction in a 1985 slaying that left a woman dead and her father injured.

    Earlier this month, the justices granted for 64-year-old Roger Dale Epperson the right to file his appeal as a pauper.

    A jury convicted Epperson and a co-defendant, 63-year-old Benny Lee Hodge, of attacking Tammy Acker and the attack on her father, Dr. Roscoe Acker, in the Fleming-Neon community of Letcher County. The group stole more than $2 million. Dr. Acker survived a strangulation attempt. Tammy Acker was more than a dozen times with a knife. She was a college student due to return to school.

    Another co-defendant, 56-year-old Donald Terry Bartley, pleaded guilty to playing a role in the 1985 slaying.

    Death sentence switched to life for man guilty of murder

    PIKE, Ky. (AP) — A Kentucky man on death row for murdering a student has worked out a deal to convert his death sentence into a life sentence without parole.

    The Lexington Herald-Leader reports Circuit Judge Eddy Coleman approved a motion Friday to set aside 69-year-old Roger Dale Epperson's death sentence and re-sentence him to life without parole.

    Epperson was convicted of murdering 23-year-old Tammy Dee Acker in August 1985. The University of Kentucky student was fatally stabbed during a robbery at her father's home.

    Epperson has an appeal pending in federal court of his conviction and sentence which could have gone on until Epperson was in his 80s.

    The judge and Acker's family agreed that if Epperson would give up the appeal of his conviction the death sentence would be removed.

    KDOC has Epperson being listed as an active death row inmate so I guess he was actually sent back at some point.
